Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, reviewing the proposed use of the property and reasons for relocating the business. Staff reviewed the staff report, noting surrounding zoning and land use. Staff reviewed previous request for C-3 General Commercial zoning in the Cedar Cross Road Corridor, existing vehicle counts, allowed uses in the C-3 District, and proposed uses by Tri-State Independent Blind Society. There were no public comments. The Zoning Advisory Commission discussed the request, and had no objections to the rezoning. Recommendation By a vote of 5 to 0, with one abstention, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. The property has remained vacant until the present. Physical Characteristics: The subject property is a level, 3.1 acre lot with over 400 feet of frontage along Cedar Cross Road. There is no vegetation currently on the lot. Concurrence with Comprehensive Plan: The Land Use and Urban Design element of the City's Comprehensive Plan states: "To promote a compatible mix of land uses" and to "To buffer and protect incompatible uses from each other." The 2030 Future Land Use Plan calls for this property to be developed for light industrial uses. Impact of Request on: Utilities: Existing utilities are adequate to serve the site Traffic Patterns/Counts: ]DOT 2013 data indicates 9,100 average daily vehicle trips along Cedar Cross Road in front of the subject property. Access to the property will be taken from Cedar Cross Road. Development of this property should generate little additional traffic relative to the overall traffic along Cedar Cross Road. Public Services: Existing public services are adequate to serve the site. Environment: Staff does not anticipate any adverse impact to the environment provided adequate erosion control and storm water management is provided during all phases of development. Adjacent Properties: The subject property is located along a busy commercial corridor and is bordered by retail, commercial service and light industrial uses. The bulk regulations and I Rezoning Staff Report- Lot 1, Cedar Ridge Farm Place#9 Page 2 parking requirements for both the LI Light Industrial district and the C-3 General Commercial district are similar. Development of the subject property for any of the uses permitted in the C-3 district should have little negative impact on the adjacent properties. CIP Investments: None proposed. Staff Analysis: The applicant is proposing to rezone a level, 3.1 acre lot located on Cedar Cross Road from LI Light Industrial to C-3 General Commercial district to facilitate relocation of Tri-State Blind Society's office, bingo activity, low vision clinic and retail outlet from its current Asbury Road location. The subject property is located along the Cedar Cross Road commercial corridor and is surrounded by retail commercial and commercial services business activity. The property is located directly adjacent to a gas station/convenience store and contractor's shop and across the street from a multi-tenant commercial building and equipment rental business. Tri-State Blind's proposed facility will take its access from Cedar Cross Road and will be required to provide adequate parking, landscaping and storm water management. The amount of traffic, activity and demand on parking generated by the proposed facility should not be dissimilar to that potentially generated by the uses currently permitted in the LI Light Industrial district. Planning staff recommends the Commission review the criteria established in Article 9.5 of the Unified Development Code regarding property reclassification.
