INTRODUCTION
Enclosed is a proposed agreement between the City of Dubuque, Dubuque
County, and the Iowa Department of Transportation for the completion of the
Addendum to the 1999 Southwest Artedal Environmental Assessment.
DISCUSSION
The Iowa Department of Transportation (IDOT) has recently made a decision to
stop work on the addendum for the 1999 Southwest Arterial Environmental
Assessment for the Seippel Road alternative. However, the Policy Board of the
Dubuque Metropolitan Area Transportation Study (DMATS) is on record stating
that the development of IA 32, Southwest Arterial, is the urbanized area's
Number 1 transportation priority project. To this extent, the Policy Board has
programmed MPO Surface Transportation Funds for location and environmental
study work for the Southwest Corddor development project. In addition, the
Policy Board has committed future MPO federal aid resources for the
construction phase of the project. The Policy Board is desirous of completing the
supplemental environmental assessment work in a timely manner in order to
allow the project to move into the next phase of development.
To this end, the City of Dubuque has agreed to take over the study work and
administer the environmental assessment through completion. In addition,
funding to complete the work would come from commitments of present and
future allocations of federal aid funds provided to DMATS for programming and
would be matched with City and County funds. It is also understood that the
DMATS Policy Board has approved commitment of present and future allocations
of federal aid to support the completion of the supplemental environmental
assessment study and the Environmental Mitigation Phase III - Archeology Work
to be accomplished in the future.
It is proposed, therefore, that the IDOT will execute a copy of the contract
modification to the US 20 Capacity Study contract with HDR Engineering of
Omaha, Nebraska, to add the remaining work necessary to complete the
addendum to the 1999 Southwest Artedal Environmental Assessment. Specific
work tasks to be covered by the supplemental agreement are to be determined
by the City and County in cooperation with the IDOT and the consultant. The
City shall manage the supplemental agreement, and in doing so, shall be
considered to be a sub-recipient of federal aid funds, and as such, agrees to
comply with all terms and conditions for use of federal funds that may be required
of the IDOT in completing the study.
The City will administer the study with the oversight of a Technical Committee to
oversee and participate in the study effort to be performed by the consultant.
The Technical Committee will consist of the following representatives:
1. City of Dubuque, Public Works Director
2. Dubuque County, County Engineer
3. DMATS, Transportation Director
4. IDOT, District Planner, Davenport
RECOMMENDATION
I recommend that the City Council approve the proposed agreement between the
City of Dubuque, Dubuque County, and the Iowa Department of Transportation
for the completion of the Addendum to the 1999 Southwest Arterial
Environmental Assessment.
BUDGET IMPACT
The City and County have committed a total not to exceed $594,000 to cover the
costs of the supplemental agreement. A total of $475,200 (80% of the total) of
DMATS Surface Transportation Funds is to be programmed. The City and
County shall each provide $59,400 (10% of the total), for a total of $118,800 to
match the STP funds. Any costs incurred in completing the supplemental
agreement which exceeds $594,000 shall require the approval of the City and the
County.
The City shall make all pedodic payments to the consultant; and upon doing so,
shall submit an invoice to the IDOT for reimbursement of the 80% of the federal
share of the amount paid to the consultant. The City shall request from the
County an amount equal to 10% of the amount paid to the consultant.
If the IA 32 project moves into design and construction, the proposed
Environmental Mitigation Phase III - Amheology Work will be administered by the
City of Dubuque. Funding for this work will come from the DMATS MPO Surface
Transportation Funds (80% of the total) to be matched with City and County
funds (20% of the total). This estimated cost ranges from $3.5 to $5.6 million.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution authorizing the
Mayor to execute three copies of the proposed agreement for the completion of
the Southwest Arterial Environmental Assessment.

1999 Southwest Arterial Environmental Assessment; and
Whereas, the City Council of the City of Dubuque approves the terms and
conditions of said agreement.

This Agreement, is entered,, into by and between the Io~va Department of Transportation,
hereinafter designated the DOT", the City of Dubuque Iowa, hereafter designated the "City"
and the Dubuque County Board of Supervisors, hereafter designated the "County" in accordance
with 761 Iowa Administrative Code Chapter 150 and Iowa Code sections 28E. 12 and 306A;
WITNESSETH; that
WHEREAS, the City, County and DOT propose to establish Primary Road No. Iowa 32 as
the Southwest Connector within the City and County; and
NOW, THEREFORE, IT IS AGREED as follows:
The DOT has recently made a decision to stop work on the addendum to the 1999
Southwest Arterial Environmental Assessment for the Seippel Road alternative. The
decision was based in part on the need by the DOT to place constraints on and prioritize
spending because of declining revenues, but also to allocate available and projected
financial resources to accomplish priority projects statewide as determined by the Iowa
Transportation Commission.
The need to stop the study has been discussed with the Metropolitan Planning
Organization (herein MPO), Dubuque Metropolitan Area Transportation Study (herein
DMATS) Policy Board. The Policy Board is on record stating that developmen~ of IA 32,

Furthermore, the Policy Board has previously progranxtned MPO Surface Transportation
Program funds for location and environmental study work for the Southwest Arterial
Corridor Development Project. Additionally, the Policy Board has committed future
MPO federal aid resources for the construction phase of the project. As such, the MPO
Policy Board is wanting to see the supplemental environmental assessment work
continued and completed in a timely manner to allow the project to move into the next
phase of development.
In a recent meeting involving principally the DOT Director, Mayor of Dubuque and
Dubuque City Manager along with several others present from the DOT and Dubuque
area, discussed and reached an agreement pending formalization on how to proceed with
completion of the supplemental environmental assessment and enviroumental mitigation,
phase 3 archeology work. in principle the City agreed to take over control of the study
work and administer through completion. In addition, funding to complete the work
would come from commitments of present and future allocations of federal aid provided
to DMATS for programming and matched with City and County funds.
It is understood the DMATS Policy Board has approved commitment of present and
future allocations of federal aid to support completion of the supplemental environmental
assessment study and environmental mitigation, phase 3-archeology work to be
accomplished in the furore.
Completion of the Addendum to the 1999 Southwest Arterial Environmental Assessment
will be conducted in accordance with the following terms and conditions.
The DOT will execute a contract modification [herein Supplemental
Agreement No. 2) to the US 20 Capacity Study (Project No. NHS-20-9 ~121) --19-
31) contract with HDR Engineering (herein Consultant), Omaha, NE to add the
remaining work necessary to complete the Addendum to the 1999 Southwest
Arterial Environmental Assessment. The specific work tasks to be covered by the
supplemental agreement are to be determined by the City and County tn cooperation
with the DOT and the Consultant. The work tasks shall take into consideration the
need to stage future incremental development of the corridor. The approved scope
of work/budget for Supplemental Agreement No. 2 is included herein as
Attachment A.
The City shall manage the Supplemental Agreement. The City in managing the
study is considered to be a sub-recipient of federal-aid funds and as such agrees to
comply with all terms and conditions for use of federal funds as may be required of
the DOT in completing the study.
C. The City wilt administer the study with oversight of a Technical Committee
(herein TC). The role of the TC is to oversee and participate in the study effort to be
performed by the Consultant. The TC shall meet on a regular basis as determined
based on the project schedule to be included as part of the Consultant's approved
scope of work for Supplemental Agreement No. 2. The TC shall operate on the
basis of consensus on issues, problems, etc. which may' require resolution.
The TC will consist of the following representatives:
1) City of Dubuque, Public Works Director
2) Dubuque County, County Engineer
3) DMATS, Transportation Director
4) Iowa DOT, District Planner, Davenport
The City- and County have committed a total not to exceed $594,000 to cover the
cost of the Supplemental Agreement. A total of $475,200 (80 percent of total) of
DMATS Surface Transportation Program funds is to be programmed. The City and
County shall each provide $59,400 (10 percent of the total) for a total of $118,800
(20 percent of the total) to match the STP funds. Any costs incurred for completing
the Supplemental Agreement, which exceeds $594,000 shall require the approval of
the City and County.
The consultant shall submit invoices/progress reports to the City for payment no
less frequently than every thirty (30) days. The City shall make payment directly to
the consultant.
Upon payment being made to the consultant by the City, the City shall submit an
invoice and copy of the consultant's progress report to the DOT, District
Planner/Davenport for reimbursement for the federal share (80 percent) of the
amount paid to the consultant. The City shall request from the County an amount
equal to 10 percent of the amount paid to the consultant.
Adherence to the Disadvantaged Business Enterprise Program (DBE) policy of the
U.S. Department of Transportation, as defined in 49 CFR Part 23 should be
considered for this project.
If the IA32 project moves into design and construction, the proposed environmental
mitigation, phase 3 archeology work will be conducted in accordance with the following
terms and conditions:
The specific mitigation work to be accomplished shall be based on the outcome of
the Addendum to the 1999 Southwest Arterial Environmental Assessment and
identification of sitos requiring Phase 3 Archeology work along the selected road
alignment.
B. The City shall administer contracts for the Phase 3 Archeology work. Consultants
are to be selected in accordance with federal-aid procurement procedures.
Funding for the work shall come from future DMATS MPO Surface Transportation
Program funds (80 percent of the totaB to be matched with City and County funds
(20 percent of the total). The estimated cost to conduct the work ranges from $3.5 to
$5.6 Million.
The City shall comply with all provisions of the equal employment opportunity
requirements prokibiting discrimination and requiring affirmative action to assure equal
employment opportunity as required by Iowa Code Chapter 216. No person shall, on the
grounds of age, race, creed, sex, color, national origin, religion or disability, be excluded
from participation in, be denied the benefits of, or be otherwise subjected to
discrimination under any program or activity for which City receives State funds from the
DOT.
If any section, provision, or pan of this Agreement shall be found to be invalid or
unconstitutional, such judgment shall not affect the validity of the Agreement as a whole
or any section, provision, or part thereof not found to be invalid or unconstitutional.
This Agreement may be executed in three counterparts, each of which so executed shall
be deemed to be an original.
l'his Agreement as set forth in paragraphs 1 through 7 herein (inclusive) represents the
entire Agreement between the parties identified herein. Any subsequent change or
modification to the terms of this Agreement shall be in the form of a duly executed
Amendment to this Agreement.

US 20 CAPACITY IMPROVEMENT STUDY - SUPPLEMENTAL AGREEMENT NO. 2
SCOPE OF SERVICES
INTRODUCTION
During a conference call on March 5a, 2002 between the consultam, DMATS. and the State.
direction was provided on additional studies needed for the Southwest Arterial project. Primary
direction discussed during the conference call included the following items:
A iechnical committee (TC) will be formed to coordinate future efforts related to the
Southwest Arterial. The TC will be led by the City, and include representatives from the
County, DMATS, and the State.
Additional concept development efforts will be required for the proposed Southwest
Arterial to reduce projects costs associated with construction, right-of-way, and cultural
resources mitigation. The level of conceptual design for the additional studies will be
comparable to the conceptual design previously completed by the consultam. Dm/ts of
the Study will include the Seippel Road Corridor environmental study area previously
established, as shown on Figure 1. Additional study areas w/Il include the following items:
'~ Reduction of design criteria. Per direction fi.om the PMT, alternatives prexSously
developed primaril~v supported a des~n speed of 70 mph, and a posted speed limit
of 65 mph. During the conference call noted above, direction was pro~fded by the
City, County, and State to reduce the design speed to 60 mph, supporting a
posted speed limit of 55 mpk Design exceptions should also be considered to
minimize excessive cuts and filk (particularly through the highly weathered shale
areas) and cultural resource impacts.
~ Initial construction of two-lane roadway,'. To reduce initial project costs, onty two
lanes will be paved initially. Due to rugged terrain issues, ~ading for a four-lane
dMded section will be considered with the imitial construction.
~ Deferconstructionofinterchwnges. Toreduceinitialprojectcosts, construction
of interchanges at US 61, North Cascade / English Mill Road, and US 20 will be
deferred. Options will be explored to preserve the corridor, including purchase of
ROW for future interchange locations and land use management.
The City will handle future consultant management of the environmental and conceptual
design studies, with support fi.om Dubuque County and DM&TS. The State will continue
to participate in coordination meetings, public meetings, and provide technical assurance
as necessary.
Environmental studies, including completion of the Addendum to the EA. Scetion 4(13
report, Phase 2 Archaeological Studies, cultural resources mitigation plan. Section 106
Memorandum of Agreement (MOA), and a Finding of No Si~cant Impact (FONSI)
will be completed in this supplemental agreement.

DESCRIPTION OF WORK TASKS

Detailed tasks associated with the study are described as follows.
A. Data ~'
1. Conduct one site visit by environmental and roadway design staffto confirm and document
existing conditions, access issues, and potential constraints.
Update the mailing I/st and property parcel mapping based on the more recem property
ownership information (provided by the County Assessors Office). Estimate assumes property
parcel data w'ill be updated before each public meeting.
Develop Year 2015 traffic projections for the proposed Southwest Arterial Latest available
traffic counts and the Year 2020 DM&TS Tranplan planning model will be used to develop
the projections. The additional effort includes consideration of changes to local access based
on the interim concepts developed.
B. Additional Concept Development
l. Revise Alternative E and Alternative E - Design Variation 1 to reduce construction cost and
cull-aral resources impacts. Revisions will baclude reducing the mainline design speed to 60
mph and identLfylag areas where desiLm exceptions should be considered to mbarrmze
construction costs, right-of-way impacts, and cultural resource impacts. Initial concept
development will include horizontal geometry and selected vertical geometry/concept level
- templating. Due to the excessive cost of Alternative E - Design Variation 2, it is assumed that
no additional study be completed on this option~
Develop an interim construction plan for the two revised options noted above. The interkn
plan will consider construction of a two-lane highway (with a combination of ~m-ade
separations and at-gTade intersections) that can be up~aded to a four lane divided highway in
the future. The interim construction plan will include an at-grade intersection at US 61 and US
20, ~ade separations at Military Road and English Mill Road, and provisions for full access
(via an access mad or at-grade imersection) at North Cascade Road_ Concept development
will include horizontal and vertical geometry.
Prepare a brief traffic service analysis oftlie revised interim concepts developed in the
previous task utilizing tlie 2000 Highway Capacity Manual methodology. This task will
include prelh'rttnary determh-~ation of intersection lane and traffic control requh-ements
considering the 2015 AM and PM peak hour projections and the access pomts allowed
provided on the facility.
Develop cost estimates for the initial concepts for the interim improvements and refined
freew'ay concepts. Co~ estimates will be based on estimated quantities for major construction
items (e.g., pavement, bridges, approximate earthwork, etc.). Other Rems (e.g., sigTdng,
lighting, etc.) will be calculated as percentages of the major constrdetion items identified fi-om

similar type construction projects. Right-of-way impacts will be summarized and provided to
the TC. Right-of-way cost estimates will be based on the windshield survey information

Conduct a workshop with the TC to review the revised freeway concepts and associated
interim (two-bric highway) concepts. Review capacity analysis and environmental issues with
concepts. The workshop will include discussion of the project development schedules for the
US 20 Capacity Improvement Study and Southwest Arterial projects m ensure the projects
are coordinated.
Refine up to two concepts. Concept refinement will include addressing comments received at
the workshop and developing mainline and side road preliminary alignments and profiles and
selected cross section templating to determine ma approximate footpri~ for each concept.
Prepare a traffic service analysis of the refined concepts developed in the previous task
utilizing the 2000 Highway Capacity Manual methodology. This task will include analysis of
cross road intersections considering the 20~5 AM and PM peak hour projections. A technical
memorandum will be prepared to document the capacity analysis results.
Property Owner Meetings - Schedule meetings with interested property owners to discuss
proposed concepts and receive input. Task assumes 3 days of property owner meeting for 2
consultant staffmembers. It is assumed that support will be provided from the TC tu assist in
the property owner meetings. The consultant will prepare documentation of the property
o~er meeting to provide to the TC.
Floodplain Analysis -- Update the floodplain evaluations previously completed for the interim
and revised freeway concepts for Granger Creel Catfish Creek and South Fork
Creek. Floodplain analysis will include review of the FEIMA flood insurance maps, and
concept level backwater anal3~is using HECRAS and the best available topographic mapping.
The additional floodplain analysis and concept recommendations will be documented in a
tecfinical memorandum.
10. Revise conceptual bridge layouts for the revised t~eeway concepts developed. Bridge layouts
are at a conceptual level (approximate locatior~ overall len~h, and number of spans) for
evaluating cost. Conceptual layout will consider the recomniefidations oftbe floodplain
analysis noted above. In addition, aerial-based pavement outline plans and conceptual profiles
will be considered in ident' ~ffying the conceptual bridge limits.
l I. Develop cost estimates based for the interim and revised freeway concepts based on estimated
quantities for major construction items (e.g., pavement, bridges, earthwork, crc.). Other items
(e.g., sighting, lighting, etc.) will be calculated as percentages of the major construction items

12. Complete development of one concept for a proposed bicycle and pedestrian path from
Military Road to north of US 20. Concept development will include developing preliminary
horizontal alignment, typical cross section, and approximate footprint_ Task includes
development of concept level cost estimate.
13. Conduct a workshop with the TC to review the refined concept layonts, environmental
evaluation, capacity analysis, and cost estimates. The workshop w/il determine the concept(s)
to be presented i~ the Southwest Arterial AEA.
14. Prepare a brief update to the Project Location Study Report to document the refined concepts
developed for the proposed Southwest Arterial. The report will include plan view information
of the refined concepts developed, traffic capacity analysis documentation, hydraulic analysts
documentation, cost estimate information, and an overview of the decisions made to screen
the concepts.
C. Environmental Studies
1. Revise IrnpactEvaluation. Based on the revised freeway akertmtives and consideration of
interim improvements, revise calculations for the estimated em,ironmental impacts: social and
economic, right-of-way, farmland impacts, noise, habitat/flora/fauna, wetlands/floodplains,
and water/ground water qnality impacts.
2. Revise tS'eliminary Draft of AEA. Revise the preliminary dmf[ of the AEA to reflect the
revised Alternative E, discussion of interim construction of the two-lane highway, arut changes
to the impact analysis based on the re~dsed Alternative E.
3. th-epare Draft Section 460 Report. All Section 4(0 properties wilI be identified and a
.su~ranary of their signaificance will be presented. Impacts to these properties will be identified
and an anab~is of aiternatives that would avoid these impacts will be made. This analysis will
be based on the orlg/nal work completed for the 1999 EA. The scope of analysis will be
limited to Alternatives A, B, C, D (developed in the 1999 EA), Alternative E (developed in
the AEA), and No Action. Justification for impacting Section 4(1) properties will be provided.
Mitigation for properties whose impacts cannot be avoided will be determined though the
Section 106 process and documented in the Section 4(1) report. Completion of the draft
Section 106 Memorandum of Agreement (MOA) will be required for the Section 4(I) report,
and is noted in the task belo~v and included in this cost proposal.
4. Incorporate 404 / Merge P~'ocess. Provide additionalenvironmentalanalysisto support 404/
Merge process agency concurrence poiat meeting. Task includes additional environmental
analysis required to prepare reformation packets for the concurrence point meetin~ 3 and 4
based on best available environmental data.

Prepare Section 106 Memorandum of Agv'eement. The scope includes preparation of a draft
and final Memorandum of Agreement (MOA) through consultation with relevant agencies,
such as the City, Comnty, State, SHPO, and ACHP. The draft MOA will be prepared for
release with the AEA, and the final MOA wilt be prepared with the FONSI. It is assumed that
the MOA will treat the archaeolo~cal and architectural sites in terms of categories of cuttural
resources rather than on a site-by-site basis.
8. Prepare Cultural Resources Mitigation Plan. Through consultation with the CRy, County,
Stare, SHPO, and ACHP (if necessary), a Draft tvfitigation Plan wSll be prepared to address
mitig'ation of architectural and archaeological sites that may be adversely impacted by the
proposed project. The Draft Mitigation Plan will address the sites individually, and include a
summary of the Phase II archaeolo~cal and architectural evaluations with relevant maps and
diagrams along with a discussion of impacts anticipated as a result of fire project desig~
The number of archaeolo~cal and architectural sites will vary depending on the design
variation selected. For the purposes of scoping, sites potentially impacted by Alternative E
ware estimated. The scope assumes that up to 20 archaeolo~cal and arctfitectural / historical
sites eli~4ble for nomination to the lxrRHP will be impacted and. therefore require mitigation.
The cultural resources mitigation plan will be referenced in the MOA.
A detailed research desig~ and some suggestions for data recovery (archaeolo~caB and
Historic American Building Survey / Historic American EngSneering Record (architectural)
also will be included in the Draft Mitigation Plan. The scope also includes preparation ora
Final/vlitigation Plan to be prepared in conjunction with the FONSI.
9. Finalize the Addendum to the EA. Based on comments received from the City, County, State,
and the FHWA, finalize and publish the Addendum to the EA.
10. Prepare Final Section 409 Report. Following public review of the EA and completion of the
Section 106 MOA, the Final Section 4(f) Report will be prepared. It is assumed that the final
report will be prepared and reviewed concurrently' with the FONSI.
11. Prepare a "Finding of No Significant Impact" (FONSI). The EA is the document used to
determine [fan Em4ronmantal Impact Statement or FONSI needs to be prepared. For
purposes of this scope, it is assumed that a FONSI is sufficient. It is also assumed that all
changes to the NEPA record can be made in the FONSI and that the EA will not need to be
changed. Based on comments received during the public review of the EA, draft and final
versions of the FONSI w/ll be prepared. Task includes responding to review comments by the
City, County, State and FHWA. The FONS[ shall include sufficient miti~ation to obtain
agency concurrence on the selection of the preferred alternative. Completion of the Section
106 Memorandum of Agreemant (MOA) will be required for the FONSI, and is included in
this cost proposal. The scope assumes preparation ora draft and final FONSI.

Public Involvement
Public Meetings. For consistenc"y wkh pre~5ons public meetings, the State will handle
advertising and preparing public comment forms and assist in prov~aiug support staff at the
public meetings. In coordlmfion with thc State and the TC, the prime consultant will handle
arrm~ements for the public meeting facilities. City., County, and DMATS staffmay also
provide s-a. pport at the public meetings. Comments and issues identified at the public meetings
will be docoxnented in memomudnm~. Two public meetings are assumed, as noted below.
o The first meeting will be a public information meeting to inform the public oftbe proposed
revisions Io the Southwest Arterial and receive public input The cost proposal assumes 4

c> The second meetiug will be a location Public Hearing, and will be coordinated w~th the
City, County, State and FFIWA after the AEA has been approved. In coord'mation with

consultant attandees. It is assumed that the Public Hearing will be an open-house format,
Prepare Aerial Based Exhibits. Exh~lfits wkh a scale of 1"=200' will be util~ed to assist in
preseming concepts to the public. The ex,its will include gxayscale, ortho-corrected d'~oStal
aerinl photography, with proposed improvements shown in color. It is assumed that a total
one set of full size and four sets of half size exhfoits will be prepared for the Public
Information Meeting (up m two concepts).
Prepare Exhibit Boards. Prepare up to 4 color exhibit boards for use at the public information
meeting. Drali plots of the exta'bits will be prepared for review by the TC.
Prepare Draft Letters for Public Comments. Prepare drali letters to address wrilten public
comments received at public meetings. Task assumes preparation of 100 responses.
Coordination Meetings
TC Coordination g~leetings, in additional to ~he concept workshops noted aboYe, participate
in three coordination meetings. Meetings include kick-off toeing CDubuque), and two
additional coordination meetings between the consultant and the TC (Dubuque and Ames).
Agency Concurrence Point Meetings. Participate in 404 / Merge Process Agency
Concurrence Point Meetings Number 3 and 4~ These meeting involve Concurrence Point 3
(alternatives to carry ahead) and Concurrence Point 4 (deter*n/nation of the pre'n-ex/
alternative). Task includes preparing packets of information to the agencies concerning des~m
variations analyzed, and justification of the selec6on of the.preferred alternative. It is assumed
that the meetings will be held in Ames. Cost proposal assumes 4 attendees per meeting.

F. Management and Quality Reviews
I. Prepare a cost proposal for this supplementat a~eement, including development of a detailed
scope of services and cost estimate.
