INTRODUCTION
This memorandum presents for City Council consideration a Resolution of Necessity
that: 1) finds that a proposed Amended and Restated Urban Renewal Plan ("Plan") for
the Greater Downtown Urban Renewal District ("District") is both necessary and
appropriate; and 2) sets a public hearing on the proposed Plan for March 6, 2017.
The proposed Plan would authorize the inclusion of an adjacent area which meet the
definition of a blighted area in Section 403.17 of Iowa Code.
BACKGROUND
The District was originally established in 1967. It has been amended and restated on
several occasions over the years to expand the boundaries to assist with
redevelopment efforts of multiple key landmark buildings and areas in the city's urban
core.
Before a municipality can exercise the authority conferred by Chapter 403 "Urban
Renewal" of the Iowa Code, a Resolution of Necessity must be adopted finding that the
area being considered for urban renewal district designation is either a slum, blighted or
economic development area and that the rehabilitation, conservation, redevelopment,
development, or a combination thereof, of the area is necessary in the interest of the
public health, safety or welfare of the residents of the city.
DISCUSSION
The former Blum properties along East 15th Street have historically been used as a
scrapyard location. These properties have been identified for environmental
assessment and cleanup, with the intention of redeveloping the properties into public
amenity space, with possible green space, trailhead parking, and public restrooms. The
intention is to provide a gathering space in conjunction with the Bee Branch project and
adjacent trail. The properties may also have additional uses such as a storage and
maintenance facility or other use, to be determined by staff and City Council.
Additionally, the County Board of Supervisors has requested the inclusion of a facility
renovation/expansion project to house their administrative offices. This project would
be included in order to provide better security for County officials and to keep the
services conveniently located for all residents of the City and County of Dubuque.
The attached Resolution directs staff to prepare an Amended and Restated Urban
Renewal Plan, to include the above-described area and the descriptions of other urban
renewal projects that are currently expected to be undertaken in the District. This is
required by Chapter 403 along with a consultation process that provides the County and
School Board an opportunity to comment on the proposed Plan prior to the required
public hearing by the City Council. Additionally, to the extent the Plan includes the use
of tax increment revenues for a public building, an analysis must be provided
demonstrating alternative development and funding options for such public buildings.
A City Council public hearing on the Amended and Restated Urban Renewal Plan will
be scheduled for March 6, 2017. The public notice will be published four to twenty days
before the meeting to allow for the appropriate publication requirements. This will allow
time for preparation of the Plan, preparation of the public building analysis (if applicable)
and the consultation process with the taxing entities.
RECOMMENDATION/ ACTION STEP
I recommend the City Council adopt the attached Resolution of Necessity that begins
the process of updating the Amended and Restated Urban Renewal Plan for the
Greater Downtown Urban Renewal District to include the above-described area and any
other applicable updating that may be necessary.

A RESOLUTION OF NECESSITY FINDING THAT CERTAIN AREAS TO BE
INCLUDED WITHIN THE GREATER DOWNTOWN URBAN RENEWAL DISTRICT
MEET THE DEFINITION OF A BLIGHTED AREA UNDER THE. URBAN RENEWAL
LAW, AND THAT DEVELOPMENT OF SAID AREA IS NECESSARY IN THE
INTEREST OF THE RESIDENTS OF THE CITY OF DUBUQUE, IOWA, AND
SETTING DATES OF HEARING AND CONSULTATION ON A PROPOSED
AMENDED AND RESTATED URBAN RENEWAL PLAN FOR SAID DISTRICT
Whereas, the City Council of the City of Dubuque has heretofore approved the
Amended and Restated Urban Renewal Plan for the Greater Downtown Urban Renewal
District (the "District") in order to provide redevelopment opportunities which will further
the purposes and objectives of the foregoing Urban Renewal Plan; and
Whereas, City staff has recommended that the District be expanded to add an
adjacent area which meets the definition of a blighted area, as found in Chapter 403 of
the Iowa Code, and that the proposed Amended and Restated Urban Renewal Plan
("Plan")be updated to include such area and to update urban renewal project
descriptions and make any other necessary revisions; and
Whereas, Chapter 403 of the Iowa Code requires that before urban renewal
authority may be exercised, a City Council must adopt a resolution of necessity finding
that the area in question is a slum, blighted or economic development area, and that so
designating such area is necessary in the interest of the public health, safety or welfare
of the residents of the municipality.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the area referred to herein as the 15th Street Subarea (which
includes the former Blum properties), as generally described in Exhibit "A" and Exhibit
"B" to this Resolution and to be included in the Amended and Restated Urban Renewal
Plan for the Greater Downtown Urban Renewal District, is a blighted area as defined by
Chapter 403 of the Iowa Code and is appropriate for an urban renewal project.
Section 2. That the development of the above-described 15th Street Subarea is
necessary and appropriate to facilitate the proper growth and development of the
community in accordance with sound planning and local community objectives.
Section 3. That the City Manager is authorized and directed to prepare an
Amended and Restated Urban Renewal Plan for the Greater Downtown Urban Renewal
District to accomplish the foregoing purposes and objectives, to include in such Plan
any appropriate project activities and details, to determine an appropriate date for and
conduct the consultation process required by law with affected taxing entities
concerning the proposed Plan, and submit the Plan to the Planning Commission for
review and recommendation as to its conformity with the general plan for the
development of the community as a whole.
Section 4. That the City Council hold a public hearing on the adoption of the
proposed Amended and Restated Urban Renewal Plan for the Greater Downtown
Urban Renewal District on March 6, 2017 at 6:00 p.m. in the Historic Federal Building,
350 West 6th Street, Dubuque, Iowa 52001. The notice of said hearing shall generally
identify the areas covered by the Plan and the general scope of the urban renewal
activities planned for such areas, and said notice shall be published and available to the
public not less than four days nor more than twenty days before the date of said
meeting. A copy of the notice of public hearing shall be sent by ordinary mail to the
affected taxing entities.
Section 5. That the City Clerk is further directed to send by ordinary mail a copy
of said Plan, the notice of public hearing, a notice of consultation, and, to the extent the
Plan includes the use of tax increment revenues for a public building, an analysis of
alternative development and funding options for such public buildings, to the Dubuque
Community School District and the Dubuque County Board of Supervisors, as the
affected taxing entities.

15th Street Subarea of the district shall include that area generally bounded by
the following description: Beginning at the intersection of the northerly right of
way line of East 15th Street and the easterly right of way line of Elm Street in the
City of Dubuque, Dubuque County, Iowa;
Thence northeasterly along the northerly right of way line of East 15th Street to a
point of intersection with the westerly right of way line of a public alley lying
between Pine Street and Maple Street; Thence northwesterly along said westerly
right of way line to the northeast corner of the North 35 feet of Lot 255 in East
Dubuque Addition; Thence southwesterly along the northwesterly line of said Lot
to a point of intersection with the easterly right of way line of Pine Street; Thence

The County is in the planning phase to renovate space on the fifth floor of the
Court House to provide office space for the District Juvenile Court officers and the
Juvenile Probation officers. The County Security Committee has recommended these
offices be brought into the Court House in order to provide better security for these
officials.
We are requesting the Council approve this renovation as a project within the
Greater Downtown Urban Renewal area. Inclusion in the UR area will provide the
County with additional options as we finance the project.
