It appears that the applicants own an undivided interest iu the various pieces of real estate. An Opinion of the Attorney Gen- eral dated, November 23, 1939 in response to an inquiry asking whether taxes of undivided inter- ests owned by various owners should be suspended, stated as fol- lows: "In answer to your second ques- tion, if the old ag'e recipient antl his deceased wife left no issue, then the property would descend. directly to the husband, if the property was valued at less than $x,500,00, In this situation, it is our opinion that the auditor should suspend the taxes. How- ever, if the old age recipient and his wife left issue, the husband, of course, would only get one- third of the property upon his wife's death. It is our opinion that in this situation, the auditor should not suspend the taxes as it would hardly be practicable to suspend one-third of the taxes artd collect the other two-thirds." County Jail and are familiar with the conditimt of the City Hall of Dubuque, Iowa and in connection with said three building's, submit the following findings and recom- mendations: The present Court House was constructed 56 years ag'q the pres- euC County Jail was emistructed nearly 100 years ag'o, and the Du- bugne City Hall was constructed 89 years ago. All are now inadequate for their purposes, all contain fire and health hazards and their con- dition is such that the cost of up- keep is prohibitive and attempted renovation would be a waste of public funds. The Court House has mo fire- proof vault for the preservation of County records; over-crowded con- ditions iu many of the offices re- sult in important records being' stared on the upper floors, outside of any vault; the top floors, parti- cularly, constitute a fire hazard; tle tall steeple may le in such con- dition as to constitute a hazard to Court IIouse personnel and passer- by; the leaky condition of the roof, the antiquated toilet facilities, and condition of other parts of the builduig, indicate that many re- pairs or replacements are needed at tle present time. Tle County Jail is being main- tained efficiently and adequately; however, it is so antiquated and out-moved, that it does not furnish fit facilities for the confinement of human beings. The second and turd tier cell gangways are still in a dangerous condition. The cast of maintaining these three old building's is a constant drain on public funds which will continue and increase. The Grand Jury are informed that fire officials have recently ordered that fire es- ~, capes be placed on the Court House Special Session, Tanuar~-lSth, 19~~ 11 anil that such addition Wray cost twelve thousand dollars. This Grand Jury is informed that in many communities throughout the nation, a Cottrt House, County Jail and City Hall have been com- bined into one milt, resu,Iting iv efficiency, convetuence, and de- creased maintenance costs.
