Councilman Wharton proved that City Manager Rhomberg be in• strutted to arrange a meeting with the Special Committee to be held at 7:30 R M, on November 10th, 1947. Communication of The Key City Gas Company requesting approval of their application to the State Highway Department for a routine permit to cross under Ilighway No. 20, near the west city limits, for the purpose of supplying gas to the new Dubuque Homes Sub. Ordinance No. 28.47 An Ordinance regulating- the speed of trains at grade crossings within the City of Dubuque repeal- ing all ordinances or parts of or- dinances in conflict herewith and providing a Penalty for violation hereof. Now, Therefore, Be 1t Ordained by the City Coun- cil of the City of Dubuque: Sec. 1. No passenger train shall be operated over and upon the grade m'ossings in the City of Du- buque at a speed of greater than 30 miles per hour. Sec. 2, No freight train shall be operated over and upon the grade crossings in the City of Dubuque at a speed greater than 25 miles per hour. Sec. 3. All ordinances or part or parts of ordfnances iu ^anflict here-" with are hereby repealed. Sec.. 4. Any person, firm or cor- poration who violates any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be fined not more than $100.00 and costs and in de- fault of such fine shall be imprison- ed for a period not exceeding thirty days in jai]. On the westerly side of the building of Leik's Drug Store, which is located on said cor- ner, astairway leads~to the second floor of said building and extends over the sidewalk, and water flrip- ping Prom the stairway caused au accumulation of ice to form at the base of the mail box. I was of the opinion that the owner of the building should also be made a party to this matter a.nd so notified hinr. Thereafter, in con- junction with tho Attorneys for his insurance company, ire conferred with the Attorney for the claimant. Claimant has agreed to settle this claim for $2,000.0D. 'Phe insurance company has agreed.. to pay $1,000.00 and I recommend that Che City pay the other "1000 00 d ingtou Streets because of an al- leged dangerous condition of the sidewalk, accumulation of snow and ice being thereon, at which time she received serous injuries including a fracture of her hip, which required her to secure hos- pital, doctor and drug bills, It ap- pears that the sidewalk was in a dangerous condition. The City Council appointed Mr. Murphy to cast their ballot for City Assessor and directed him to cast said ballot for Mr. Hanover. SCHEDULE 3 COMMERCIAL AND INDUSTRIAL AUTOMATIC WATER HEATING AI?1D/OR SPACE HEATING SERVICE AVAILABILITY: This rate is available to all commer- cial and industrial consumers using an automatic gas water heater and/or automatic space heating equipment supplied with gas through a separate meter. Commercial consumers shall include all restaurants, business houses, apartment buildings, except where each tenant has a separate meter, churchee, and institutions. DEFINITION OF AN APAR'iMENT: (a) An apartment is defined as a portion of a building consisting of two or more rooms, equipped for living purposes. Any meter installed upon a ~us- tomer's prenilse ;hall bear a label clearly indicating tha date that said meter was tested and recalibrated. Such record as filed shall indicate the name of the rianufacturer oP said meter, its serial number, type, ca- pacity, number assigned to it by its owner, name and address of the .nis- tmner where said meter was in sere- ice prior to said test, and date of last previous test, together with the Percentage of error above m• below accuracy, as disclosed by said test. Meters shall be adjusted to registor within plus or minus two per cent (2%) of accuracy at full load. PENALTY: Section 3.
