Kennedy to US 52
The Iowa Department of Transportation (IDOT) has submitted a Pre-Construction
Agreement for the City of Dubuque relating to the construction of Iowa 32 (Northwest
Arterial) from John F. Kennedy Road to US 52. The agreement provides for the City's
reconstruction of John F. Kennedy Road from Spring Valley Road to the northerly City
limits to be incorporated into the IDOT construction project for the Northwest Arterial. A
public hearing on these plans and specifications and the levy of special assessments
has already been held and approved by the City Council.
The additional work, although it will be incorporated into the IDOT contract, will be paid
for at 100% City cost. The IDOT estimate for this work is $1,038,927.
The City's public hearings were based on the City's estimated cost of $1,027,780, which
is slightly different than IDOT's estimate. At the end of the project, the actual
construction costs will be computed; and both the City's contribution to IDOT and the
special assessments will be recalculated based upon actual construction costs.
Public Works Director Mike Koch recommends approval of the of the Pre-Construction
Agreement with IDOT relating to the construction of John F. Kennedy Road from Spring
Valley Road to the northerly City limits, in conjunction with the Northwest Arterial from
John F. Kennedy to US 52.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
Enclosed is a proposed agreement between the City of Dubuque and the Iowa
Department of Transportation relating to the construction of Iowa 32 (Northwest Arterial)
from John F. Kennedy Road to US 52.
DISCUSSION
The IDOT agreement provides for the City's reconstruction of John F. Kennedy Road
from Spring Valley Road to the northerly City limits to be incorporated into the IDOT
construction project for the Northwest Arterial. A public hearing on these plans and
specifications and the levy of special assessments has already been held and approved
by the City Council.
The additional work, although it will be incorporated into the IDOT contract, will be paid
for at 100 percent (100%) City cost. The IDOT estimate for this work is $1,038,927.
The City's public hearings were based on the City's estimated cost of $1,027,780, which
is slightly different than IDOT's estimate. At the end of the project, the actual
construction costs will be computed; and both the City's contribution to IDOT and the
special assessments will be recalculated based upon actual construction costs.
RECOMMENDATION
I recommend approval of the proposed agreement and further recommend that the
Mayor be authorized and directed to sign the attached pre-construction agreement
through the adoption of the enclosed resolution.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution relating to the
construction of John F. Kennedy Road from Spring Valley Road to the northerly City
limits, in conjunction with the Northwest Arterial from John F. Kennedy to US 52.

99-4-095C WITH THE IOWA DEPARTMENT OF TRANSPORTATION
RELATING TO THE CONSTRUCTION OF IOWA 32 (NORTHWEST
ARTERIAL) AND JOHN F. KENNEDY ROAD TO US 52
Whereas, the Iowa Department of Transportation is proposing to construct
Iowa 32 from John F. Kennedy Road to US 52; and,
Whereas, the Iowa Department of Transportation has prepared a pre-
construction agreement outlining the terms and conditions under which the City's
reconstruction project on John F. Kennedy Road from Spring Valley Road to the
northerly City limits can be included in the State's construction project; and,
Whereas, the City Council of the City of Dubuque approves the terms and
conditions of said pre-construction agreement.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the Iowa Department of Transportation Agreement No.
99-4-095C consisting of an agreement providing for the City's reconstruction
project on John F. Kennedy Road from Spring Valley Road to the northerly City
limits be included in the Iowa Department of Transportation's contract for the
construction of the Northwest Arterial from John F. Kennedy Road to US 52.
Section 2. That the Mayor be authorized and directed to execute two
copies of said pre-construction agreement.

Attached are two (2) copies of an addendum to Agreement 99-4-095 between the City of Dubuque
and the Iowa Department of Transportation for the above referenced project. The project involves
the construction of an extension to Iowa 32 (Northwest Arterial). The addendum reflects the current
concept of this project.
Please secure the necessary approvals and signatures of the appropriate city officials and return both
signed copies of the addendum to this office for further processing. An original of the fully executed
addendmn will be forwarded to the city after final signature by our department.

This Addendum, is entered into by and between the Iow~i Department of Transportation,
hereinafter designated the "DOT", the City of Dubuque, hereafter designated the "CITY" in
accordance with 761 Iowa Administrative Code Chapter 150 and Iowa Code sections 28E.12 and
306A.7;
WITNESSETH; that
WHEREAS, the DOT proposes to establish or improve an extension of the Northwest
Arterial within Dubuque County, Iowa; and
WHEREAS, the DOT and CITY are willing to jointly participate in said project, in the
manner hereinafter provided; and
WHEREAS, this Addendum reflects the current concept of this project which is subject to
modification by the DOT; and
NOW, THEREFORE, IT IS AGREED as follows:
l. The DOT will design, let and inspect construction of the following described project in
accordance with the project plans and DOT standard specifications:
A new extension of Iowa 32, also known as the Northwest Arterial, will be
constructed beguming at the junction of existing Iowa 32/J.F.Kermedy Road (J.F.K.
Road) and extending northeasterly to the CITY's north corporation line. The new
paved roadway will be a four-lane divided facility with a raised median. Each pair of
lanes will be approximately 7.2 meters in width with a 1.8~meter wide paved inside
shoulder and a 3.0-meter wide ~anular outside shoulder.

Special Provisions
The CITY and DOT have previously entered into the following Agreements for the above
referenced project:
Agreement 98-1-178 for right of way acquisition was signed by the CITY and DOT
on March 1 & 8, 1999 respectively.
Agreement 99-4-095 for construction of the above referenced project was signed by
He CITY and DOT on July 5 and 17, 2000 respectively.
Addendum 99--4-095A for transfer 9f jurisdiction of Iowa 32 was signed by the CITY
and DOT on July 20 and 26, 200t respectively.
Addendum 99-4-095B for recreational trail construction was signed by the CITY and
DOT on January 2 and 9, 2001 respectively.
Additional miscellaneous improvements will be made to JFK Road within the CITY, at its
west junction with the Northwest Arterial. This additional work will be accomplished at
100% CITY cost. The estimate for said work is approximately $1,038,927 (see the estimated
quantities on Exhibit "A" attached).
Miscellaneous Provisions
Previously executed Agreements 98-1-178, 99-4-095 and Addendums 99-4-095A and 99-
4-095B (see section 2 herein) will remain in full force and effect except as revised herein.
If any section, provision, or part of this Addendum shall be found to be .invalid or
unconstitutional, such judgment shall not affect the validity of th? Addendum as a whole or
any section, provision, or part thereof not found to be invalid or unconstitutional, except to
the extent that the original intent of the Addendum cannot be fulfilled.
6. It is the intent of all parties that no third party beneficiaries be created by this Addendum.
Tiffs Addendum may be executed in two counterparts, each of which so executed will be
deemed to be an original.
Any subsequent change or modification to the terms of this Addendum will be in the form of
a duly executed amendment to this document.
