of Lots 1-25, inclusive, of Block I and Lot A of Southern Hills Subdivision Ill, as it is
substantial compliance with the City of Dubuque Subdivision Regulations.

INTRODUCTION
The submitted final plat of Lots 1-25, Inclusive, of Block 1 and Lot A of Southern Hills
Subdivision III continues the residential development pattem of the Southern Hills
Subdivision in Dubuque County. The submitted final plat provides for the platting of 25
additional parcels to be developed for single-family homes.
DISCUSSION
The City Council reviewed and approved the first phase of Southern Hills in October
1996. Subsequent final plats were approved in December 1999 and November 2000.
The submitted final plat provides for the construction of three new private streets and
the extension of one existing street, Kemp Court. The three new private streets will be
Allen Drive, Molly Drive and Nicholas Court. These private streets follow the custom in
the County that the lots are platted to the centerline of the right-of-way.
The City Council is reviewing this plat as it is within two miles of the corporate limits of
the City of Dubuque, and thus the City and County do a joint review of subdivisions.
RECOMMENDATION
The submitted final plat of Lots 1-25, Inclusive, of Block 1 and Lot A of Southern Hills
Subdivision III is in substantial compliance with the City of Dubuque Subdivision
Regulations. I recommend the City Council approve the plat subject to waiving Article
IV, Design Improvement Standards, except for Section 42-19, Lots and Blocks. This
waiver is consistent with previous City approvals for plats in this subdivision.

Physical Characteristics: The subject property is located at the temporary cul-de-sac
terminus of Kemp Court along a ridge that is currently in agricultural cultivation. The
property slopes on three sides to wooded drainage and is abutted on the west by Lake
Eleanor Road right-of-way and on the east by the existing Southern Hills Subdivision
on Kemp Court.

Proposed Streets and Grades: Extension of Kemp Court to a cul-de-sac, Nichols Court,
Molly Drive and extension of Allen Ddve to intersect Kane Road. All streets are built to
County standards with 22 feet of paving and 66-foot rights-of-way. The proposed cul-
de-sac should be 75 feet in diameter.
Recommended Motion: Motion to approve the submitted preliminary plat of Lots 1
through 25 inclusive, of Block 1 and Lot A of Southern Hills Subdivision III as the plat is
in substantial compliance with the City of Dubuque zoning regulations subject to
waiving Article 4, Design Improvement Standards, except for 42-19, Lots and Blocks.

Conformance with Comprehensive Plan: This area was not included as part of the
1995 Comprehensive Plan. This area was also outside the City's 1998 annexation
study that examined the potential growth areas and their possible annexation to the
city.
Impact of Request on:
Utilities: Water and sewer will be provided on a private basis.
Traffic Patterns: When fully developed, the proposed subdivision will generate
approximately 250 vehicle trips per day.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impacts to the environment
provided adequate erosion control is provided during all phases of development.
Adjacent Properties: The proposed development will increase the number of
vehicle trips along Kemp Court, Kemp Road, Kane Road and Lake Eleanor Road.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted final plat of Southern Hills Subdivision III is in Dubuque
County within two miles of the City of Dubuque and requires joint review. The subject
final plat will create 25 additional lots along an extension of Kemp Court. Kemp Court
will cul-de-sac approximately 300 feet from the Lake Eleanor Road right-of-way. The
subdivision will be built along a ridge on 1-acre plus lots, which drop off on all sides to
a wooded drainage way.
All streets proposed in the plat will be built to County standards with 22 feet of paving,
4-foot shoulders and 66-foot right-of-way. Cul-de-sacs will have a 75-foot diameter.
The streets will be maintained by the homeowners association for this development.
Individual septic systems will be installed for each lot, while all 25 lots will share four
common wells. The subject properbj is outside both the City's 1995 Comprehensive
Plan study area as well as the City's 1998 annexation study area. The study examined
potential growth areas for the City and identified areas of potential annexation. The
subject parcel is outside of the area studied and staff does not anticipate this area wilt
be annexed to the City in the near future.
Staff recommends that as the submitted plat is in substantial compliance with the City
of Dubuque and Dubuque County Subdivision Regulations, that the City Council
approve the final plat of Lots 1-25, Inclusive, of Block 1 and Lot A of Southern Hills

RESOLUTION APPROVING THE FINAL PLAT OF LOTS '1-25, INCLUSIVE, OF
BLOCK '1 AND LOT A OF SOUTHERN HILLS SUBDNISlON III IN DUBUQUE
COUNTY, IOWA
Whereas, there has been filed with the City Clerk a final plat of Lots 1-25,
inclusive, of Block 1 and Lot A of Southern Hills Subdivision III; and
Whereas, the preliminary plat has been examined by the Zoning Advisory
Commission and has its approval endorsed thereon, with the waiver of Article IV,
Design and Improvement Standards of the Subdivision Regulations, except for Section
41-29; and
Whereas, said final plat has been reviewed by the City Planner and had her
approval endorsed thereon; and
Whereas, said final plat has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the City Council hereby waives Article tV, Design and
Improvement Standards of the Subdivision Regulations, except Section 42-19, Lots and
Blocks.
Section 2. That the final plat of Lots 1-25, Inclusive, of Block 1 and Lot A of
Southern Hills Subdivision III is hereby approved and the Mayor and City Clerk are
hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa,
upon said subdivision plat.
