Economic Development Director Maurice Jones recommends City Council approval of a
Resolution correcting the legal description in the Amended and Restated Urban
Renewal Plan for the Greater Downtown Urban Renewal District adopted March 6,
2017.
The Resolution includes the phrase "Nunc Pro Tunc", which in Latin means "now for
then". This means that the Resolution is intended to have a retroactive impact to
correct the scrivener's error so that the Resolution will continue to have the same
effective date and such effective date will not be changed by the corrective Resolution.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The purpose of this memorandum is to forward for City Council review and approval a
Resolution correcting the legal description in the Amended and Restated Urban
Renewal Plan for the Greater Downtown Urban Renewal District adopted March 6,
2017.
BACKGROUND
The Greater Downtown Urban Renewal District was originally established in 1967.
It has been amended and restated on several occasions over the years to expand the
boundaries to assist with redevelopment efforts of multiple key landmark buildings and
areas in the city's urban core.
DISCUSSION
After holding a public hearing on March 6, 2017, City Council reviewed and approved
Resolution 90-17 and Ordinance 6-17 which updated the Greater Downtown Urban
Renewal District by adding land and updating project details. Subsequently, the
documents were forwarded to the County Auditor, where staff identified a scrivener's
error in the legal description. The legal description included in the Urban Renewal Plan
and the Ordinance each omitted a reference to a "#2" in describing two of the subareas
of the District.
The attached Resolution includes the phrase "Nunc Pro Tunc", which in Latin means
"now for then". This means that the enclosed Resolution is intended to have a
retroactive impact to correct the scrivener's error so that the Resolution will continue to
have the same effective date and such effective date will not be changed by the
corrective Resolution.
RECOMMENDATION/ ACTION STEP
I recommend that the attached Resolution correcting the scrivener's error in the
Amended and Restated Urban Renewal Plan be adopted in order to support
reinvestment efforts in the District.

RESOLUTION NO. 90-17-A
RESOLUTION NUNC PRO TUNC CORRECTING AND AMENDING A SCRIVENER'S
ERROR IN CERTAIN LEGAL DESCRIPTIONS INCLUDED IN THE AMENDED AND
RESTATED URBAN RENEWAL PLAN FOR THE GREATER DOWNTOWN URBAN
RENEWAL DISTRICT
WHEREAS, by Resolution No. 90-17, adopted March 6, 2017, this Council found
and determined that certain areas located within the City are eligible and should be
designated as an urban renewal area under Iowa law, and approved and adopted the
Amended and Restated Urban Renewal Plan (the "Urban Renewal Plan" or "Plan") for
the Greater Downtown Urban Renewal District (the "Urban Renewal District" or "District")
described therein; and
WHEREAS, the Urban Renewal Plan approved and adopted by Resolution No.
90-17 contained a scrivener's error in the legal description of the Industrial Harbor
Subarea and the 15th Street Subarea; and
WHEREAS, correcting the scrivener's error does not change the parcels of land
which were intended to be included in the Urban Renewal District; and
WHEREAS, the Council has determined to adopt this resolution nunc pro tunc,
correcting the scrivener's error in the legal descriptions of the Industrial Harbor Subarea
and the 15th Street Subarea contained in the Urban Renewal Plan for the Urban Renewal
District.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF DUBUQUE,
IOWA:
Section 1. That the findings and conclusions set forth or contained in the Urban
Renewal Plan concerning the area of the City of Dubuque, State of Iowa, described in the
preamble hereof and in Resolution No. 90-17, be and the same are hereby ratified and
confirmed in all respects as the findings of this Council for the Urban Renewal District
with the exception of the amended legal description as set forth below.
Section 2. The legal descriptions of the Industrial Harbor Subarea and the 15th
Street Subarea contained in the Urban Renewal Plan approved and adopted by
Resolution No. 90-17 on March 6, 2017, are hereby corrected, nunc pro tunc, to provide
as set forth in the legal descriptions of such subareas attached hereto as Attachment D.
Section 3. The attached Attachment D shall be substituted in lieu of the original
Attachment D contained in the Urban Renewal Plan.
Section 4. That all other provisions of the Urban Renewal Plan not affected or
otherwise revised by this resolution, as well as all resolutions previously adopted by this
City Council related to the Urban Renewal Plan be and the same are hereby ratified,
confirmed and approved in all respects.

District Boundary Description by Subarea
1 . The Town Clock Subarea of the District shall include that area described as
follows: Beginning at the intersection of the north right-of-way line of Ninth Street with
the east right-of-way line of Central Avenue; thence south along the east right-of-way
line of Central Avenue to its intersection with the south right-of-way line of Fourth Street;
thence west along the south right-of-way line of Fourth Street to its intersection with the
west right-of-way line of Locust Street; thence north along the west right-of-way line of
Locust Street to its intersection with the north right-of-way line of Ninth Street, but also
including the adjacent City Lots 623 and 624 (Dubuque Museum of Art), the Locust
Street Parking Ramp between 8th and 9th Streets and the former U.S. Federal Building
located on City Lots 101 , 102, 139, 140, and the N 54.5' of City Lots 103 & 138, and the
vacated alley between said lots; thence east along the north right-of-way line of Ninth
Street to its intersection with the east right-of-way line of Central Avenue, and point of

2. The Town Clock Expansion Subarea shall include the following described

3. The Old Main Subarea of the District shall include that area generally bounded

4. The Upper Main Subarea of the District shall include that area generally bounded
on the North by Fourteenth Street, on the West by Locust Street but including City
Lots658A, 659, 660, and the balance of City Lots 658 (Carnegie-Stout Public Library),
on the South by the northerly boundary of the Town Clock Subarea and on the East by
Central Avenue, and including all public rights-of-way.
5. Ice Harbor Subarea A of the District shall include that area generally bounded on
the north by the public alley located between the vacated Fourth Street and Third
Street, on the west by the Chicago, Central and Pacific Railroad right-of-way, on the
south by East First Street and on the east by the municipal limits of the City of Dubuque,
Iowa and including any adjoining public right-of-way.
6. Ice Harbor Subarea B of the District shall include that area generally bounded on
the north and west by the Chicago, Central and Pacific Railroad right-of-way, on the
south by the northerly boundary of Subarea A and on the east by the municipal limits of
the City of Dubuque including any adjoining public right-of-way.

Company's 4 th Addition, and all that part of Lot 2-1 of Adams Company's 4th Addition
