Mayor Wharton stated that this
is the regular monthly meeting of
the City Council, and also the first
meeting of the fiscal year, for the
transaction of such business as may
properly come before the meeting.
City Cleric J. J. Shea swore in
Messrs. Ruben V. Austin, Ray-
mmid F. Kalb and Richard L.
Wynes to serve as Couucihnen for
the terms commencing the first
Monday in April, 1950,
Councilman Russo moved that
Councilman Wehi be elected May-
or for the ensuing fiscal year, Sec-
onded by Cotmcilman Wynes. Car-
ried by the followhig vote:

Solicitor that he did not want it
to appear that PJIr. Kintzinger is
getting a reduction in salary far
any other reason than that ltis
worle will be reduced and further
that the office of the City Solicitor
has in the past been deluged with
work and that it was necessary
to appoint temporary assistants
from time to time and that with
the appointment of an Assistant
City Solicitor that it will offer the
City of Dubuque greater efficiency
and more economical service.

Gentlemen:
With reference to the claim of
Hugo P. Ansel which has been
referred to me for investigation
and report, on February 17th, 1950
claimant, after stopping for the
stop sign and 19th and Central
Avenue, started to make a turn
to the left on Central Avenue and
in so doing had to cross ruts in
the street which were six to eight
inches high, and as his car was
crossing the ruts, the battery came
down on top of the ruts, causing
the battery to be pushed up
against the floor boards, breaking
the battery and the carrier for the
battery, This was shortly after

the heavy snow and occurred while
the street department was in the
e=,~ork of. cloaning the streets. I
atn of the epltion that there is
no liability of the City on this
claim and recommend that the

13 of the Iowa Stream and Lake
Pollution Law, House File 4, an
act of the 53rd General Assembly,
a permit is issued for the installa•
tion of the Simpson-Coates St. Dis-
trict sanitary sewers and lift sta-
tion, the plans fm• which have
been received in this office. This
permit is issued subject to the
fallowing conditions and require-
ments:
i. These extensions fit into your
comprehensive sewer system which
will ultimately permit the collec-
tion and treatment of wastes from
the city of Dubuque prior to dis-
charge into the Mississippi River
or tributary thereof.
2. The approval of these plans
and the issuance of the permit
do not constitute approval of the
discharge of untreated wastes into
the Mississippi River.
3. The sewers will be laid in
accordance vrith standard specifi-
cations now on file with this de-
partment.
4. The sewer lines are deep
enough to serve the basements of
the establishments along the line.
We are retaining one copy of
approved plans for our files and
forwarding the other copy of ap•
proved plans to the office of the
city Engineer, Dubuque, Iowa.

A, J. Becker for $3.25 for damages
because of the backing up of a
sewer into his premises on or
about March 21, 1950, which has
been referred to me for investiga-
tion and report, it appears that the
sewer became clogged for some
reason and backed into the prem•
ices of the claimant, and that the
City upon being notified, went to
the premises, cleaned out the city
sewer, and the balance of the
water, etc., in his basement, fn
addition thereto, he was compelled
to employ a plumber which cost
him $3,25. I recommend that his
claim be allowed in the sum of
$325, and that a warrant be issued
payable to his order and delivered
to him upon delivery of a Release
to the City properly executed,

the construction thereof, The con•
struction of the proposed improve-
ments and extensions consists in
general of the following:
(1) Fw•nishing of all material,
labm~, tools and equipment for
fabricating, delivering, erecting,
and painting a 500,000 gallon ca-
pacity, double ellipsoidal, steel,
elevated water storage tank, 100
feet from top of foundations to
overflow.
(2) Furnishing of all labor, tools,
materials and equipment necessary
to construct the foundation for a
500,000 gallon elevated steel water
storage tank.
All in accordance with the pro•
posed plans and specifications and
proposed form of contract now on
file in the office of the City Clerk
of Dubuque, Iowa, which plans
and specifications and form of
contract are hereby made a part
hereof the same as if set out in
full and are referred to for a more
detailed description of the work to
be done and the materials to be
furnished and the terms and con-
ditions thereof.
Copies of the plans and specifica-
tions, form of contract and propos-
al forms are now on file and avaiI-
able for inspection at the office of
the City Clerk in the City Hall,
Dubuque, Iowa. Copies of docu-
ments may be obtained for bidding
purposes by depositing $10,00 with
the City Clerk for each set of
documents, The full amount of
the deposit for one set of docu-
ments will be refunded to each
actual bidder who returns the
plans in good condition to the City
within ten (10) days after opening
of proposals. One-half (r/z) of all
other deposits will be refunded for
each set of complete documents,
including plans returned to the
City.
All proposals rnust be submitted
on bid forms furnished by the
City Clerk as a part of the specifi-
cations. No bid may be withdrawn
after the opening of proposals with-
out the consent of the City of
Dubuque, Iowa, for a period of
thirty (30) days after the scheduled
time of closing bids.
At said hearing, the City Council
will consider the plans and specifi-
cations and the proposed form of
contract, the same now being on
file in the office of the City Clerk,
reference to which is made for a
more detailed and complete des-
cription of the proposed improve-
ments, and will receive and con-
sider any objections of said plans
and specifications and form of
contract made by any interested
party.
The cost of coustructing said
improvements and extensions will
be paid in cash out of the proceeds
of the sale of Water Revenue
Bonds issued by the City. These
bonds are not general obligations
nor payable in any manner out of
taxation, but are payable solely
and only out of the future net
revenues of the Municipal Water-
works. Payment will be made
to the contractor or contractors as
the work progresses upon monthly
estimates as described in the spec-
ifications.
The successful bidder will be

required to furnish a performance
bond in an amount of 100 percent
of the contract price.
Construction shall be started
within 30 days after the award of
contract, and shall be completed
within 180 days thereafter, all sub-
ject to unavoidable delays.
All proposals shall be accompan-
ied by a certified check or bank
draft drawn on a solvent bank in
the State of Iowa or a satisfactory
bid bond, in an amount not less
than five percent (5 percent) of
the amount of the bid, which secur-
ity shall be forfeited if the bidder
fails or refuses to enter into con-
tract or to furnish bond after his
proposal has been accepted by the
City Council.
The City Counoil hereby reserves
the right to reject any or all bids,
to waive informalities and to enter
into such contract or contracts as
it shall deem to be to the best
interest of the City.
Neither the contract or contracts
for said imprrovo rents and exten-
sions nor the Water Revenue Bonds
proposed to be issued as aforesaid
shall constitute general obligations
of the City nor secured by or pay-
able in any manner by taxation,
but shall be payable solely from
future net revenues of the munici-
pal waterworks system and secur-
ed by a pledge cf said net earnings.
By virtue of statutory authority,
preference will be given to labor,
products and provisions grown and
produced within the State of Iowa.

that on February 10th, 1950, while
in the discharge of his duty as

and he received permission to have
repairs made to the jacket, but
the damage to the jacket was such
that the repairs were of no value,

premises decided that a plat and
schedule be prepared for improve-
ment of this sheet with curb and

improving of curb and gutter of
the alley second north of Hazel

Street.

others requesting the establishment
of Laurel Street extended 415 feet
northeasterly of its present termi-
nus into property owned by the

Council to view the grounds. The
Council having viewed the prop-
erty requested the City Manager
to obtain the views of the Park
Board in the matter.
This has been done and the posi-
tion of the Park Board is as
follows: -The Park Board is of
the opinion that the opening of
this street will be of no benefit
for park purposes and will only
consent to such opening on the
condition that the Parlt property
be not assessed for any present or
future improvement of the propos-
ed street.
The above finding indicates that
if the Council determines to estab-
lish the requested street that it
be improved at the expense of
the petitioners in consideration of
the dedication of the land by the
City and Park Board.

Gentlemen:
At the meeting of the City Coun-
cil held on Monday, April 17, the
petition of Albert Sodawasser, et
al, with reference to automobiles
being stored upon a vacant lot in
the 2100 block of Elm street by
Boyes Wrecking and Towing Serv-
ices, was referred to the City
Attorney and Building Commis-
sioner for investigation and re-
port.
We have made an investigation
of this matter and our opinion
with reference thereto follows:
We find that the area complain-
ed of lies within the heavy indus-
trial zoning area of the City of
Dubuque. There are nine restric-
tions placed upon uses of property
located within that area for which
special permission must be granted
prior to use. We feel that at the
present time at least, no business
is being conducted upon said prem-

ises which would be prohibited by
the provisions of the zoning ordin-
ance as it applies to heavy indus•
trial areas. We feel further from
an investigation of the premises
that they are not now being used
as a junk yard but rather as a
storage place for wrecked automo-
biles and in our opinion the same
is a conforming use under the
zoning ordinance,

Gentlemen:
With reference to the claim of
George Haberkorn referred to me
for investigation and report, claim-
ant while driving on Seminary
Street on April 6th a short dis-
tance past Clarke College struck
holes in the street and blew out
a tiro and tube, which cost him
$22.75. The space in the street
covered by holes was about thirty
feet square with holes from three
inches to eight inches deep. Claim-
ant has agreed to accept $11.50
in payment of his claim. I rec-
ommend that his claim be allowed
in the sum of $11.50 and that a
warrant be issued payable to his
order and delivered to him upon
delivery to the City of a release
executed by him.
