INTRODUCTION
The enclosed resolutions provide for the establishment of the final assessments for the
2016-2017 Snow Removal from City Right-Of-Way.
BACKGROUND
Iowa State Code Section 364.12b states the abutting property owner is responsible "for
the removal of the natural accumulations of snow and ice from the sidewalks within a
reasonable amount of time and may be liable for damages caused by the failure of the
abutting property owner to use reasonable care in the removal of the snow or ice." City
Code of Ordinance 10-1-3-C-1 addresses the duties of the abutting owner, removal by
City, and the collection of costs.
Engineering records show 13 snow events for the season of which most melted away
within a couple of days. Although there were 205 complaints, because of the
unseasonably warm temperatures last winter there were only two occasions that crews
were sent out for snow removal.
DISCUSSION
The Final Schedule of Assessments for the unpaid properties for snow/ice removal from
City Sidewalks is $542.50; this total includes the $25.00 per incident administrative fee.
BUDGETIMPACT
The Sidewalk Inspection Program — Assessable Capital Improvement Project (CIP
1001108) is a general fund — liens account that will reimburse the assessment amount,
of $542.50. The General Special Assessment Fund (CIP 25510255) covers the cost of
contracting and the revenue from those assessments.
RECOMMENDATION
I recommend that the City Council approve the resolutions establishing this Final
Assessment Schedule for the 2016-2017 Snow Removal from City Right-Of-Way in the
amount of$542.50.

RESOLUTION NO. 154-17
RESOLUTION ADOPTING AN ASSESSMENT SCHEDULE OF UNPAID SNOW AND
OR ICE REMOVAL CHARGES AND DIRECTING THE CLERK TO CERTIFY THE SAME
TO THE DUBUQUE COUNTY TREASURER FOR COLLECTION IN THE SAME
MANNER AS PROPERTY TAXES
Whereas, the City Manager has filed with the City Clerk an assessment schedule
providing the amount to be assessed against certain lots for the actual unpaid abatement
costs of removing snow and or ice; and
Whereas, said schedule is attached as Exhibit A to this resolution and incorporated
herein by this reference; and
Whereas, Iowa Code § 364.12 authorizes the City Council to assess against the
property said abatement costs in the same manner as property taxes; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
IOWA CITY, IOWA:
Exhibit A is adopted as the Final Assessment Schedule pursuant to Iowa Code
§384.60. The amounts listed in Exhibit A for unpaid snow and or ice removal charges are
confirmed and levied against the properties listed in Exhibit A.
The City Clerk be and is hereby directed to certify the Final Schedule of Assessments
to the County Treasurer of Dubuque County, Iowa, and to publish notice of said
certification once each week for two consecutive weeks in the manner provided in Iowa
Code § 362.3, the first publication of which shall be not more than fifteen days from the
date of filing of the Final Schedule of Assessments. On or before the date of the second
publication of the notice, the City Clerk shall also mail a copy of said notice to property
owners whose property is subject to assessment, as provided in Iowa Code § 384.60.
Assessments may be paid in full without interest at the office of the Dubuque City
Treasurer, City Hall, 50 W. 13th Street, Dubuque, Iowa, at any time within 30 days after
the date of the first notice of the Final Schedule of Assessments. Thereafter, unpaid
assessments are payable at the County Treasurer's Office, Dubuque County Courthouse,
720 Central Avenue, Dubuque, Iowa. The assessment cannot be paid in installments.
Unpaid balances will draw the same delinquent interest as ordinary taxes.
