SPECIAL SESSION

The Dubuque City Council met in special session at 6:00 p.m. on February 27, 2017
in the Historic Federal Building, 350 W. 6th Street.
Present: Mayor Buol; Council Members Connors, Del Toro, Jones, Lynch, Resnick,
Rios; City Manager Van Milligen.
Mayor Buol read the call and stated this is a special session of the City Council called
for the purpose of conducting such business that may properly come before the City
Council and for discussing various Fiscal Year 2018 city departmental budgets.
CONSENT ITEMS
Motion by Lynch to receive and file the documents, adopt the resolutions, and dispose
of as indicated. Seconded by Resnick. Motion carried 7-0.
1. Marquette Hall, LLC Third Amendment to Purchase and Sale Agreement: City Man-
ager recommending approval of a Third Amendment to the Purchase and Sale Agree-
ment between the City of Dubuque and Marquette Hall, LLC that addresses an award of
tax credits by the Iowa Finance Authority to Marquette Hall, LLC. Upon motion the docu-
ments were received and filed and Resolution No. 78-17 Approving the Third Amendment
to the Purchase and Sale Agreement between the City of Dubuque, Iowa and Marquette
Hall, LLC was adopted.
RESOLUTION NO. 78-17
APPROVING THE THIRD AMENDMENT TO THE PURCHASE AND SALE AGREE-
MENT BETWEEN THE CITY OF DUBUQUE, IOWA AND MARQUETTE HALL, LLC
Whereas, the City of Dubuque (City) is the owner of the following described real prop-
erty:
Vacated alley between Regent Street and Queen street, as shown on Exhibit A (the
Property); and
Whereas, City desires to sell the Property to Marquette Hall, LLC pursuant to a Pur-
chase and Sale Agreement dated February 1, 2016, as amended; and
Whereas, the parties wish to further amend the Purchase and Sale Agreement as set
forth in the Third Amendment to Purchase and Sale Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The Third Amendment to the Purchase and Sale Agreement between the
City of Dubuque and Marquette Hall, LLC. is hereby approved.
Section 2. The City Manager is hereby authorized to sign the Third Amendment to the
Purchase and Sale Agreement.

ITEMS SET FOR PUBLIC HEARING

Motion by Lynch to receive and file the documents, adopt the resolutions, set the public
hearings as indicated, and direct the City Clerk to publish notice as prescribed by law.
Seconded by Connors. Motion carried 7-0.
1. Marquette Hall, LLC Sale of Property: City Manager recommending setting a public
hearing for March 6, 2017, on the intent to dispose of interest in real estate pursuant to a
Purchase and Sale Agreement between the City of Dubuque and Marquette Hall, LLC.
Upon motion the documents were received and filed and Resolution No. 79-17 Resolution
of Intent to dispose of an interest in real estate by Deed to Marquette Hall, LLC pursuant
to a Purchase and Sale Agreement between the City of Dubuque and Marquette Hall,
LLC was adopted setting a public hearing for a meeting to commence at 6:00 p.m. on
March 6, 2017 in the Historic Federal Building.
RESOLUTION NO. 79-17
INTENT TO DISPOSE OF AN INTEREST IN REAL ESTATE BY DEED TO MAR-
QUETTE HALL, LLC PURSUANT TO A PURCHASE AND SALE AGREEMENT BE-
TWEEN THE CITY OF DUBUQUE AND MARQUETTE HALL, LLC
Whereas, the City of Dubuque (City) is the owner of the following described real estate:
Vacated alley between Regent Street and Queen Street (the Property), as shown
on Exhibit A; and
Whereas, City desires to sell the Property to Marquette Hall, LLC pursuant to a Pur-
chase and Sale Agreement dated February 1, 2016, as amended (the Purchase Agree-
ment), now on file at the Office of the City Clerk, City Hall, 13th and Central, Dubuque,
Iowa; and
Whereas, the City Council has tentatively determined that it would be in the best inter-
ests of the City to approve the Purchase and Sale Agreement and the sale of the Property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The City of Dubuque intends to dispose of its interest in the Property by
Deed to Marquette Hall, LLC pursuant to the Purchase and Sale Agreement.
Section 2. That the City Clerk is hereby authorized and directed to cause this Resolu-
tion and a notice to be published as prescribed by Iowa Code Section 364.7 of a public
hearing on the City's intent to dispose of the Property to be held on the 6th day of March,
2017, at 6:00 o'clock p.m. at the Historic Federal Building, 350 West 6th Street, Dubuque,
Iowa.
Passed, approved and adopted this 27th day of February, 2017.

PUBLIC HEARINGS
Fiscal Year 2018 City departmental budgets were presented by staff from the following
departments:
1. Water Department Fiscal Year 2018 Budget Presentation: Denise Ihrig, Water De-
partment Manager.
2. Water & Resource Recovery Center Fiscal Year 2018 Budget Presentation: William
O'Brien, W&RRC Manager.
3. Public Works Department Fiscal Year 2018 Budget Presentation: John Klostermann,
Public Works Director; Renee Tyler, Assistant Public Works Director; and Anderson
Sanci, Resource Management Coordinator.
4. Engineering Department Fiscal Year 2018 Budget Presentation: Gus Psihoyos, City
Engineer; Deron Muehring, Civil Engineer II; Jon Dienst, Civil Engineer II; Bob Schiesl,
Assistant City Engineer; and Dave Ness, Civil Engineer II.
The City Council had discussion with staff following each presentation.
Following the Water Department presentation, Ms. Ihrig stated that she will explore the
low-pressure zone in what Council Member Connors referred to as the Holy Ghost Hill
area (Keokuk and Monroe Streets); and the City Manager stated that budget items that
the City Council has asked to be held for later discussion will appear in the amended
budget recommendation for further discussion and vote at the March 7, 2017 final budget
hearing.
Following the Public Works presentation, Paul Schultz, 1008 Victoria Street, addressed
the City Council about his support of using compressed natural gas city vehicles, but had
concerns about purchasing such vehicles before fully knowing the economics of the fuel,
what path the City is following in this area, and the impact of changing federal regulations.
Mr. Schultz supported the solid waste consultant budget request and expressed a strong
need for funding more public education to expand the food scrap program, achieving zero
waste and landfill diversion. David Lyons, Sustainable Innovation Consultant for the
Greater Dubuque Development Corp. (GDDC), expanded on several points from a
handout he provided regarding GDDC's support of the City's approach to renewable en-
ergy and fuel.
Following the Engineering Department presentation, City Engineer Gus Psihoyos
stated that the issue of water runoff around Glendale Ct. will be addressed next year; the
concept of two-lane roundabouts as they impact bicycle safety will be addressed by the
design consultants for the individual projects. Assistant Engineer Bob Schiesl stated that
a State of Good Repair for the NW Arterial is governed by provisions outlined in the SW
Arterial Transfer of Jurisdiction with the Iowa Department of Transportation.
