Present-Mayor Russo, Council-

City Manager Schiltz.
Mayor Russo stated that this is
the regular monthly meeting of
the City Council, also the first
meeting of the fiscal year, for the
purpose of acting upon such
business as may properly come
before the meeting.
RESOLUTION N0. 1-52
A resolution providing for the
appointment of a City Manager
and a City Clerk of the City of
Dubuque; prescribing their salaries
and fixing their bonds.
Be It Resolved by the City
Council of the City of Bubuque
that the following officers be ap-
pointed, subject, however, to the
right of the Council to declare
such offices vacant or remove the
officers therefrom at the pleasure
of the Council with or .without
cause, and to be paid the compen-
sation provided for in the budget,
and the following bonds shall be
provided by such officers at the
expense of the individual officer;
City Manager, L. J. Schiltz, bond
$5,000.00; City Clerk, J. J. Shea,
bond $1,000.00.

that T. H. Nelson be appointed City
Solicitor and R. M. Czizek, Assist-
ant City Solicitor, subject, how-
ever, to the right of the council to
declare such offices vacant or to
remove the officers therefrom at
the pleasure of the Council with or
without cause, and that they be
paid at the rate provided for in the
budget, and that they each furnish
the following bonds at their ex-

pointed depositories of the public
funds and the City Treasurer is
hereby authorized to distribute
such funds in such banks in
amounts not to exceed the follow~
rag: First National Bank, $375,000;
00; American Trust and Savings
Bank, $350,000.00; Dubuque Bank
and Trust Company, $325,000.00.
Be It Further Resolved that the
City Treasurer be and he is hereby
directed to file with the County
Treasurer of Dubuque County,
Iowa a list of such depositories
and to keep such list on file with
such County Treasurer at all times.

Whereas the Planning and Zoning

has recommended the vacation of the
above alley; and

owner of all of the Property abutting
said alley, has petitioned for Bald
vacation and there appears to be no
valid obJection thereto;
Now Therefore Be It Ordained by

below described area from its pres-
ent classification to Two Family
Residence District classification.
Whereas the Planning and Zoning
Commission has recommended to the
City Ceuncfl that the following de-
scribed area be changed from its
present classification to Two Fam-
ily District classification, to-wit:
Lots 7 to 20, inclusive, of Finleys
Addition in the City of Dubuque,
Iowa, including any or all subdivi-
sions of said lots; and
Whereas notice of such proposed
change has been published as pro-
vided by law and an opportunity af-
forded to all interested Parties and
citizens to be heard thereon at a pub-
lic meeting held at 7:30 o'clock p.m.
on the 7th day of January, 1952, at
the Council Chambers in the City
Hall; and
Whereas no objections have been
filed or made to the proposed change;
Now Therefore Be It Ordained, by

RESOLUTION N0. 1-52
Resolution providing for the LS-
suance of Improvement bonds for
the purpose of providing for the
payment of the assessed cost of
asphaltic macadam surfacing on
Tressa Street.
Whereas the contract heretofore
entered into by the City of Du-
buque, Iowa, for the asphaltic
macadam surfacing hereinafter des-
cribed has been completed and the
City Manager has certified the
completion thereof to the City
Council and the City Council has
ascertained the cost thereof and
has determined that $135.00 Dollars
of the cost thereof small be as-
sessed against the property sub•
ject to assessment therefor; and
Whereas public notice, as pro-
vided by law, has been published
by the City Clerk stating the in-
tention of the City Council to issue
bonds for the purpose of providing
for the payment of the assessed
cost of said improvement and a
public hearing has been held, pur-
suant to such notice and all ob-
jections made thereto have been
considered and determined;
Now Therefore Be It Resolved
by the City Council of the City of
Dubuque:
1. That to provide for the pay-
ment of the assessed cost of im-
proving Tressa Street from the
west property line of McLenan
Street to a point 191 feet east there
shall be issued Improvement bonds
in the amount of $135.00 Dollars
io anticipation of the deferred pay-
ment of assessments levied for
such improvement.
2. Such bonds shall be called
Improvement bonds; and shall bear
the date of February 6, 1952; and
shall be cumbered consecutively;
and they shall be numbered, di-
vided into series,. and be in such
denominations and for such ma-
turity dates as are shown in the
'following table:
1. 4981-$ 35.00, April 1, 1953
2. 4982--$100.W, April 1, 1954
3. Said bonds shall bear interest
at the rate of 5 per cent per an-
num, payable semi-annually in ac-
cordance with coupons thereto.at-
tached;
9. Said bonds shall not make
the City of Dubuque liable in any
way, except for the application of
said special assessment funds.
5. Said bonds shall provide that
they may be payable at any time
prior to the maturity date stated
therein at the option of the City of
Dubuque and shall be in sub-
stantially the following form:

Improvement Bond
The City of Dubuque in the
State of Iowa promises to pay as
hereinafter mentioned to the
bearer hereof, on the first day
of ......................... or at any time
before that date, at the option of
the City of Dubuque, the sum of
One Hundred dollars with interest
thereon at the rate of 5 per cent
per annum, payable semi-annually,
on the presentation and surrender
of the interest coupons hereto at-
tached. Both principal and in-
terest of this bond are payable at
the office of the City Treasurer
in the City of Dubuque, in the
State of Iowa.'This bond is issued
by the City of Dubuque under and
by virtue of Chapter 396 of the 1950
Code of Iowa, as amended, and the
Resolution of said City duly passed
on the 7th day of January, 1952,
being Resolution No ..................
This Bond is one of a series of
2 bonds, 1 for $35.00 numbered
4981, and one for $106.00 numbered
4982 all of like tenor and date,
and issued for the purpose of im-
proving Tressa Street from the
west property line of McLenan
Street to a point 191 feet east as
described in said Resolution, in
said City, which cost is payable by
the abutting and adjacent property
along said improvements and is
made by law a lien on all of said
property. It is payable only out of
Regular Session, January 7, 1952 7
the Special Assessment Fund No.
1031 created by the collection of
said special tax, and said fund can
be used for no other purpose.
It is hereby certified and re-
cited that all the acts, conditions
and things required to be done,

Whereas the contract heretofore

buque, Iowa, for the asphaltic
nacadam surfacing hereinafter
described has been completed and
the City Manager has certified the
completion thereof to the City
Council and the City Council has
ascertained the cost thereof and
has determined that $1,698.90 Dol•
Lars of the cost thereof shall be
assessed against the property sub-
ject to assessment therefor; and
Whereas public notice, as pro-
vided by law, has been published
by the City Clerk stating the in-
tention of the City. Council to issue
bonds for the purpose of providing
for the payment of the assessed
cost of said improvement and a
public hearing has been held, pur-
suant to such notice and all ob-
jections made thereto have been
considered and determined;

of the City of Dubuque:

Gentlemen:
Your Planning and Zoning Com-
mission recommends to your Hon-
orable Body the denial of the peti-
tion of the Torbert Drug Company,
dated June 17, 1951, for the follow-
ing reasons:-
(1) If favorable action were
taken on this petition it would set
a precedent that would undoubtedly
serve as a justification for similar
requests in the many other resi-
dential sections of the city. The
city authorities could not justifiably
discriminate against other peti-
tioners seeking like favors and the
result would. be a breaking down of
sound zoning, if in fact, not de-
stroying the effectiveness of the
entire Zoning Ordinance. The ob-
ject of a Zoning Ordinance is prim-
arily to stabilize land values and
protect: property owners against
the intrusion of objectionable land
use. -
($) In a city arranged as is Du-
buque, the logical place for Busi-
Hess is in the downtown area near
the Light Industrial District, con•
venient to warehouses, railroads
and truck lines. There is not, at
present, a Business District in the
entire hill section of Dubuque from
the Mother House at the south-
easterly end to Kane Heights at
the northerly end, There are a few
Local Business Districts in the
hill area. However, there is a
great difference between Local
Business Districts and a Business
District. In a LOCAL Business Dis-
trict, small service shops of a re-
tail nature such as grocery stores,
drug .stores, filling stations, etc.
for the purpose of serving the im-
mediate vicinity are permitted.
Most of such stores in the hill sec-
tions were established before the
passing of the Ordinance. Those
built since were required to be set
back from the property line, as
for example, Apel's on Dodge at
Bryant Street.
Business Districts, on the otter
hand, permit various kinds of
establishments including taverns,
trailer courts, etc. and buildings
may be placed on -the front and
side property lines-the tendency is
to crowd buildings close together
and develop conditions objectiona-
ble in residential areas.
(3) It is necessary when con-
sidering achange in rezoning any
area that the adjacent property
be given consideration. In this
area there are at least twenty or
more single family residences.
Most of these owners object to re-
zoning to a business district. They
have an investment in excess of
$250.000 at the present time with
prospects of many more homes to
be built. These homes were built
with the understanding that the
area was a single family district
and they claim that they are en-
titled to protection under the
Planning and Zoning Ordinance.
(4) The Planning and Zoning
Commission has always considered
the land southerly and westerly
from Grandview Avenue a resi-
dential area for the development
of Dubuque. We also would like to
retain as residential areas both
sides of Grandview Avenue and the
streets that radiate from Grand-
view Avenue, such as Mt. Carmel,
Rowan, Southern Avenue westerly
from the Armory, Plymouth, Mt.

Loretta, Upper Dodge, West Third,
Highway 20, Bennett, University,
West Fourteenth Street, Asbury,
Seminary, Rosedale and several
other streets in the same general
territory.
(5) From a strictly selfish stand-
point on the part of the City, it is
well to remember that the greatest
source of Tax Revenue to the City
of Dubuque is the downtown, the
real estate, buildings and stores.
This income may be quickly im-
paired , by the establishment of
Business Districts s c a t t e r e d
throughout the city.
(6) Primarily the object of the
Zoning Ordinance is to stabilize
land values and protect property
owners against the intrusion of
objectionable land uses. The Plan•
ning and Zoning Commission meets
and studies such problems in a
disinterested, impartial, unselfish
manner and endeavors to reach
decisions in line with Public In-
terests and Common Good. There-
fore, we again recommend denial
of the petition.

Joseph Michel has brought an
action in the District Court of
Dubuque County, Iowa, claiming
seventy-five hundred dollars from
the City of Dubuque and Molo Oil
Co, for damages resulting from a
fall on the sidewalk at Fifth and
Locust Streets on December 9th,
1949.
An investigation has disclosed
that Mr. Michel did suffer such a
fall resulting in a fractured hip
and that the facts present a ques-
tion as the liability of the City
and the Molo Oil Company.
Mr. Michael has agreed to ac-
cept $812.&5 in full settlement of
which amount Molo Oil Co. has
agreed to contribute two hundred
dollars and the City of Dubuque
$6]2.85.
I therefore recommend that this
settlement be approved and that
the Auditor be instructed to draw
a warrant payable to Joseph
Michel and Louis Fautsch, his at-
torney, in the amount of, $612.85
and to deliver the same upon re-
ceipt of a properly executed re-
lease, and the dismissal of said
action with prejudice at plain•
tiff's costs.

The Milk Ordinance of the Clty
of Dubuque has no regulations re-
quiring the dating of fluid milk
products or the length of time
these products can be kept for re-
tail sales.
Processed milk at plrerent is .of
a comparatively high quality and
because of a decreased volume of
milk supplies during Chia time of
the year, the retail outlets have a
minimum quantity of mill[.
This is an ideal situation for
the consumer because a4pplies are
completely exhausted daily. How-
ever, io flush periods when milk
is abundant, retail outlets Are
stocked beyond possible exhaus-
tion and milk is carried over for
some period of time unbeknown
to the consumer.
I would recommend Wet the Milk
Ordinance be amended to y~,~ ~,'.de
for dating of fluid milk products
and also designating the length of
time products can 6e kept for re•
tail sales.

I have had several inquiries re-
gardaag the restriction of parking
m perbs of Picket Street, Cornell
Street and Montrose Street, and
after having an investigation made,
the following conditions were found
to exist:
Picket Street is 22 feet wide and
one block in length from Cornell
to Henion Street. There are no
reaidentiat units on the South side
of the street sad it carries mostly
local traffic.

Boulevard is 16 feet wide for a
distance of 170 feet and Montrose
9tteet north of Loral Boulevard is
15 feet wide for a distance of 170
feet, Then are no residential units
facing the street within this area.
Conditions, especially during the

ardons along these streets and I
would ldce to make the following
recammeadations which are in ac-
cordance with a study made by the
Traffic Department:
1. That parking be restricted on
the South aide of Picket Street
from CorneII Street to Henion
Street.
2. That parking be restricted on
both aides of Cornell Street from
Loral Boulevard to a point 170

school crossing signal on Windsor
Avenue and East Twenty-Second
Street to control traffic on Windsor
Avenue.

of doge in the city of Dubuque,
Iowa; providing for the observation
under confinement of biting dogs,
and special prov[aion for the contra)
of rabies, prescribing penalties for
violation; and amending Ordinance
No. 4-33.
Be It Ordained by the City Council
of the City of Dubuque, Iowa:
3eetion I. Definitions. The follow-
ing detinltlons shall apply in the In-
terpretation and enforcement of this
Ordinance:
(a) "Dog" includes all damestl-
cated members of the caniafamilaris,
male or female, whether altered or
not;
(b) "Owner" Includes any person,
firm or corporation owning, harbor-
ing, sheltering or keeping a dog;
(c) "Kenhel dogs" are dogs kept
or raised solely for the bona fide
purposes of safe and which are kept
under constant restraint;
(d) "At large" includes any dog
off the premises of its owner er upon
the public streets, alleys, public
grounds, or parka within the Clty of
Dubuque. A dog shalt not be deemed
at large if:
1. It ie attached to a leash of suf-
ficient strength to restrain the dog
and nbt more than ten (10) feet in
length, where said leash is held by
a person competent to govern the
dog; or
2. When properly restrained within
a motor vehicle or housed In an ani-
mal hospital approved by City Health
Ottlcer,
Section 2. License fee payable by:
(a) The City Manager shall issue
dog licensee upon due application
and payment of the tee provided here-
inafter. The licensee, upon procure-
ment of the license, shall securely
attach the license tag to a collar or
harness, and this collar or harness
with the license tag attached shall
at all times be kept on the dog far
which the license is issued. Any
dog found at large w[thout a collar
or harness to which a license tag is
attached shall be deemed unlicensed
and shall be impounded;
(b) The head oP the family shall
be liable for payment of the license
fee on any dog owned, harbored or
kept 6y any member of the family;
(c) It shall be unlawful for any
owner to own, possess or harbor a
dog, except kennel dogs, in the City
of Dubuque without having obtained
a license therefor In compliance with
the provisions hereinafter set forth,
except that a license shall not be
regwred for dogs under the age of
three (3) months which are confined
to the owners' premises;
d) The Individual license fee shall
be $lA0 for male or spayed female
dogs and $3.00 for female dogs per
calendar year or fraction thereof. The
owner shall file application for license
with the City Manager, This appli-
cation shall give the name and ad-
dress of owner, breed, sex and de-
scription of dog.
(e) The license must be secured
by April 1st each year, or at the
time a dog has reached the age of
three (3) months after said date. In
the event of a change in ownership
the license holder shall notify the
City Manager of such change.
Section 3. Harboring Vicious Dug:
It shall be unlawful for any per-
son to harbor or keep a vicious dog
within the City of Dubuque. A dog la
deemed to be vicious when it shall
hate attacked or bitten any person
(without provocation), or when pro-
pensity to attack or bite persons shall
exist and is known or ought reason-
ably to be known to the owner.
Section 9. Impounding: Repoasea-
sion or Disposal
(a) Any dog found at large as
previously defined without a proper
license from the City of Dubuque
shall be eubject to seizure and- hn-
poundment in the place provided by
the City.
(b) The possession of any un-
licensed dog so seized or impounded
may be obtained by the owner upon
obtaining a license and paying 'the
sum of Two Dollars (;l) plus the
current daily fee for keeping such
dog for each day or fraction thereof
during which the said dog has been
Impounded and upon proper identifi-
cation of said dog.
(c) Any dog not claimed by the
owner within three (3) days may be
disposed of as prescribed by the
Health Officer.
Section 5. Dogs Disturbing the
Peace.
(a) It shall be unlawful for any
person to own, keep, have in his
possession or harbor any dog which
by frequent and habitual howling,
yelping, barking or otherwise, shall
cause a serious annoyance or dis-
turbance tq persons ar to the neigh-
borhood.
(b) It shall be unlawful Por any
person, firm or corporation keeping,
owning or sheltering a dog to allow
or permit such animal to pass upon
the premises of another causing dam-
age or annoyance or otherwise inter-
fering with the premises.
(c) No person shall be convicted
under the provisions of this section
except upon complaint of two or
more persons of different households.
Section 6. Female Dogs in Season.
It shall be unlawful for any owuer
to allow hie female dog that is in
season to run at large or to so con-
fine her as to attract male., dogs to
the area and by their presence cause
a nuisance. Any person violating the
provisions of this section shall be
punished as provided in this Ordi-
nance and the dog shall be subject
to seizure and impoundment at the ex-

pense of the owner, during the re-
mainder of the heat period.
Section 7. Rabies.
(a) The owner of any dog which
has contracted rabies, or which has
been eubject to same or which is
suspected of having rabies, or which
shall have bitten any person, shall,
upon demand of the Chief of Police
or Health Officer, produce and sur-
render up such dog to be held in
quarantine far observation fora pe-
riod determined by the City Health
Officer at the expense of the owner
of said dog.
(b) At the discretion of the Health
Officer it may be. permissible for
the owner to properly confine his
dog Instead of having it impounded.
The term "properly confined" shall
be construed to include:
(i) Chaining at home or penning
at home if the dog be so protected
as to prevent intimate approach oP
any other animal or person by a
metal or wood barrier of suffcient
size, height and construction as to
absolutely prevent the ingress or
egress of person or animal;
(2) Confinement in an animal hos-
pital under the supervision of a reg-
istered veterinarian.
(c) If, upon examination by a vet-
erinarian, any dog shall prove to be
infected with rabies, such dog shall
be disposed of as directed by the
Health Officer. It shall be the duty
of said veterinarian to notify the
City Health Officer of any positive
rabies case found within twenty-four
(24) hours.
(d) Any animal bitten or attacked
by any known rabid animal, shall be
quarantined under supervision of the
City Health Officer by being con-
fined, as provided above, far a period
of not less than ninety (90) days.
(e) Any person who shall know-
ingly harbor or keep any dog in-
fected with rabies, or any dog known
to have been bitten by a rabid dog,
or who shall fail to report to the
police or health officer the existence
of a dog which he knows to be so
infected, or who shall fail to pro-
duce and surrender up any dog pur-
suant to subjection (a) hereof, shall
be punished as provided in this ordi-
nance.
(f) Any person finding a dead dog
shall at once notify the police de-
partment.
Section 8. Control of Rabies Out-
break.
When the Mayor, pursuant to Reso-
lution of the City Council, shall de-
clare an emergency due to rabies:
(a) It shall be unlawful for the
owner of any deg to permit or suf-
fer such dog to be at large. Any
dog Pound at large shall be deemed
to be so with the permission or at
the sufferance of its owner.
(b) It shall be unlawful for any
person except the owner of a dog,
or his agent, to open any door or
gate of any private premises, or to
otherwise entice or enable any dog
to leave any private premises for
the purpose or with the result of
setting such dog at large.
(c) Any dog found at large shall
be impounded by the police depart-
ment whether licensed or nat.
Section 9. Violation of Provisions.
Any person violating any of the
provisions of this Ordinance shall,
upon conviction, be fined a sum not
exceeding One Hundred Dollars ($100)
and coats, and in default of payment
be committed to the City or County
jail until such fine and costs are
paid not exceeding thirty (30) days
or a jail sentence may be imposed
not exceeding the said thirty (30)
days.
Section 10. Repeal and Date of
Effect.
That part oP Ordinance No. 4-33
relating to dogs and Section 64 of
Ordinance No. 78, and al] ordinances
and parts of ordinances in conflict
with this ordinance are hereby re-
pealed; and this Ordinance shall be
in full force and effect immediately
upon its adoption and publication
as provided by law.
Section ll. Unconstitutionality
Clause.
Should any section, paragraph, sen-
tence, clause or phrase of this Ordi-
nance be declared unconstitutional or
invalid for any reason, the remainder
of said Ordinance shall not be affected
thereby.

Gentlemen:
During the last several weeks I
have been investigating the pos-
sibility of better pedestrian pro-
tection and control in the down-
town area and especially at the
intersections where traffic is con-
trolled by traffic lights.
There have also been petitions
submitted to the City Council by
the Dubuuge Safety Council regard-
ing the parking of vehicles close
to crosswalks and discussion among
the Council regarding short time
restricted parking at certain lo-
cations in the business district. In
order that we may proceed with
the adoption of the findings of this
investigation, I would like to pre-
sent the following recommendations
to the Council for their approval:
1. That East and West bound
traffic on East Sixteenth Street be
controlled by Stop signs at the in-
tersection of Washington Street.
2. That ten minute restricted

the business districts but limited

3. That no parking be allowed
on Davis Avenue from a point 630

the city.
5. 'that all traffic lights between
4th and 14th Streets be converted
to double faced type and that ad-
ditional protection be given pedes-
trians by adding a walk signal at
the hntersections of 6th, 8th and
10th Struts on Main, -6th and 8th
on Locust Street and 14th and
Central; Also that the controls at
12th .and Central and 14th and
Main be of a type that can be con-
trolled for red signals in all four
.directions so that pedestrians can
cross in all directions; that right-
turn.arraws be installed at 4th and
~G~ntral sfor southbound traffic and
Y4th anti .Locust Streets to .govern
•muthbound traffic.
6. That a system of controls be
•established to regulate traffic
lights at the intersections of 8th,
12th, 14th and 17th Streets on
Central Avenue and Main and

These controls would activate an
all-red signal at the intersection

Whereas pursuant to an election
duly and regularly held in the City
of Dubuque on the 6th day of No-
vember, 1951, Ordinance No. 3-52
entitled "An Ordinance Authoriz-
ing the Issuance of $167,000 Fire
Station Bands and Providing for
the levy of Taxes to Pay the Same"
has been introduced in the City
Council of the City of Dubuque;
and
Whereas said Ordinance provides
for the levy and collection of a
direct annual tax for the payment
of the principal and interest of
said bonds; and
Whereas it is advisable to make
provision for a supplemental esti-
mate of said taxes for future years
pursuant to the provisions of Sec-
tion 24.7 of the 1950 Code of Iowa;
Now Therefore Be It Resolved
by the City Council of the City of
Dubuque, Iowa:
Section 1. That pursuant to'
Chapters 407 and 76 of the 1950
Code of Iowa and Chapter 159 of
the Acts of the 54th General As-
sembly of Iowa, a supplemental
estimate of special taxes for the
payment of the principal and in-
terest of said bonds be made as
follows and that there shall be
levied, assessed and collected a
direct annual special tax upon all
of the taxable property within said
City sufficient to produce net an-

gram, consisting of constructing
a new fire station and acquiring a
site therefor and remodeling an
existing fire station in said City,
and to issue bonds for such pur•
pose not exceeding $167,000, and it
is deemed advisable and for the
best interests of said City that
Fire Station Bonds in the amount

Both principal and semi-annual in•

other things being equal, awards
will be made upon the most favor-
able bid or bids specifying the
lowest interest rate. Bidders must
furnish a certified check on a
State or National Bank for two
percent (2%) of the principal
amount of bonds bid for as a
guarantee of good faith, this
amount to be forfeited to the City
by the successful bidder should he
fail to take up and pay for any
of the bonds when ready.
The City will furnish a complete
transcript of all proceedings had
in connection with the issue of said
bonds to the successful bidder,
but bids may not be conditioned
upon the approving opinion of any
attorneys or others. The City will
furnish the printed bonds and all
bids may be so conditioned. The
right is reserved to reject any or
all bids.
