Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
Commissioner Norton recused himself and stepped down from the table.
Hannah Heiar spoke in favor of the request, indicating the Plat of Survey facilitates
dividing off a lot to accommodate construction of a new single-family home on the
property utilizing the existing farm lane for access. She noted the property has been
rezoned by Dubuque County.
Staff reviewed the staff report, noting that the access and easement has been reviewed
by both County and City Engineering Departments. Planning staff noted the Plat of
Survey is within two miles of the city and is jointly reviewed by both the City and County
of Dubuque. Staff noted a waiver of the frontage requirement is needed.
There were no public comments.
The Zoning Advisory Commission discussed the request, and reviewed the existing
farm lane will be impacted with the completion of the Southwest Arterial. The applicant
indicated there will be provided access to a new frontage road which will then connect
to North Cascade Road.
Recommendation
By a vote of 5 to 0, with one abstention, the Zoning Advisory Commission recommends
that the City Council approve the request and waive the street frontage requirement for
Lot 1 and Lot 2.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted Plat of Survey of Watters Homestead subdivides an existing parcel of
land in Dubuque County south of North Cascade Road to allow for the construction of
an additional home on the property. The County has recently rezoned the parcel to
accommodate the proposed construction of an additional single-family home.
DISCUSSION
The submitted Plat of Survey of Watters Homestead is being jointly reviewed by both
the city and county as it is within two miles of the city of Dubuque corporate limits. The
proposed subdivision is somewhat unique as Lot 2 is totally encompassed by Lot 1, and
will be served by the existing farm lane that accesses North Cascade Road.
The Engineering Department has reviewed the submitted Plat of Survey as the existing
farm access is within the Southwest Arterial construction project. Planning staff has no
objection to the proposed plat as the existing farm lane is sufficient to accommodate the
traffic generated by an additional single-family home.
County regulations would require that if an additional lot is created, that the farm lane
would have to be upgraded to a 66-foot wide roadway easement to accommodate a
larger private street. There are no plans at this time for further subdivision of the
property.
RECOMMENDATION
Planning staff recommends the Zoning Advisory Commission review the submitted Plat
of Survey of Watters Homestead and recommend approval of the Plat of Survey subject
to waiver the lot frontage requirement for Lot 2.

RESOLUTION APPROVING THE PLAT OF SURVEY OF WATTERS HOMESTEAD IN
DUBUQUE COUNTY, IOWA.
Whereas, there has been filed with the City Clerk a Plat of Survey of Watters
Homstead in Dubuque County, Iowa; and
Whereas, said Plat of Survey provides 0 feet of frontage for Lot 1 and Lot 2 on a
public or approved private street, where street frontage is required by Section 11-14 of Title
16 of the City of Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the Code of Ordinances, Unified
Development Code, is waived to allow 0 feet of frontage on a public or approved private
street for Lot 1 and Lot 2.
Section 2. That the Plat of Survey of Watters Homestead is hereby approved and
the Mayor and City Council are hereby authorized and directed to endorse the approval of
the City of Dubuque, Iowa upon said Plat of Survey.
