Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report and related materials are attached for your review. Discussion The applicant's representative spoke in favor of the request, reviewing the proposed amendment and the reasons for the change to the parking lot screening. She reviewed how the vinyl fence and landscaping will be used to soften the appearance of the fence from the residential properties across the street. She distributed photos of the proposed fence, noting its dark color. Staff reviewed the staff report, noting that the PUD was established in 1987, an amendment on screening was withdrawn in 2008, and the current request is basically the same with regard to replacement of the existing arborvitae with a combination of a vinyl fence and landscaping to soften the appearance. Staff noted both the original and proposed screening comply with UDC requirements for PUD landscaping. One person spoke with concerns about the proposed changes to the screening proposed by Dutrac Community Credit Union. The speaker indicated that as a neighbor, he preferred the existing natural landscaping. The Zoning Advisory Commission discussed the request, reviewing the original requirement contained in the 1987 PUD ordinance. Commissioners reviewed the renderings provided by the applicant and felt the change in screening was appropriate. Recommendation By a vote of 5 to 1 , the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. Said property is located between Dana Dr to the South(back parking lot area) and Southway St to the West(side parking lot)with the front of the building facing Asbury Rd (North). Approximately 450 Ft. along the Dana Dr perimeter, (South) and approximately 240 Ft. along the Southway perimeter, (West)has a vegetative screening composed of earth berm and Arborvitaes which were planted in 1986 based on the PC Planning Commercial District city ordinance. Over the years the Arborvitaes have become unhealthy, diseased, distressed and very sparse in areas. DuTrac has replaced dying trees yearly as needed which has now created a very uneven, sparse screening area. The Arborvitaes no longer provide the necessary purpose of providing a screening to block vehicle lights in darkness, a sound barrier from our drive up and parking lot traffic, or a security barrier for DuTrac and our good neighbors. According to local Nursery personnel,the berm has created a hardship on the Arborvitaes as they grew,restricting water intake. DuTrac had installed an irrigation system along the Arborvitae line but the trees continue to distress. DuTrac feels we have taken every possible step to preserve the Arborvitae screen to no avail which required us to seek other options. Proposal: DuTrac proposes to remove all the Arborvitaes, level out the berm to natural ground level, install a high quality 5 Ft. vinyl fence with steel rod re-enforcement in a wood looking tone (to appear less invasive) along the perimeter of Dana Dr(450 Ft) and Southway St(250 Ft). To frirther soften the appearance, DuTrac proposes to plant natural decorative grasses along the fence as well as other beautifying vegetation and complete the look with a 6 Ft wide level of color mulch under the fence. Dutrac will contract with Wagner Nursery to design and install said vegetation. DuTrac maintenance personnel will continue to maintain fencing and vegetation once installed to ensure the high quality remains. With installing the fence,DuTrac would be able to restore the needed security barrier, cut down on car lights facing the neighbors as well as reduce the noise level from vehicles using the drive up or ATM, and would once again create the required barrier per the PC Plan. Kritz, Associate Planner SUBJECT: Proposal to Amend the DuTrac Community Credit Union Planned Unit Development to modify Screening Requirements DATE: April 25, 2017 INTRODUCTION DuTrac Community Credit Union is proposing to amend the Planned Unit Development (PUD) that is applied to their property at 3465 Asbury Road to modify the screening requirements contained in the PUD Ordinance. BACKGROUND The PUD District for DuTrac Community Credit Union property located at 3465 Asbury Road was approved by the City Council on January 5, 1987. The adopted PUD Ordinance regulated the allowed uses, setbacks, signs, and had specific site plan provisions, including that a screen composed of an earthen berm and/or shrubbery of at least five (5) foot in height and 50% opacity be provided adjoining Southway and Dana Drive. Subsequent to the adoption of Ordinance 02-87, DuTrac Community Credit Union proceeded with development of the new credit union building and in all respects complied with the adopted PUD Ordinance. DuTrac Community Credit Union previously sought an amendment in 2008 to the screening requirements and subsequently tabled the request in August 2008. DISCUSSION As part of the current application, the applicant has provided a summary of why they want to change the screening from the existing arborvitae. In addition, the applicant notes that they propose to install a five-foot vinyl fence with additional landscaping to soften the appearance of the vinyl fence. The applicant has provided exhibits that illustrate their proposal to amend the existing screening requirements. Planning staff has reviewed the submitted proposal and the proposed change to the screening requirements complies with the current screening requirements found in the Unified Development Code. The proposal will provide greater screening from vehicle headlights during winter months. RECOMMENDATION Planning staff recommends that the Zoning Advisory Commission review the applicant's information and make a recommendation to the City Council on the proposed amendment to the screening requirements for the DuTrac Community Credit Union Planned Unit Development District. That Title 16, the Unified Development Code of the City of Dubuque Code of Ordinances is hereby amended by rescinding Ordinance 02-87 which provides regulations for the Planned Unit Development District with a Planned Commercial District designation for Dutrac Community Credit Union, and now being amended to allow for a revised screening requirement as in Exhibit A as stated below, to wit: Lots 1, 2, 3 and 6 of Block 1, and Lots 1, 2, 3, 4, 5 and 6 of Block 2 Westchester Subdivision, and to the centerline of the adjoining public right-of- way, all in the City of Dubuque, Iowa. A. Use Regulations. The following regulations shall apply to all uses made of land in the above-described PC Planned Commercial District: 1. The principal permitted uses shall be limited to: a. Commercial and non-commercial art galleries e. Museums and libraries f. Schools of instruction g. Private or public clubs, auditoriums and assembly halls h. General office and rental office i. Medical and dental laboratories j. Drug and health care supplies k. Book, stationary, office supplies, and office furniture I. Artist and photographic studio m. Printing and publishing n. Bank, savings and loan, and small and industrial loan companies, credit unions, with a drive -up or automated facilities o. Data processing center with abilities for satellite data p. Business services q. Personal services r. Professional services (medical) 2. Accessory uses shall include any use customarily incidental and subordinate to the principal use it serves. 3. Temporary use shall be limited to the following: Any use listed as a permitted use within the PUD District of a limited duration as established in Section 2-5.3 of the Unified Development Code. B. Lot and Bulk Regulations: Development of the land in this particular PC Planned Commercial District shall be regulated as follows. 1. The primary structure shall provide a minimum thirty (30) foot front yard setback adjoining Asbury Road, a minimum of fifty (50) foot front yard setback adjoining Dana Drive, and a minimum one hundred (100) foot front yard setback adjoining South Way. Dutrac Community Credit Union PUD Page 3 2. Accessory structures may be located in the required side yard. 3. No building or structure can exceed forty (40) feet in height. 4. The primary structure shall not exceed 25,000 square feet of gross floor area. 5. Screening shall be required for all mechanical equipment. C. Signs: 1. The sign regulations shall be the same as that which are allowed in the OS Office Service District as established in Section 15 Signs of the Unified Development Code. D. Performance Standards 1. Conceptual Development Plan The development and maintenance of uses in the Dutrac Community Credit Union PUD Plan shall comply with the Conceptual Plan as follows: a. The site plans shall be submitted in accordance with Sections 12 and 13 of the Unified Development Code. b. The landscaping and screening requirements as established in Section 4-5 shall apply to this PC Planned Commercial District. A screening composed of earth berm and/or shrubbery of at least five (5) feet in height and 50% opacity or a combination of a solid fence and landscaping as shown in Exhibits A and B attached to this ordinance shall be provided adjoining South Way and Dana Drive. c. Access to and from the site is restricted to Asbury Road. No curb cuts shall be permitted onto South Way or Dana Drive. d. Traffic circulation is restricted to the central portion of the site. e. The rate of storm water discharge from the development (cubic feet per second) shall be limited to the rate estimate for 30% impervious area. f. Within the fifty (50) foot front yard setback a long South Way and Dana Drive, a fifteen (15) foot maximum height shall be allowed for lighting. Dutrac Community Credit Union PUD Page 4 2. Off -Street Parking and Loading Regulations a. All vehicle -related features shall be surfaced with standard or permeable asphalt, concrete, or pavers. b. All parking and loading spaces shall be delineated on the surfacing material by painted stripes or other permanent means. a. The number, size and design of parking spaces and parking lots, including bicycle parking and shared parking, shall be governed by applicable provisions in Section 13 Site Design Standards and 14 Parking of the City of Dubuque Unified Development Code. b. The number, size, design, and location of parking spaces designated for persons with disabilities shall be according to the local, state, or federal requirements in effect at the time of development. c. No on -street maneuvering of delivery vehicles will be allowed on any street. Lots shall provide all necessary maneuvering space for delivery vehicles within the boundaries of the lots. 3. Site Lighting New outdoor light fixtures shall comply with Section 13-3.1 Site Design Standards of the Unified Development Code. 4. Landscaping and Screening Regulations Landscaping and screening requirements shall comply with Section 13-4.1 Site Design Standards of the Unified Development Code and the Performance Standards of this PUD Ordinance. 5. Exterior Trash Collection Areas Exterior trash collection areas shall comply with Section 13-4.9 Site Design Standards of the Unified Development Code. 6. Exterior Storage Exterior storage shall comply with Section 13-4.1 Site Design Standards of the Unified Development Code. 7. Platting Dutrac Community Credit Union PUD Page 5 Subdivision plats shall be submitted in accordance with Section 11 Land Subdivision of the Unified Development Code. 8. Site Plans Final site development plans shall be submitted in accordance with Section 12 Site Plans and Section 13 Site Design Standards of the Unified Development Code prior to construction of each building and vehicle -related feature unless otherwise exempted by Section 12 Site Plans. 9. Storm Water Conveyance The developer shall be responsible for providing surface or subsurface conveyance(s) of storm water from the lot to existing storm sewers or to flow line of open drainage ways outside the lot in a means that is satisfactory to the City Engineer. Other applicable regulations enforced by the City Engineer relative to storm water management and drainage shall apply to properties in the PUD District. 10. Noises. Noises generated within the PUD District shall be regulated by Chapter 33, Article IV, Noises, of the City of Dubuque Code of Ordinances. 11. Other Codes and Regulations These regulations do not relieve an owner, developer, or tenant from other applicable city, county, state or federal codes, regulations, laws and other controls relative to the planning, construction, operation and management of property in the PUD District. E. Transfer of Ownership Transfer of ownership or lease of property in the Dutrac Community Credit Union District PUD shall include in the transfer or lease agreement a provision that the purchaser or lessee acknowledges awareness of the conditions authorizing the establishment of the District PUD. Section 2. The foregoing amendment has heretofore been reviewed by the Zoning Advisory. Commission of the City of Dubuque, Iowa. Section 3. That Title 16, the Unified Development Code of the City of Dubuque Code of Ordinances is hereby amended by rescinding Ordinance 02-87 which provides regulations for the Planned Unit Development District with a Planned Commercial District designation for Dutrac Community Credit Union, and now being amended to allow for a revised screening requirement as in Exhibit A as stated below, to wit: Lots 1, 2, 3 and 6 of Block 1, and Lots 1, 2, 3, 4, 5 and 6 of Block 2 Westchester Subdivision, and to the centerline of the adjoining public right-of- way, all in the City of Dubuque, Iowa. A. Use Regulations. The following regulations shall apply to all uses made of land in the above-described PC Planned Commercial District: 1. The principal permitted uses shall be limited to: a. Public or quasi -public utilities including substations b. Residential use above the first floor c. Mortuaries and funeral homes Dutrac Community Credit Union PUD Page 2 d. Commercial and non-commercial art galleries e. Museums and libraries f. Schools of instruction g. Private or public clubs, auditoriums and assembly halls h. General office and rental office i. Medical and dental laboratories j. Drug and health care supplies k. Book, stationary, office supplies, and office furniture I. Artist and photographic studio m. Printing and publishing n. Bank, savings and loan, and small and industrial loan companies, credit unions, with a drive -up or automated facilities o. Data processing center with abilities for satellite data p. Business services q. Personal services r. Professional services (medical) 2. Accessory uses shall include any use customarily incidental and subordinate to the principal use it serves. 3. Temporary use shall be limited to the following: Any use listed as a permitted use within the PUD District of a limited duration as established in Section 2-5.3 of the Unified Development Code. B. Lot and Bulk Regulations: Development of the land in this particular PC Planned Commercial District shall be regulated as follows. 1. The primary structure shall provide a minimum thirty (30) foot front yard setback adjoining Asbury Road, a minimum of fifty (50) foot front yard setback adjoining Dana Drive, and a minimum one hundred (100) foot front yard setback adjoining South Way. Dutrac Community Credit Union PUD Page 3 2. Accessory structures may be located in the required side yard. 3. No building or structure can exceed forty (40) feet in height. 4. The primary structure shall not exceed 25,000 square feet of gross floor area. 5. Screening shall be required for all mechanical equipment. C. Signs: 1. The sign regulations shall be the same as that which are allowed in the OS Office Service District as established in Section 15 Signs of the Unified Development Code. D. Performance Standards 1. Conceptual Development Plan The development and maintenance of uses in the Dutrac Community Credit Union PUD Plan shall comply with the Conceptual Plan as follows: a. The site plans shall be submitted in accordance with Sections 12 and 13 of the Unified Development Code. b. The landscaping and screening requirements as established in Section 4-5 shall apply to this PC Planned Commercial District. A screening composed of earth berm and/or shrubbery of at least five (5) feet in height and 50% opacity or a combination of a solid fence and landscaping as shown in Exhibits A and B attached to this ordinance shall be provided adjoining South Way and Dana Drive. c. Access to and from the site is restricted to Asbury Road. No curb cuts shall be permitted onto South Way or Dana Drive. d. Traffic circulation is restricted to the central portion of the site. e. The rate of storm water discharge from the development (cubic feet per second) shall be limited to the rate estimate for 30% impervious area. f. Within the fifty (50) foot front yard setback a long South Way and Dana Drive, a fifteen (15) foot maximum height shall be allowed for lighting. Dutrac Community Credit Union PUD Page 4 2. Off -Street Parking and Loading Regulations a. All vehicle -related features shall be surfaced with standard or permeable asphalt, concrete, or pavers. b. All parking and loading spaces shall be delineated on the surfacing material by painted stripes or other permanent means. a. The number, size and design of parking spaces and parking lots, including bicycle parking and shared parking, shall be governed by applicable provisions in Section 13 Site Design Standards and 14 Parking of the City of Dubuque Unified Development Code. b. The number, size, design, and location of parking spaces designated for persons with disabilities shall be according to the local, state, or federal requirements in effect at the time of development. c. No on -street maneuvering of delivery vehicles will be allowed on any street. Lots shall provide all necessary maneuvering space for delivery vehicles within the boundaries of the lots. 3. Site Lighting New outdoor Tight fixtures shall comply with Section 13-3.1 Site Design Standards of the Unified Development Code. 4. Landscaping and Screening Regulations Landscaping and screening requirements shall comply with Section 13-4.1 Site Design Standards of the Unified Development Code and the Performance Standards of this PUD Ordinance. 5. Exterior Trash Collection Areas Exterior trash collection areas shall comply with Section 13-4.9 Site Design Standards of the Unified Development Code. 6. Exterior Storage Exterior storage shall comply with Section 13-4.1 Site Design Standards of the Unified Development Code. 7. Platting Dutrac Community Credit Union PUD Page 5 Subdivision plats shall be submitted in accordance with Section 11 Land Subdivision of the Unified Development Code. 8. Site Plans Final site development plans shall be submitted in accordance with Section 12 Site Plans and Section 13 Site Design Standards of the Unified Development Code prior to construction of each building and vehicle -related feature unless otherwise exempted by Section 12 Site Plans. 9. Storm Water Conveyance The developer shall be responsible for providing surface or subsurface conveyance(s) of storm water from the lot to existing storm sewers or to flow line of open drainage ways outside the lot in a means that is satisfactory to the City Engineer. Other applicable regulations enforced by the City Engineer relative to storm water management and drainage shall apply to properties in the PUD District. 10. Noises. Noises generated within the PUD District shall be regulated, by Chapter 33, Article IV, Noises, of the City of Dubuque Code of Ordinances. 11. Other Codes and Regulations These regulations do not relieve an owner, developer, or tenant from other applicable city, county, state or federal codes, regulations, laws and other controls relative to the planning, construction, operation and management of property in the PUD District. E. Transfer of Ownership Transfer of ownership or lease of property in the Dutrac Community Credit Union District PUD shall include in the transfer or lease agreement a provision that the purchaser or lessee acknowledges awareness of the conditions authorizing the establishment of the District PUD. Section 2. The foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 3.
