South fork Sanitary Sewer Connection Fees - Phase Ill
Public Works Director Mike Koch is recommending the establishment of connection fees
for the South Fork Sanitary Sewer- Phase III construction project. Final acceptance of
the project as completed by Stewart Construction in the amount of $613,467.99 was
done at the May 20, 2002 City Council meeting.
The connection fee schedule for this project includes all serviceable properties within
the sanitary sewer drainage basin for the South Fork Interceptor Sewer- Phase III.
Many of these properties within the basin are located outside of the corporate limits of
the City of Dubuque; however, the connection fees will not become due and payable
until such time as any properties included in the schedule of connection fees are
annexed and until such time that an actual connection is made to the sanitary sewer for
any individual properties.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

A public hearing was set by the City Council for June 17, 2002, to approve the
schedule of connection fees for the South Fork Sanitary Sewer- Phase III.
The connection fee schedule for this project includes all serviceable properties
within the sanitary sewer drainage basin for the South Fork Intemeptor Sewer -
Phase II1. Many of these properties within the basin are located outside of the

ORDINANCE NO. 49-02
AN ORDINANCE ESTABLISHING A SCHEDULE OF SEWER CONNECTION FEES FOR THE
CONNECTION OF PROPERTY TO THE SOUTH FORK SANITARY SEWER PROJECT -
PHASE III
Whereas, after full consideration of the schedule of sanitary connection fees proposed to be
made for the South Fork Sanitary Sewer Project - Phase III, which schedule of connection fees was
filed in the office of the City Clerk on the 20th day of May, 2002; and
Whereas, the City Council has determined that the amounts shown on said schedule are proper
and are in proportion to the benefits conferred; and
Whereas, the City Council further finds that the schedule of sewer connection fees for the South
Fork Sanitary Sewer Project - Phase III be approved and adopted.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE;
IOWA:
Section 1. There is hereby established a schedule of sewer connection fees the South Fork
Sanitary Sewer Project - Phase III for the connection of property to said City sewer.
Section 2. Each property owner whose property will be served by connection to said City
sewer shall pay a sewer connection fee to the City, as shown on the schedule of sewer connection fees
attached hereto.
Section 3. Such connection fee shall be due and payable when a sewer connection
application is filed with the City. All fees collected under this Ordinance shall be paid to the City
Treasurer.
Section 4. The City Clerk is hereby authorized and directed to certify a copy of this
Ordinance for recording in the office of the Dubuque County Recorder.

INTRODUCTION
The enclosed resolutions provide for final acceptance of the improvements to the
South Fork Sanitary Sewer - Phase III and the establishment of connection fees
for connection to the South Fork Sanitary Sewer.
DISCUSSION
Construction of the improvements to the South Fork Sanitary Sewer - Phase III
has been completed by Stewart Construction Company of Dubuque. The final
contract amount is $613,467.99. Even though the construction was completed ~n
2000, final costs for associated easements for the project and crop damage were
not submitted until the end of 2001.
This sewer provides sewer service to 1347.28 acres of developable preper~y.
Connection fees from future connections to this sewer will pay for the cost of the
sewer.
This project was funded under the Sanitary Sewer Extension Policy which allows
the City to construct interceptor and collector sewers with City funds and
establish a connection charge to benefiting property owners within the sanitary
district if and when property owners connect to the sewer.
The connection fees for this interceptor sewer are based on the cost per acre for
the sewer project and are allocated to all properties within the district, except for
97.32 acres of undevelopable "floodplain" in this basin. The connection fees will
be collected as properties in the district are developed. The connection fees are
estimated to be $732,083.86. This is calculated at the rate of $543.3797 per
developable acre.
RECOMMENDATION
I recommend that the improvements in the South Fork Sanitary Sewer Phase Ill
project be accepted and that the schedule of connection fees be approved.

This project was funded from the General Fund. The funds are being repaid to
the General Fund from the Sewer Fund and through connection charges as
development occurs in the district.
ACTION TO BE TAKEN
The City Council ~s requested to adopt the attached resolutions accepting the
improvements in the South Fork Sanitary Sewer Phase III and establishing the
final construction cost of the project, and setting a public hearing on the
establishment of connection fees for the sanitary sewer district.

ACCEPTING THE PUBLIC IMPROVEMENT TO THE SOUTH FORK
SANITARY SEWER PROJECT - PHASE III
Whereas, the contract for the South Fork Sanitary Sewer Pro~ect - Phase
II has been completed and the City Manager has examined the work and filed
his certificate stating that the same has been completed according to the terms of
the contract, plans and specifications and recommends its acceptance.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved
and that said improvement be and the same ~s hereby accepted.
Section 2. That the City Treasurer be and is hereby directed to pay to
the contractor from the General Fund an amount equal to the amount of the
contract, less any retained percentage provided for therein.

RESOLUTION PROVIDING FOR NOTICE OF THE DATE, TIME AND
PLACE OF A PUBLIC HEARING ON AN ORDINANCE ESTABLISHING
THE SOUTH FORK SANITARY SEWER PROJECT - PHASE III AND A
SCHEDULE OF CONNECTION FEES
Whereas, the City Council of the City of Dubuque, Iowa, proposes to
establish, by Ordinance after notice of a public hearing, the South Fork Sanitary
Sewer Project - Phase III and to provide a schedule of connection fees therefor;
and
Whereas, Iowa Code Section 384.38(3) requires notice and a public
hearing on such Ordinance; and
NOW, THEREFORE, BE iT RESOLVED BY THE CiTY COUNCIL OF
THE CITY OF DUBUQUE, iOWA:
Section 1. The City Clerk is hereby authorized and directed to publish
notice of the date, time and place of the hearing on said proposed Ordinance,
which hearing shall be on June 17, 2002 at 6:30 p.m. in the Public Library
Auditorium in the City of Dubuque, Iowa, such publication to be once each week
for two consecutive weeks in the manner provided by Section 362.3, the first
publication of which shall not be less than ten (10) days before the date of the
headng.
Section 2. The notice shall be in substantially the following form:
Notice To Property Owners
Notice is given that there is now on file for p_ublic inspection in the
office of the Clerk of the City of Dubuque, City Hall, Dubuque, Iowa,
a proposed Ordinance establishing the South Fork Sanitary Sewer
Project - Phase III and providing for connection fees.
The Council will meet at 6:30 p.m. on June 17, 2002, at the Public
Library Auditorium, 360 West 11th Street, in the City of Dubuque,
Iowa, at which time the owners of property subject to connection
fees in the South Fork Sanitary Sewer project - Phase III or any
other person having an interest in the matter may appear and be
heard for or against the establishment of the District, or the
schedule of connection fees. A person subject to such connection
fees will be deemed to have waived all objections unless at the time
of hearing, the person has filed objections with the Clerk.
Section 3. Not less than fifteen (15) days before the hearing, the Clerk
shall also send a copy of the notice by mail to each property owner whose
property will be served by connection to said City sewer and be subject to
the connection fees at the address as shown by the records of the County
Auditor.

NOTICE TO PROPERTY OWNERS
Notice is given that there is now on file for public inspection in the office of
the Clerk of the City of Dubuque, City Hall, Dubuque. Iowa. a proposed
Ordinance establishing the South Fork Sanitary Sewer Project - Phase It and
providing for connection fees.
The Council will meet at 6:30 p.m. on June 17, 2002, at the Public Library
Auditorium, 360 West 11th Street, in the City of Dubuque, Iowa, at which time the
owners of property subject to connection fees in the South Fork Sanitary Sewer
Project - Phase III or any other person having an interest in the mat[er may
appear and be heard for or against the establishment of the District, or the
schedule of connection fees. A person subject to such connection fees will be
deemed to have waived all objections unless at the time of hearing, the person
has filed objections with the Clerk.

RESOLUTION PROVIDING FOR NOTICE OF THE DATE, TIME AND
PLACE OF A PUBLIC HEARING ON AN ORDINANCE ESTABLISHING
THE SOUTH FORK SANITARY SEWER PROJECT - PHASE II1 AND A
SCHEDULE OF CONNECTION FEES
Whereas, the City Council of the City of Dubuque, Iowa, proposes to
establish, by Ordinance after notice of a public hearing, the South Fork Sanitary
Sewer Project - Phase III and to provide a schedule of connection fees therefor;
and
Whereas, Iowa Code Section 384,38(3) requires notice and a public
hearing on such Ordinance; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, iOWA:
Section 1. The City Clerk is hereby authorized and directed to publish
notice of the date, time and place of the hearing on said proposed Ordinance,
which hearing shall be on June 17, 2002 at 6:30 p.m. in the Public Library
Auditorium in the City of Dubuque, Iowa, such publication to be once each week
for two consecutive weeks in the manner provided by Section 362~3, the first
publication of which shall not be less than ten (10) days before the date of the
hearing.
Section 2. The notice shall be in substantially the following form:

SANITARY SEWER PROJECT - PHASE Ill
Whereas, the contract for the South Fork Sanitary Sewer Project - Phase
III has been completed and the City Manager has examined the work and filed
his certificate stating that the same has been completed according to the terms of
the contract, plans and specifications and recommends its acceptance.
NOW THEREFORE, BE IT RESOLVED BY THE CiTY COUNCIL OF THE
CiTY OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved
and that said improvement be and the same is hereby accepted.
Section 2. That the City Treasurer be and is hereby directed to pay to
the contractor from the General Fund an amount equal to the amount of the
contract, less any retained percentage provided for therein.

Public Works Director Mike Koch recommends acceptance of the South Fork Sanitary
Sewer Phase III, as completed by Stewart Construction, in the final contract amount of
$613,467.99. Even though the construction was completed in 2000, final costs for
associated easements for the project and crop damage were not submitted until the end
of 2001. It is further recommended that a public hearing be set for June 17, 2002, on
the establishment of connection fees for the sanitary sewer district.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The encloSed resolutions provide for final acceptance of the improvements to the
South Fork Sanitary Sewer- Phase III and the establishment of connection fees
for connection to the South Fork Sanitary Sewer.
DISCUSSION
Construction of the improvements to the South Fork Sanitary Sewer - Phase Ill
has been completed by Stewart Construction Company of Dubuque. The final
contract amount is $613,467.99. Even though the construction was completed in
2000, final costs for associated easements for the project and crop damage were
not submitted until the end of 2001.
This sewer provides sewer service to 1347.28 acres of developable property.
Connection fees from future connections to this sewer will paY for the cost of the
sewer.
This project was funded under the Sanitary Sewer Extension Policy which allows
the City to construct interceptor and collector sewers with City funds and
establish a connection charge to benefiting property owners within the sanitary
district if and when property owners connect to the sewer.
The connection fees for this interceptor sewer are based on the cost per acre for
the sewer project and are allocated to all properties within the district, except for
97.32 acres of undevelopable "floodplain" in this basin. 'Fhe connection fees will
be collected as properties in the district are developed. The connection fees are
estimated to be $732,083.86. This is calculated at the rate of $543.3797 per
developable acre.
RECOMMENDATION
I recommend that the improvements in the South Fork Sanitary Sewer Phase III
project be accepted and that the schedule of connection fees be approved.

This project was funded from the General Fund. The funds are being repaid to
the General Fund from the Sewer Fund and through connection charges as
development occurs in the district.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolutions accepting the
improvements in the South Fork Sanitary Sewer Phase II1 and establishing the
final construction cost of the project, and setting a public hearing on the
establishment of connection fees for the sanitary sewer district.
