The project was broken up into six components, and Public Works Director Mike Koch is recommending bid award on three of those components as follows: Masonry tuck pointing would be warded to Renaissance Restoration, Inc. in the amount of $93,640. Heating, ventilation and air-conditioning would awarded to Rafoth Sheet Meta, Inc. in the amount of $19,250. Plumbing and sprinkler would be awarded to Simplex Grinnell, Inc. in the amount $69,661. BACKGROUND The Dubuque County Historical Society (DCHS) and the City, as the local sponsor, secured a Transportation Equity Act for the 21st Century (TEA-21) Grant awarded by the Iowa Department of Transportation (Iowa DOT). Through discussions with the iowa DOT, DCHS and City staff, it was determined that the project would be more efficiently managed and would have more local participation if the project could be bid locally through the City of Dubuque. The Iowa DOT will allow local bidding of a TEA-21 project if the project elements being bid are estimated to cost less than $100,000 each. To achieve this, the Woodward Museum - 2002 Renovations Project was separated into six (6) individual projects. The City entered into a supplemental agreement with the Iowa DOT for local bidding of all six (6) individual projects through the City's bidding process. DISCUSSION As stated, the project has been separated into six (6) individual projects. received on June 6, 2002 are summarized as follows: The bids Contract No.1 - Masonry Tuckpointing The masonry tuckpointing will include the removal of the existing painting signage, tuckpointing of the existing brick and the replacement of damaged masonry units. Renaissance Restoration, Inc. $ 93,640 Contract No.2 - Roof & Gutters/Downspouts The roof & gutters/downspouts will include the removal of existing roofing materials on the one-story section, installation of new built-up roofing on the one-story section, repair of the built-up roof on the two-story section and installation of new pre-finished metal gutters and downspouts throughout. No Bid Contract No.3 - Carpentry The carpentry work shall include the removal of the metal panels on the one-story windows, replacement of broken glass in the one-story windows, restoration of all existing windows, installation of storm windows on the second floor windows and construction of bulkheads/chases to conceal fire sprinkler piping in the two-story section. No Bid Contract No.4 - HVAC The HVAC work shall include the modifications to the existing equipment and controls to assist in controlling the humidity levels throughout the structure. Rafoth Sheet Metal, Inc. $19,250.00 Contract No.5 - Plumbing and Sprinkler The plumbing and sprinkler work will include the installation of a fire sprinkler system throughout the building and the removal of existing plumbing fixtures in one of the existing restrooms. Simplex Grinnell Continental Fire Sprinkler $ 69,661,00 $ 74,600.00 Contract No.6 - Electrical The electrical work shall include the installation of a new smoke and heat detection system throughout the building including the attic space and the associated modifications to the electrical circuitry. No Bid Upon receipt of the bids, City staff, the Dubuque County Historical Society and their Architectural - Engineering design consultant, the Durrant Group, reviewed the multiple construction bid proposals. Two of the bids received did not provide the required bid security and were rejected on that basis. Several of the other bids did not include the targeted required information regarding the contractor's efforts to achieve 3% minority participation in the contract. The bidders were clearly required to provide information required along with their bid proposals. A total of 18 bidders did not meet this requirement and were rejected because of this requirement. The recommendation of City staff, the DCHS and Durrant, is to award the bids on these contracts where there was one or more valid bids received and to reject the remaining bid proposals. While there was one valid bid received for Contract No. 3, this bid is 142% over the estimate and it is recommended that the bid be rejected and the project also be re-bid. Bid tally sheets showing all of the bids received, including the non- responsive bids are attached. BUDGET IMPACT The total project statement of probable cost for the Woodward Museum - 2002 Renovations Project is $960,040 which includes a 10% contingency and design fees. The contracts being bid at this time total $182,551. The Dubuque County Historical Society has a TEA-21 Grant awarded by the Iowa Department of Transportation in the amount of $629,121 for the Woodward Museum - 2002 Renovations Project. The projects will be funded with 30% Dubuque County Historical Society funds and 70% State/Federal funds up to the maximum grant amount. The DCHS has submitted a final draft of the construction documents, including project plans, specifications and probable cost estimates for the Woodward Museum - 2002 Renovations Project to both the State Historical Preservation office and the Iowa DOT for approval. To date, the City and the DCHS have received written authorization to proceed on the six (6) individual contract components. Due to the complexity of the project and the immediate proximity to the Mississippi River Discovery Center site, Conlon Construction has been hired ~lirectly by the Dubuque County Historical Society to provide construction management, coordination and inspection for all six (6) projects. There ware 24 biddem on several parts of the project. 5 of those bidders had the required DBE "document" All of the other bidders were not recognized. Three of the bid areas had no bidder with the =required" form We were told these bid areas ware going to be rebid The other three areas were going to be recommended to be awarded. Of the three to be awarded only one had the Iow bid with the "required" form The other 2 were recommended to be awarded with bids more than $25,000 higher than the Iow bids with the proper bid bond, $25,000 of the taxpayers money. There were 6 bid areas. Only one was recommended award to the Iow bidder. 2 ware recommended at a higher than Iow bid and 3 ware not even considered. I would say there is something wrong. 1. The bidding documents ware not prepared in a way that would give bidders a proper set of instructions. 2. When Chris from Durant was called, he did not know exactly what to do, we told him what wa normally do and what envelope wa use for what and he approved. Our bid was rejected 3. The proper way to give bidders instructions is to instruct them what envelope should contain what and what should be put on the outside of the envelopes 4. It is the responsibility of the party requesting a bid to include all of the required forms to be included with the bid. 5. when asking the city engineer about the form, he said he did not want to make it seem too complicated, therefore he did not have a form to fill out for the "required" information. By this action, the city has stole the paychecks of the workers that could be working on this project Jun 6. The contractors that worked so hard to give a Iow bid to the city am penalized by the city because the city and its architect failed to (a) give "instructions to the bidders" and (b) supply the "forms required" for the bid. These contractors are robbed of possible dollars to pay them overhead and maybe a little profit. See attached samples of instruction to bidders page 38,4 and the TSB forms required. These were supplied on another project and properly included by all bidders. 7. Other government entities wave a minor irregularities allowing contractors to supply a "required" form in a timely manner after the bidder was notified of the irregularity. The project manual has a notice to bidders in the front of the manual where it states ~The City Council reserves the right to reject any and all bids or to waive any technical ties and irregularities.' 8. Them was no DBE's in all of the bids except one and there bid was also thrown out 9. Them was not any possible DBE subs for our masonry bid because we were going to do the work ourselves with our own people and our own equipment. This is tuckpointing not general contracting where you may have a chance to get a bid from a DBE. Attached is a copy of the DBE directory table of contents which clearly shows there is no possible DBE's for this project. The DBE list supplied appeared to be for road work, not for construction projects where buildings are involved, This list is the one supplied in addendum 2 where the bidders were directed to a intemet location for the list of possible DBE's. Where does it say in the bid documents that your bid will be thrown out if you don't have a mysterious form that does not even exist. Why did the city not provide a form if one was required? Why did the city not provide instructions to the bidder on how to prepare the bid documents like every other government agency does? Why does the city not wave minor irregularities like every other responsible agency does? Why does the city not take the Iow bid? Therefore the city does not know if the bidders acknowledged the addendum ~r2 or any other addendum. A responsible Iow bidder has the form of bid and a proper bid bond, these are the items that make up the dollam where the citizens get the lowest cost. This is how tax dollars are saved. This paper you required serves no advantage to anyone except your record keeping and serves no purpose in this case. Koch, Public Works Director Woodward Museum - 2002 Renovations Project Iowa DOT Ref No. STP-ES-2100 (619)--81-31 Iowa DOT Agreement No. 00-STPE-45 INTRODUCTION This correspondence is intended to provide further information and clarification related to the contract documents and required bid submittal materials associated with the Woodward Museum - 2002 Renovations Project. BACKGROUND Since this is a State/Federal funded project (Federal Enhancement funds), the Iowa Department of Transportation established a 3% goal for Disadvantaged Business Enterprises (DBE) participatio~ for the Woodward Museum - 2002 Renovations Project. Authority for the Department's DBE Program is derived from, but is not limited to the following: Title VI of the. Federal Civil Rights Act of 1964 and any amendments; Executive Order 11625 and any amendments; Transportation Equity Act for the 21st Century (TEA-21); 49 CFR Part 26 of the Federal Register and any amendments. The Dubuque County Historical Society (DCHS) was required to submit construction documents, including project plans, specifications and probable cost estimates for the project to both the State Historic Preservation Office and the Iowa Department of Transportation (IDOT) for approval. Prior to initiating the public bidding procedure, the City and the DCHS received authorization to proceed on the six (6) individual contract components. On Thursday, March 23, 2002 a pre-bid contractors informational meeting was held on the project at the Portside Building. The notice of the pre-bid contractors informational meeting was published with the "Notice to Bidders" and was also included in the "Pro.ect Specifications Manual". The pre-bid meeting was open to all contractors interested submitting a bid proposal. Although not mandatory, each prospective bidder was encouraged to attend the pre-bid contractors informational meeting. Based upon discussion and questions raised at the pre-bid contractors meeting, both City staff and Durrant felt it necessary to issue an addendum to clarify for the contractors the specific DBE requirements associated with the bid process and what was to be included along with the bid submittal. On Friday, May 31, 2002, Durrant issued PRE-BID ADDENDUM NO. 2 to all plan holders of record. The following is a quote from the addenda which was issued: DBE CLARIFICATION TO CONTRACTS NOS. 1 THROUGH 6 "On each bid proposal form, a 3% Disadvantaged Business Enterprises (DBE) Goal is listed. It is each bidder's responsibility to make a good faith effort to meet this goal. It is required on each bid proposal form to include a DBE commitment in the space provided and to include documentation on the good faith effort each bidder has made to reach the 3% DBE goal. Even if the percentage of DBE commitment is zero, the commitment and the documentation of the searci~ for DBE firms MUST be included with each bid. For a directory of DBE firms, go to www.bidx.com, click on the State of Iowa on the map, click on the "Lettings" tab at the upper left of the screen, and then click on the "DBE Directory" at the right. A copy of the PRE-BID ADDENDUM NO. 2 is attached for reference. By virtue of the ADDENDUM NO. 2 which ~s a binding record of the contract bid documents, by not providing the required DBE submittals with the bid proposal, the bid proposal is considered non-responsive and thus rejected and not considered. In total. 25 bids were submitted on the 6 individual contracts being bid. It is not unusual to have some level of nonconformity in the bidding process leading to the rejection of certain bids. This sedes of contracts had 3 bids rejected on the basis of an improper bid bond, and 3 bids were rejected because of a corn plete failure to solicit minority participation. A total of 7 bids were correctly submitted with regard to DBE documentation. Some of the bidders submitted letters summarizing their efforts to obtain DBE contractors, and some used a summary form generally utilized by IDOT for this purpose. Either format was acceptable to document the contractor's good faith efforts to solicit minority participation. RECOMMENDATION The City does include a provision in its contract language that allows for technicalities to be waived. Neither the failure of a bidder to provide a proper bid bond, nor a contractor's lack of any mandated effort to solicit minority contractors are conditions which could be waived as minor irregularities. Bidders were required to show their pre-bid efforts to solicit minority participation for this project, with 3% as a targeted goal, not a specific requirement. A total of 7 contractors indicated such pre-bid efforts by submitting this documentation along with their bids. Only these 7 bids were considered responsive to the specifications. One can only speculate as to the pre-bid efforts of those contractors not documenting their efforts to attract a DBE contractor as part of their bids. During the City's review of the results of the bidding process, contact was made to the iowa Department of Transportation to determine how they would handle bids received in this manner. IDOT indicated concurrence with the City's position that the pre-bid documentation had to be supplied along with the bid proposal in order for the bid to be considered valid. It is on the basis of the outlined requirements that 15 of the total 25 bids were rejected as non-responsive to the contract requirements.
