AFFIDAVIT OF COMPLIANCE: Staff presented an Affidavit of Compliance verifying the
meeting was being held in compliance with the Iowa Open Meetings Law.
CALL TO ORDER: The meeting was called to order by Chairperson Mozena at 5:04 p.m.
MINUTES: Motion by Wand, seconded by Guinn, to approve the minutes of the April 18
2002 Historic Preservation Commission meeting as submitted. Motion carried by the
following vote: Aye -Kringle, Gibbs, Wand, Guinn, Henson and Mozena; Nay - None.
Chairperson Mozena moved the design review for 729 Bluff Street to the front of the
agenda at the request of Nancy and Richard Wallace because of a time conflict.
DESIGN REVIEW: Application of Nancy & Richard Wallace for a Certificate of
Appropriateness to install a sign located at 729 Bluff Street in the Cathedral District.
Richard Wallace presented his application to the Commission. He noted that the sign
would be made of wood and painted. He stated that the sign wil be installed on an
existing sign bracket. Staff Member Wernimont presented the application. He noted that
the sign meets the current sign regulations for a property located in an office residential
district and a historic district. He also noted that in a conversation with a sign Contractor
on May 1, 2002, the sign contractor indicated that the sign would be 40" by 20".
Motion by Kringle, seconded by Wand, to approve the application as submitted. Motion
carried by the following vote: Aye -Kringle, Gibbs, Wand, Guinn, Henson and Mozena;
Nay - None.
DESIGN REVIEW: Application of Grand Opera House to seek recommendation to be
listed on National Register for property located at 135 8th Street.
Chris Chapin-Tiiton reported they are in the process of listing the Grand Opera House
on the National Register of Historic Places. Ms. Tilton discussed the history of the
structure and described the interior of the building. Ms. Tilton described three stages
of restoration that are currently scheduled for the Grand Opera House. She noted they

have applied for several grants to help fund the restoration project. Staff Member
Carstens described the Commission's role in reviewing National Register Nominations.
Motion by Guinn, seconded by Wand, to recommend the Grand Opera House be listed
on the National Register of Historic Places based on meeting criteria A and C. n
addition, the Commissions felt criteria B. Motion carried by the following vote: Aye -
Kringle, Gibbs, Wand, Guinn, Henson and Mozena; Nay - None.
DESIGN REVIEW: Application of Richard & Judith Henkel (tabled) for a Certificate of
Appropriateness to remove lead paint, repaint and replace roof with architectural
shingle for property located at 542 W. 11th Street in the W. 11th Street/Revolving Loan
District.
Richard Henkel presented his application to the Commission. Mr. Henkel noted that he
is requesting a $25,000 Historic Preservation Revolving Loan for removal of lead paint,
repainting and roof replacement, window replacement and tuck pointing of the chimney.
He also stated he is working with the Housing and Community Development
Department for lead paint removal. He stated that the asphalt roof will be replaced with
an architectural shingle that has the appearance of shakes. He stated that he has
already begun removal of the lead paint and that he is a certified lead paint abatement
contractor. He stated that he agrees with the Commission's recommendation for
alterations to the side porch and understands that his labor for the lead paint removal
cannot be charged to the Historic Preservation Revolving Loan Fund. He stated that
he was not aware that he needed to attend the previous Historic Preservation
Commission meeting, and that working on the structure before receiving approval for
the revolving loan fund.
Staff Member Wernimont reviewed the staff report, style of shingles (asphalt shake),
the application .and the revolving loan fund process and documentation. The
Commissioners discussed replicating the appearance of the railing for the side porch.
The commissioners also discussed the current rail height of 32" versus the 40" required
by the Housing Code, and means of access to the side porch from the street. The
Commissioners discussed replacement windows. Mr. Henkel said he is installing
$20,000 of high efficiency Iow e-rated double-hung vinyl clad windows. Commissioners
Guinn and Mozena stated they are going on record that we are not in support of using
any of the Revolving Loan Fund money towards vinyl windows. Mr. Henkel stated that
wood windows run about 25% more than the vinyl windows. Chairperson Mozena felt
the revolving loan fund money was being used to subsidize the City's lead abatement
programs, and does not support using any of the revolving loan funds to help the lead
paint abatement efforts. He did support use of the revolving loan fund for paint and
labor, but not the additional cost of lead paint removal. Mr. Henkel stated that the
encapsulate paint would have obliterated all the ornamental detail. He said he wanted
to keep the exterior wood details as visible as possible. Commissioners were in
consensus that the revolving loan fund should not be used for lead paint abatement u p-
charges. The cost of other work merited the full loan amount.

Motion by Guinn, seconded by Gibbs, to approve an award of $25,000 for the roof
replacement with architectural shingles, scrap and paint, cost of side porch railing, but
not for up-charge of lead abatement. Motion carried by the following vote: Aye -
Kringle, Gibbs, Wand, Guinn, Henson and Mozena; Nay - None.
DESIGN REVIEW: Application of Highlands of Dubuque, L.C. for a Certificate of
Appropriateness to remove asphalt/asbestos roof and replace with Carriage House
shingle for property located at 663 W. 11th Street in the W. 11th Street District.
Kathy Bauerly presented the project, noting the two bids for roof replacement. She
explained that she had a roof leak last year. Mrs. Bauerly requested replacement of
the asbestos and asphalt roof with Carriage House shingle. She explained that the roof
would be a red color and the structure will be repainted to a cream color. Staff Member
Wernimont noted that the Historic Preservation Commission approved the roof
replacement on the rear addition in October 2001, and stated that the Commission
would have liked to have seen the entire roof reshingled with a Carriage House shingle.
He explained that this was the applicant's request at this time. He noted the revolving
loan fund committee suggested $9,000 to cover unforeseen costs.
Motion by Guinn, seconded by Wand, to approve the application as submitted, and to
award a Revolving Loan Fund for the amount of $9,500.00. Motion carried by the
following vote: Aye -Kringle, Gibbs, Wand, Guinn, Henson and Mozena; Nay - None.
DESIGN REVIEW: Application of Flint & Julie Drake for a Certificate of
Appropriateness to replace railing and spindles; and build retaining wall for property
located at 1072 W. 3rd Street in the Langworthy District.
Flint Drake presented his application to the Commission. He provided the Commission
a historic blueprint of this home. He explained that the porch railing project will
reproduce the historic railings as drawn on the blueprints. Staff Member Wernimont
noted the applicant has provided a dimensional drawing for the porch railing
replication. He noted there is no railing on the porch now. Commissioners and Mr.
Drake discussed his efforts to relocate the electrical service at the porch.
Motion by Guinn, seconded by Gibbs, to approve the porch railing and spindles as
proposed. Motion carried by the following vote: Aye -Kringle, Gibbs, Wand, Guinn,
Henson and Mozena; Nay- None.
Mr. Drake proceeded to describe an existing retaining wall located on the property. Mr.
Drake reviewed that the original project was for a retaining wall of about three feet. Mr.
Drake noted that the contractor however erected the wall to a height over four feet. and
the retaining wall encroaches into the public right-of-way, which requires City permits
and Historic Preservation Commission approval. The Commissioners also discussed
with Mr. Drake the need for railing for walls over 30". Mr. Drake reviewed the higher
cost of limestone versus the Yersalock product used. Commissioners discussed that
the appearance of the planter is rather abrupt. They discussed having the contractor

rectify the problem he has created for Mr. Drake by creating a series of step aowns
perhaps at 16" (or 2-3 stones) with the visual line following the slope of the driveway.
The Commissioners discussed the reduction of the height will eliminate some or all of
the City permits.
Motion by Wand, seconded by Gibbs, to approve the acceptance of the retaining wall
and planter with a revised design that provides step downs and terraced landscaping.
Motion was approved by the following vote: Aye - Kringle. Gibbs, Wand, Guinn,
Henson and Mozena; Nay - none.
The consensus was that the Historic Preservation Commission does not see design
problems with the structure being located in the public right-of-way.
DESIGN REVIEW: Application of Roberto Montiyc fora Certificate of Appropriateness
to spot tuckpoint entire structure for property located at 334 Jones Street in the
Cathedral/Homeowner Grant District.
Roberto Montiyo stated he has received two bids for spot tuck pointing of $5,100 and
$4,445. He stated he would like the structure to be spot tuck pointed in order to
prevent leaks into the home and give them a chance to get the house back into proper
condition. He has requested the grant of $5,000 to cover this work. Staff Member
Wernimont presented a staff report noting visible cracks and water leaking into the
home. He also noted the Historic Homeowner Grant Review Committee has reviewed
his application and are recommending the applicant receive $5,000 to spot tuck point
the entire structure.
Motion by Guinn, seconded by Wand, to approve the Historic Homeowner Grant as
submitted. Motion carried by the following vote: Aye -Kringle. Gibbs, Wand, Guinn,
Henson and Mozena; Nay - None.
DESIGN REVIEW: Application of David Stuart for a Certificate of Appropriateness to
reroof structure with synthetic slate and replace gutters for property located at 1492
Locust Street in the Jackson Park/Revolving Loan Fund District.
David Stuart presented his application to the Commission. He distributed samples of
the synthetic slate roof in four colors, and reviewed its qualities and installation. Mr.
Stuart described the decorative cresting and ornamental gutters he is trying to recreate
in cedar. Mr. Stuart asked for ability to replace the synthetic slate roof with asphalt if
the new roofing material fails, since it is a new product with a lifetime warranty. He
plans to do a four color pattern with the roofing characteristics of this style of home.
Staff Member Wernimont presented the staff report, noting the actual project cost for
the materials alone exceeds $35,000 with Mr. Stuart to do the work on his own home.
He said Mr. Stuart has asked for two years to complete the roofing project. Staff
Member Wernimont noted that Mr. Stuart was granted a three-year restoration period
for the exterior work on the home in April of 2001. He said the Revolving Loan Fund
Committee has recommended approval.

Motion by Guinn, seconded by Gibbs, to approve Certificate of Appropriateness and to
award a $25,000 Revolving Loan Fund for the work as presented. Motion carried by
the following vote: Aye -Kringle, Gibbs, Wand, Guinn, Henson and Mozena; Nay -
None.
DESIGN REVIEW: Application of Steve Cook for a Certificate of Appropriateness to
wrap wood widows with aluminum for property located at 1338 Main Street in the W.
11th Street District.
Al Ames represented Steve Cook and explained that he is a lead contractor and this
project is a lead paint project through the Housing and Community Development
Department. He explained the proposal is to wrap wood windows and casing with
aluminum on the sides and rear of the structure, but to paint and scrap the front
windows. Staff Member Carstens presented the staff report, noting the use of federal
funds; and therefore, the project requires a 106 review. She noted that the 106 review
states that the windows needed to be scraped and maintained in order to receive
federal funding. The Commission discussed the windows on the north side and how
they are not viewable. The Commission also discussed the spacing between the City
Hall Annex and 1338 Main Street, and noted that the windows are visible.
Commissioners Gibbs and Mozena stated that they are in opposition to wrapping any
wood windows with metal clad.
Motion by Gibbs, seconded by Kringle, to approve the work with the condition it be in
compliance with the 106 Review. Motion carried by the following vote: Aye -Kringle,
Gibbs, Wand, Guinn and Mozena; Nay - Henson.
DESIGN REVIEW: Application of Steve Cook for a Certificate of Appropriateness to
place vinyl siding on a storage shed and rear of main structure located at 525/525 %
Loras Boulevard in the W. 11th Street District.
Al Ames presented the application to the Commission. He noted that the applicant
would like to place vinyl siding on the garage. He noted that the existing garage is
covered with wood siding and lead paint. In addition, he stated that there is a portion of
the main structure that has wood siding with peeling lead paint and that the applicant
would like to side that structure with vinyl siding. Staff Member Carstens presented the
staff report, noting that the 106 Review requested scraping and painting wood siding on
the rear addition. She also noted that the 106 review stated that the Historic
Preservation Commission can make a decision on whether or not they would allow
placing vinyl siding on the garage. The Commission reviewed and decided to vote on
the items separately. The Commission discussed scraping and painting and accessing
the revolving loan fund to help finance some of the exterior improvements.
Motion by Guinn, seconded by Wand, to approve siding the garage with vinyl siding.
Motion was denied by the following vote: Aye - Wand and Henson; Nay - Kringle,
Gibbs, Guinn and Mozena.

Motion by Guinn, seconded by Wand, to approve the scraping and painting of the rear
addition and garage. Motion was approved by the following vote: Aye -Kringle, Gibbs,
Wand, Guinn, Henson and Mozena; Nay- None.
DESIGN REVIEW: Application of Plastic Center Inc. for a Certificate of
Appropriateness to install windows, doors and stairs to patio area located at 200 Main
Street/Julien Inn in the Old Main District.
Ron Heibing presented his application. He noted that they will be opening windows
and doors to provide access to a patio area located at the rear of the structure. He
noted that the area was always intended to be a patio. The Commission discussed the
location of the patio and stairs. Mr. Helbing stated that the steps will have a spindle
railing. He explained how the veranda/patio will relate to the building, parking lot and
3~d Street. Staff Member Wernimont explained this application is basically for
installation of doors and windows and stairs to patio. Staff Member Wernimont noted
the half-turned window shown on the sketch will not be installed. The steps will be
made of wood; the patio will be covered with carpet initially. If successful, will replace
carpet with patio block. Mr. Helbing explained the existing parapet wall is 36" high and
they will place a decorative cable railing to reach the height of 42' as required by Code.
The Commissioners discussed the elevation of the patio and the design of the cabled
railing. Mr. Helbing stated they did not have a design yet. Staff Member Wernimont
noted the dimensions of the windows and doors in the staff report. Mr. Helbing stated
that the half-round window shown on the sketch will not be installed and that the
window will be an aluminum thermal pane. He stated the doors that provide access to
the patio will be two 36"--aluminum doors, seven foot high. The Commissioners noted
that this will be visible from 3~ Street, but not readily visible from anywhere else. The
Commissioners discussed a design for the railing atop the parapet wall should be
wrought iron and reminiscent of the main ornament railings on Main Street of the fleur
de lis motif.
Motion by Wand, seconded by Guinn, to approve the design as described, contingent
on window openings remaining as they existed in the main structure, and the railing
atop the parapet be wall be decorative wrought iron, not cable. Motion was approved
by the following vote: Aye -Gibbs, Wand, Guinn and Mozena; Nay - Kringle and
Henson.
DESIGN REVIEW: Application of Matthew & Birgit Morey for a Certificate of
Appropriateness to add an addition for property located at 540 Wilbur Street in the W.
11th Street District.
Matthew Morey presented his application. He explained they are trying to replicate the
design and ornamental anchor detail of the east fa(;ade on the north side of the

proposed two-story addition. He stated the addition will house a four-seasons room.
master bedroom, bath and basement on a 20' by 24' foundation. He stated that he and
his stepfather will be doing most of the work, and his uncle will do the plumbing. He
noted that the architect is Haverland. He stated that the structure will be sided with
Kemp plank to closely replicate the existing asbestos siding on the main structure. He
noted that all the windows currently are aluminum and not wood. Staff Member
Wernimont presented the staff report, noting replication of gable roof pitches, anchor
detail, use of materials very compatible to existing ane chart of staff report. The
Commissioners discussed the second floor windows on the addition will be higher due
to roof lines. The commissioners asked about the use of poured concrete versus
Dubuque stone on the foundation. Mr. Morey indicated the foundation won't be very
visible from Wilbur Street. Mr. Morey explained the first story will have one window
centered under two second story windows (not two on the first story of addition as
shown).' He noted the porch will have two decorative columns. Mr. Morey explained he
has removed the grills from the windows, which have an appearance of mutton bars.
The Commissioner suggested following design guidelines for the use of shutters: 1)
Either eliminate all, or 2) make proportionate to windows so that shutters appear
functional. Commissioners also suggested consistencies in windows and designs be
used.
Motion by Wand, seconded by Guinn, to approve the design as presented with
revisions to windows, to use single double hung instead of pairs, and to use a stone
fa(;ade or colored concrete to blend with Dubuque stone foundation. Motion was
approved by the following vote: Aye -Kdngle. Wand, Guinn, Henson and Mozena; Nay
-Gibbs.
DESIGN REVIEW: Application of Anderson Design Center/Bluff Street Neighborhood
Association for a Certificate of Appropriateness to install period lighting and street trees
from 1st -~ 3rd Street Block of Bluff Street in the Cathedral District.
Jerry Anderson presented the application, noting installation of trees and period
lighting. He stated that the lighting will be the same as the lighting that is located in the
Cable Car Square area. He noted that the spacing will be very similar with the
exception of locating light posts in front of the Cathedral. Mr. Anderson a rendering of
the street with a view from 3rd Street towards Highway 20/Dodge Street. Staff Member
Carstens presented a staff report, noting that the lighting will be same as what is
located in Cable Car Square. She noted that the application meets the streetscape and
landscape guidelines that were recently adopted. Commissioner Henson questioned
whether or not the lighting would shine into resident's windows located on the second
stories. Staff Member Carstens noted that the lights are designed to focus light toward
the street and not upward. The Commission discussed whether trees would remain.
Mr. Anderson indicated that some of the mature trees may be removed for new trees.
The Commission indicated that they would want the mature trees to remain.

carried by the following vote: Aye - Gibbs, Wand Guinn and Henson: Nay - None;
Abstain - Kringle.
DESIGN REVIEW: Application of Dubuque Bank & Trust for a Demolition Permit to
demolish the structure located at 1300-1322 Iowa Street located in the Downtown
Neighborhood District.
Nelson Klavitter presented the application noting that they are rehabbing the Walsh
Stores. He noted that the building on 13t~ and Iowa (True Value) will be demolished to
meet parking demands for the newly rehabbed Walsh Store. Mr. Klavitter noted the
Walsh Store is in the process of being listed on the National Register of Historic
Places. Staff Member Carstens presented the staff report. She referred to the Iowa
Site Inventory Form completed by Associate Planner Para Myhre for the Economic
Development Department. The report stated that the structure has no historical
significance. She referred to the history of the building and outlined the demolition
district permit process. The Commission requested that if anything was salvageable
from the building, they would like to see it saved. Mr. Klavitter stated that they have not
identified any salvageable building materials.
Motion by Henson, seconded by Kringle, to recommend the City Council approve
demolition of the Iowa Street True Value located at 1330-1322 Iowa Street. Motion
carried by the following vote: Aye-Kringle, Gibbs, Wand, Guinn, Henson and Mozena;
Nay - None.
Chairperson Mozena asked about the parking lot standards. Mr. Klavitter stated that
the parking lot standards wil be similar to the ones located at the Dubuque Bank and
Trust building across Central Avenue. He stated that they are currently looking into
historical lighting for the parking lot.
DESIGN REVIEW: Application of Dubuque Bank & Trust for a Demolition Permit to
demolish the structure located at 45 W. 13th Street located in the Downtown
Neighborhood District.
Staff Member Carstens presented the staff report, noting the building is older than the
Iowa True Value building. She described the modifications the building has had over
time. and noted that there are other examples located in Dubuque. She noted that the
property was evaluated by the Kriviskey survey, and it was not identified to be
incorporated into the Jackson Park Historic District. She referred to Pam Myhre's Iowa
Site Inventory Form for the structure, and that it did not identify the structure as being
historically significant. Mr. Klavitter noted that utilities will be buried underground, and
that they will asked to vacate the alley between the Walsh Stores and the parking lot.
The Commission stated that they do not like losing buildings; however, the significant
rehabbing of the larger Walsh Store buildings overshadow these relatively two small
buildings.

Motion by Wand, seconded by Henson, to recommend the City Council approve
demolition based on no economic return and the renovation of the larger Walsh Store
buildings and a friendly amendment to have the building materials salvaged. Motion
was approved by the following vote: Aye -Kringle, Gibbs, Wand, Guinn, Henson and
Mozena; Nay - None.
ITEMS FROM COMMISSION: The Commission briefly discussed the scholarships for the
forum 2002 National Preservation Conference located in San Antonio, Texas. The
Commission directed staff to file an application for the Histodc Preservation Commission to
the State Historic Preservation Office.
The Commission referred to a memo regarding hiring Jim Jacobsen to form the Phase III
survey. The Commission directed staff to include the warehouse district to the downtown
demolition district because of the current survey. The Commission briefly discussed the
proclamation for Historic Preservation Week.
The Commission reviewed the memo regarding tax rebates for the downtown area. Staff
Member Carstens reported that the City Council approve the tax rebates unanimously.
The Commission reviewed the letter submitted to John Richardson regarding demolition by
neglect for his property located on Highland Place. Staff Member Wernimont briefly gave
a history of the demolition by neglect process. The Commission referred to a letter
included in the packet that described the proposed changes to the architectural guidelines
for historic structures.
Chairperson Mozena discussed the possibility of having the Commission tour the
Preservation Station located in Burlington, Iowa. He requested that staff send him
information about the Preservation Station and the dates for the tour.
