Duggan and Members of the City Council June 7, 2002 Claim Against the City By Marissa Schultz Date of Claim Date of Loss 05/29/02 04/15/02 Nature of Claim Vehicle Damage This is a claim in which the claimant states that as she was stopped at the intersection of 17th and Central, a portable stop sign was blown by the wind and struck the driver's door and mirror of her vehicle. According to the report of John Klostermann, a power outage occurred on April 15, 2002 which affected traffic signals in the downtown area. Portable stop signs were set up at essential intersections, however, due to the number of signs placed in a very short period, not all of the signs received the proper sandbagging required for this type of installation. It is therefore the recommendation of Mr. Klostermann to approve the claim in the amount of $511.40. The Legal Department concurs with this recommendation. Ms. Schultz claims damage to her vehicle when the wind blew over a portable stop sign placed at the intersection of 17th Street and Central Avenue. On April 15th, due to a power outage that affected traffic signals in the downtown area, portable stop signs were set up at essential intersections. Due to the number of signs placed in a very short period, not all signs received the proper sandbagging required for this type of installation. It is my opinion that the damage claimed by Ms. Schultz is consistent with her claim. It is therefore my recommendation to pay the claim as filed.
