Nature of Claim
Vehicle Damage
This is a claim in which the claimant states that as she was driving on Kaufmann Avenue
during the Manhole Replacement Project, she was "waved through" an area of the street
that was being worked on, and in the process, hit the curb and dented the back passenger
side of her vehicle.
According to the report of Mike Koch, Public Works Director, this claim relates to the 2001
(FY2002) Asphalt Paving Project that is being done by Portzen Construction, Inc. The
contract called for the standard form of contracts and bonds with the City, which require
the contractor to hold the City harmless from any claims for damage resulting from the
work.
It is therefore the recommendation of Mr. Koch that the claim be forwarded to Portzen
Construction, Inc. for further consideration. The Legal Department concurs with this
recommendation.

Claim against the City of Dubuque by Cindy Frommelt
This claim relates to the 2001 Asphalt Paving Project (FY2002) that is being
done by Portzen Construction, Inc. The contract called for the standard form of
contracts and bonds with the City, which require the contractor to hold the City
harmless from any claims of damage resulting from the work.
Therefore, it is the recommendation of the City Engineering Division that this
claim for damages be forwarded to Portzen Construction, Inc. for further
consideration/processing.
