Tobacco Compliance - Cops in Shops
Police Chief Kim Wadding is recommending the authorization of a 28E Agreement
between the City of Dubuque and the Iowa Alcoholic Beverages Division, which will
allow for the continuation of the Cops in Shops community partnership program
between local retailers and law enforcement.
In concert With Iowa's tobacco compliance initiative sponsored by the Iowa Alcoholic
Division (ABD), Cops in Shops is a statewide program designed to partner with local
tobacco retail businesses to combat tobacco purchases by underage youth. The
program allows off-duty police officers, funded by ABD, to be placed in area businesses
posing as customers to observe illegal cigarette sales from underage youth or adults
purchasing for underage youth.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION:
In concert with Iowa's tobacco compliance initiative sponsored by the Iowa Alcoholic
Division (ABD), Cops in Shops is a statewide program designed to partner with local
tobacco retail businesses to combat tobacco purchases by underage youth. The
program allows off-duty police officers, funded by ABD, to be placed in area businesses
posing as customers to observe illegal cigarette sales from underage youth or adults
purchasing for. underage youth.
BACKGROUND:
Cops in Shops is a community partnership between local retailers and law enfomement,
designed to deter underage youth from attempting to purchase cigarettes and adults
who purchase cigarettes for underage youth. Key components of the program include:
o Focuses on underage persons and adults purchasing cigarettes for underage youth
o Creates another deterrent to youth from trying to purchase/obtain cigarettes
o Is a community effort, private business working with law enforcement to tackle the problem together
o Creates ongoing awareness to underage youth as well as business employees to ensure that all
cigarette sales are appropriate
o Serves to confiscate the use of false identification used to make cigarette purchases
DISCUSSION:
Officer Steve Eastvedt has had a number of discussions with local retailers regarding
what can be done to build awareness and heighten employee focus on preventing
underage tobacco sales. The intent of the Cops in Shops is to build cooperation and
corroboration between the retailer and law enforcement by highlighting the concern and
working comprehensively to prevent underage cigarette sales.
Again this year the Iowa Alcoholic Beverages Division has asked us to participate in the
Cops in Shops program. The Iowa Alcoholic Beverages Division has authorized $1,500
to be paid to the police department for providing 30 hours of work in an ABD authorized
Cops in Shops Program.
RECOMMENDATION:
Cops in Shops promote positive partnering between law enforcement and retailers in
promoting appropriate cigarette sales. The program aids retailers in highlighting the
concern with the public as well as store employees. The recommendation would be to
continue to promote and offer the program to retailers especially to those suffering from
violations of underage cigarette sales.
ACTION REQUESTED:
Our request is to continue working jointly with retailers through the Cops in Shops
initiative by authorizing the enclosed 28E agreement between the police department
and the Iowa Alcoholic Beverages Division.

13.17, amend the 28E Agreement for Tobacco Enforcement between the parties. The
parties agree to the following addendum:
The 28E Agreement for Tobacco Enforcement, SECTION 5,
RESPONSIBILITIES OF THE PARTIES, is amended to add the
following new subsection:
ABD Developed Cops in Shops Program. The Department
agrees to participate with ABD in an ABD developed and
approved Cops in Shops program.
The 28E Agreement for Tobacco Enforcement, SECTION 6, PAYMENT
TO DEPARTMENT, is amended to add the following new subsection:
6.1 (a)
Method of Payment for Cops in Shop~. In consideration for
providing the services set forth in section 5.1.5, the Department
shall be paid ,,'~ ~ for providing ~ hours of work in
an ABD authorized Cops in Shops program. To qualify for
participation in the Cops in Shops p,rogram, the Department
must have completed the compliance checks contracted for in
the current 28E Agreement on or before June 1, 2002. No
payment w'fll be authorized for a Cops in Shops program
without prior approval of the ABD.
IN WITNESS WHEREOF, in consideration of the mutual covenants set forth
above and for other good and valuable 'consideration, the receipt, adequacy and legal
sufficiency of which are hereby acknowledged, the parties have entered into the
Addendum and have caused .their duly authorized representatives to execute the
Addendum.
