Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the lot split facilitated the sale of the
existing house to a family member and noted access to the property would remain the
same.
Staff reviewed the staff report, noting surrounding zoning, land use, and access to the
property. Staff reviewed that any future home built on Lot 2 will require review by the Fire
Department to insure adequate access for emergency vehicles. Staff noted a Special
Exception will also be necessary to allow a house to be constructed more than 50 feet from
the public street.
There were no public comments.
The Zoning Advisory Commission discussed the request, and found it appropriate.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request to waive the lot frontage requirement for Lot 1.
A simple majority vote is needed for the City Council to approve the request.

SUBJECT: Plat of Survey of D & E Rainbow Acres
INTRODUCTION
Ms. Sarah L. Zenner is seeking approval for a lot split that will create a substandard lot
that has no frontage on a public or private street. The subject property is zoned AG
Agricultural district and is legally non-conforming because there is a single-family home
on the lot that is not used as an accessory to an agricultural use. Therefore, Article 4 of
the Unified Development Code requires that residential non-conformities follow the bulk
standards established in the R-2A Two-Family Residential zoning district.
DISCUSSION
The R-2A district requires that each new lot maintain a minimum of 25 feet of frontage
on a public or private street. The proposed plat splits an approximately 14-acre lot
placing the residence on a 2.6-acre lot with no frontage, leaving the balance of the
property undeveloped save for a cell-tower located in the northwest corner of the lot.
The residence is approximately 800 feet from the front property line and is accessed
from an existing driveway to 32nd Street.
Any future development of Lot 2 will require that the Zoning Board of Adjustment
approve a Special Exception permitting a house to be built in excess of 50 feet from the
frontage and Fire Department approval for access, hydrant and turn-around issues.
RECOMMENDATION
Staff recommends the Zoning Advisory Commission review the submitted Plat of Survey
of D & E Rainbow Acres and recommend approval subject to waiving lot frontage for Lot
1.

RESOLUTION APPROVING THE PLAT OF SURVEY OF D & E RAINBOW ACRES IN
THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Plat of Survey of D & E Rainbow
Acres in the City of Dubuque, Iowa; and
Whereas, said Plat of Survey provides 0 feet and 37.6 feet of frontage for Lot 1 and Lot
2 respectively on a public or approved private street, where 25 feet of street frontage is
required by Section 5-4.7 in accordance with Section 4-7.c. of Title 16 of the City of
Dubuque Code of Ordinances; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find that
it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 5-4.7 of Title 16 of the City of Dubuque Code of Ordinances,
Unified Development Code, is waived to allow 0 feet of frontage on a public street or an
approved private street for Lot 1.
Section 2. That the Plat of Survey is hereby approved and the Mayor and City Clerk are
hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa upon
said Plat of Survey.
