City Engineer Gus Psihoyos is recommending acceptance of the construction contract
for Phase II of the 30 Inch Force Main Relocation Project from 11th Street to 12th Street,
as completed by Top Grade Excavating, Inc. in the final contract amount of
$355,517.76, which is a 4.9% increase from the original contract amount of$338,888
due to an increase in 30 inch fittings used to avoid a gas main that was deeper than
anticipated. Additionally, potentially contaminated soils were stockpiled and tested.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for the
Phase 11 of the 30 inch Force Main Relocation Project from 11 th Street to 12th Street.
BACKGROUND
Phase II of the 30 inch Force Main Relocation Project from 11th Street to 12th Street
extended the pipe installed under the phase I contract, from the northeast corner of the
intersection of 11th Street and Elm Street, to the cul-de-sac at the east end of 12th
Street. The project consisted of; 458 LF of 30 inch DIP, 68 LF of 42 inch bored and
jacked steel casing and an air release structure.
There is only one remaining phase of the 30 inch Force Main Relocation Project, from
7th Street to 12th Street, around the former Public Works Garage and Alliant Energy
Sites. Phase III is the section of force main on Washington Street, from 7th Street to 9th
Street. This section is planned to be completed in conjunction with the reconstruction of
Washington Street from 7th to 9th Streets. Phase III would also include the tie-in, at 12th
Street and 7th street, and the abandonment of the existing force main through the old
Public Works Garage site and the Alliant Energy Site. Completing phase III will
complete the re-routing project and will be constructed as part of the street project.
FY2017 budget allocated $640,683.88, for constructing Phase II and Phase III of the 30
inch Force Main Relocation Project.
DISCUSSION
Phase 11 of the 30 Inch Force Main Relocation Project from 11 th Street to 12th Street was
completed by Top Grade Excavating, Inc., of Farley, Iowa, in the final contract amount
of $355,517.76 which is 4.9% increase from the original contract amount of
$338,888.00. The increase was due to an increase in 30 inch fittings, used to avoid a
gas main that was deeper than anticipated. Also, additional potentially contaminated
soils were stockpiled and tested. This project realized a savings, along with the Jule
Project by disposing of the material as fill for the Jule site. The EPA approved the use
of this material based on testing results.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize the payment
of the contract amount of $355,517.76 to Top Grade Excavating, Inc., for Phase II of the
30 inch Force Main Relocation Project from 11th Street to 12th Street.

from 11th Street to 12th Street Project is summarized as follows:

ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the
improvements, and establishing the final contract amount of $355,517.76, and for the
payment of the contract amount to Top Grade Excavating for Phase II of the 30 Inch
Force Main Relocation Project from 11th Street to 12th Street.

ACCEPTING PHASE II OF THE 30 INCH FORCE MAIN RELOCATION PROJECT
FROM 11TH STREET TO 12TH STREET AND AUTHORIZING THE PAYMENT OF THE
CONTRACT AMOUNT TO THE CONTRACTOR
Whereas, the Public Improvement Contract for Phase II of the 30 Inch Force
Main Relocation Project from 11th Street to 12th Street (the Project) has been
completed and the City Engineer has examined the work and filed a certificate stating
that the Project has been completed according to the terms of the Public Improvement
Contract and that the City Engineer recommends that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Relocation of 30" Force Main around Old Public Works Garage fund for the contract
amount of $355,517.76 less any retained percentage provided for therein as provided in
Iowa Code chapter 573, and to pay such retainage only in accordance with the
provisions of Iowa Code chapter 573.

the Public Improvement Contract, and that the total cost of the completed work is
$406,085.44.
