Van Milligen, City Manager SUBJECT: Ordinance Change: Abandoned Buildings Title 6 & 14 DATE: June 19, 2017 Currently the City of Dubuque Ordinance Title 6 and Title 14 definitions of an Abandoned Building do not read the same. Van Milligen, City Manager FROM: Todd Carr, Building Services Manager SUBJECT: Ordinance Change: Abandoned Buildings Title 6 & 14 DATE: 06/14/2017 Introduction: The purpose of this Ordinance Change is to provide a clear and consistent definition of an Abandoned Building in both Title 6 and Title 14 of our City Ordinances to eliminate any inconsistency. Background: Currently our Title 6 and Title 14 definitions of an Abandoned Building do not read the same under the definitions. Conclusion: City staff from Building, Housing, and Legal Department have identified this inconsistency between the two Ordinances, and have made the necessary changes to our Ordinances so that the definition will now be the same in both Ordinances. This will remove any enforcement issues and confusion between the public and private sector on what constitutes an Abandoned building. Action Step: City Staff is respectfully recommending this Ordinance Change be placed on the City Council Agenda as an Action item for them to review and approve. Section 6-4-2 of the City of Dubuque Code of Ordinances is hereby amended to read as follows: 6-4-2: DEFINITIONS: As used in this chapter, the following definitions shall apply: ABANDONED BUILDING: Any building or portion thereof which has stood with an incomplete exterior shell for six (6) months or longer which meets one or more of the following criteria: A. Is unsecured; B. Is unoccupied; or C. Is in violation of the International Property Maintenance Code, International Building Code, or International Fire Code adopted by the city of Dubuque. Section 2. Section 14-4-1 of the City of Dubuque Code of Ordinances is hereby amended to read as follows: 14-4-1: DEFINITIONS: For the purpose of this chapter, certain terms, phrases, words and their derivatives shall be construed as specified in either this chapter or as specified in the building code or the property maintenance code. Where terms are not defined, they shall have their ordinary accepted meanings within the context in which they are used. Unless otherwise expressly stated or unless the context clearly indicates a different intent, the following terms shall, for the purpose of this chapter, have the following meanings: ABANDONED BUILDING: Any building or portion thereof which has stood with an incomplete exterior shell for six (6) months or longer which meets one or more of the following criteria: A. Is unsecured; B. Is unoccupied; or C. Is in violation of the International Property Maintenance Code, International Building Code, or International Fire Code adopted by the city of Dubuque.
