Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
A representative of Linwood Cemetery, the property owner, spoke in favor of the request,
reviewing that the plat facilitates the sale of the former caretaker's home and allows Linwood
Cemetery to continue utilizing the maintenance building. The representative indicated they
have investigated building a new maintenance building on the Linwood property, but the cost
was found to be prohibitive.
Staff reviewed the staff report, noting that the existing maintenance building is a legal non-
conforming use and will remain as such until such time as the property ceases to be owned and
operated by Linwood Cemetery. Staff noted the submitted plat is being reviewed by the Zoning
Advisory Commission as Lot 1, that includes the maintenance building, does not have frontage
on a public street, but is accessed from an alley shown on the Plat.
There were no public comments.
The Zoning Advisory Commission discussed the request, and felt it was appropriate.
Recommendation
By a vote of 6 to 0, with one abstention, the Zoning Advisory Commission recommends that the
City Council approve the request subject to waiving the lot frontage requirement for Lot 1.
A simple majority vote is needed for the City Council to approve the request.

SUBJECT: Plat of Survey of Linwood-Burden Avenue Place No. 2

INTRODUCTION
The submitted Plat of Survey of Linwood-Burden Avenue Place No. 2 subdivides an
existing 44,918 square foot parcel into two lots. The subject property is the caretaker's
house and maintenance building for Linwood Cemetery. Linwood Cemetery is planning
on selling the caretaker's house which would be on Lot 2 and retaining the ownership of
the maintenance building on Lot 1. The Zoning Advisory Commission is reviewing this
plat as Lot 1 does not have frontage on a public or approved private street.
DISCUSSION
The submitted Plat of Survey of Linwood-Burden Avenue Place No. 2 facilitates the sale
of former caretaker's house to a new owner. Linwood Cemetery would retain ownership
of Lot 1 which is the location of their maintenance facility for the cemetery.
Linwood Cemetery investigated the construction of a new maintenance facility on the
grounds of the cemetery, but found it cost prohibitive. The submitted Plat of Survey
requires approval by the Zoning Advisory Commission and City Council as Lot 1, the
site of the maintenance facility would not have frontage on a public or approved private
street.
The maintenance facility for Linwood Cemetery is a legal non-conforming use as it's
located in an R-1 Single-Family Residential Zoning District on a parcel other than that of
the cemetery itself. Maintenance facilities for cemeteries are considered a customary
accessory use of the cemetery if located on the same parcel(s) as the cemetery.
The maintenance building on a separate parcel from the cemetery is considered as a
legal non-conforming use. As such, it can remain for as long as it stands or until its sold
to another party. The R-1 zoning applied to the property would not allow the
maintenance building to be used for an automobile service garage or storage building.
The only use for it would be by Linwood Cemetery as a maintenance building.

The former caretaker's house will be sold to another owner and rehabbed while the
maintenance building on Lot 1 will continue to be owned by Linwood Cemetery. The
existing access to the maintenance facility is through a public alley shown on the plat on
the north side of the building.
RECOMMENDATION
Planning staff recommends the Zoning Advisory Commission review the Plat of Survey
of Linwood-Burden Avenue Place No. 2 and recommend approval of the submitted Plat
of Survey subject to waiving lot frontage requirements for Lot 1.

RESOLUTION APPROVING THE PLAT OF SURVEY OF LINWOOD -BURDEN AVENUE
PLACE NO. 2 IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Plat of Survey of Linwood -
Burden Avenue Place No. 2 in the City of Dubuque, Iowa; and
Whereas, said Plat of Survey provides 0 feet of frontage for Lot 1 on a public or
approved private street, where 50 feet of street frontage is required by Section 11-14 of
Title 15 of the City of Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Plat of Survey places Linwood Cemetery's maintenance building on
Lot 1 and may continue to be used as a maintenance shop only by Linwood Cemetery as a
legal non -conforming use;
Whereas, said Plat of Survey has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find
that it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived to allow 0 feet of frontage on a public
street or an approved private street for Lot 1.
Section 2. That the Linwood Cemetery maintenance shop is a legal non-
conforming use and will remain as such until such time as the property ceases to be owned
and operated by Linwood Cemetery.
Section 3. That the Plat of Survey of Linwood -Burden Avenue No. 2 is hereby
approved and the Mayor and City Clerk are hereby authorized and directed to endorse the
approval of the City of Dubuque, Iowa upon said Plat of Survey.
