The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
Associate Planner Kyle Kritz reviewed the submitted Plat of Survey, noting the location of the
property and that the Zoning Advisory Commission and City Council are required to review and
approve as Lot 2-1 does not have frontage on a public or private street. Planning staff noted
that Dubuque County will be acquiring Lot 1 of 1 for expansion of their Secondary Roads
Department. Lot 2-1 will remain owned by the City of Dubuque.
Planning Staff Member Kritz indicated that staff had no objection to the submitted Plat of
Survey, and recommended waiving of the lot frontage for Lot 2-1 as the parcel could still be
developed in the future as the City of Dubuque also owns the adjacent property to the west and
north sides of the parcel.
There were no public comments.
The Zoning Advisory Commission discussed the request, and found it to be appropriate.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve
the request, subject to waiving the lot frontage requirement for Lot 2 of 1.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted Plat of Survey of Lot 1 of 1 and Lot 2 of 1 of Dubuque Industrial Center
West 2nd Addition subdivides an existing parcel of land located in the Dubuque Industrial
Center West. This property is located along Seippel Road south of its intersection with
Chavenelle Road. The parcel is located immediately south of a detention pond serving
the Dubuque Industrial Center West.
DISCUSSION
The submitted Plat of Survey of Lot 1 of 1 and Lot 2 of 1 of the Dubuque Industrial
Center West 2nd Addition subdivides an existing parcel of land 8.434 acres in size into
two parcels. The Zoning Advisory Commission is reviewing the plat as Lot 2 of 1 will
not have any frontage on a public or approved private street.
The subject property is owned by the City of Dubuque and the Plat of Survey facilitates
the sale of Lot 1 of 1 to Dubuque County. Adjacent to Lot 1 of 1 is the Dubuque County
Secondary Roads Department which needs the property for a future expansion.
While Lot 2 of 1 will not have frontage on a public or private street, the City of Dubuque
does own the adjacent Lot C of the Dubuque Industrial Center West. Lot C is the
location of one of the two detention basins serving the Dubuque Industrial Center West.
The City of Dubuque also owns the adjacent property to the west, Lot 1 of Graf Farm
Subdivision No. 2. The City of Dubuque purchased the Graf Farm for future industrial
development. In the future, Lot 2 of 1 may be combined with the adjacent property and
developed as part of a future industrial park utilizing the former Graf Farm property.
Planning staff has no objection to the submitted Plat of Survey and waiving the lot
frontage as Lot 2 of 1, even without frontage, can still be developed in the future as the
City of Dubuque owns the property on the west and north sides of the subject parcel.

Planning staff recommends the Zoning Advisory Commission review the Plat of Survey

for Lot 2 of 1.

RESOLUTION APPROVING THE PLAT OF SURVEY OF LOT 1-1 & LOT 2-1 OF
DUBUQUE INDUSTRIAL CENTER WEST 2ND ADDITION IN THE CITY OF DUBUQUE,

Whereas, the City of Dubuque (City) and Dubuque County, Iowa (County) have
entered into an Offer to Buy and Acceptance (the Agreement), pursuant to which City will
convey 3.88 acres of real property in Dubuque Industrial Center West 2nd Addition to
County; and
Whereas, the Agreement requires that the property be surveyed and platted in
order to be sold; and
Whereas, there has been filed with the City Clerk a Plat of Survey of Lot 1-1 & Lot
2-1 of Dubuque Industrial Center West 2nd Addition in the City of Dubuque, Iowa; and
Whereas, said Plat of Survey provides 0 feet of frontage for Lot 2-1 on a public or
approved private street; and
Whereas, 50 feet of street frontage is required by Section 11-14 of Title 15 of the
City of Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and the City
Council finds that the Plat conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
. Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived to allow 0 feet of frontage for Lot 2-1
on a public street or an approved private street.
Section 2. That the Plat of Survey is hereby approved and the Mayor and City Clerk
are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa
upon said Plat of Survey.

RESOLUTION NO. 255-17
RESOLUTION APPROVING THE PLAT OF SURVEY OF LOT 1-1 & LOT 2-1 OF
DUBUQUE INDUSTRIAL CENTER WEST 2ND ADDITION IN THE CITY OF DUBUQUE,
IOWA
Whereas, the City of Dubuque (City) and Dubuque County, Iowa (County) have
entered into an Offer to Buy and Acceptance (the Agreement), pursuant to which City will
convey 3.88 acres of real property in Dubuque Industrial Center West 2nd Addition to
County; and
Whereas, the Agreement requires that the property be surveyed and platted in
order to be sold; and
Whereas, there has been filed with the City Clerk a Plat of Survey of Lot 1-1 & Lot
2-1 of Dubuque Industrial Center West 2nd Addition in the City of Dubuque, Iowa; and
Whereas, said Plat of Survey provides 0 feet of frontage for Lot 2-1 on a public or
approved private street; and
Whereas, 50 feet of street frontage is required by Section 11-14 of Title 15 of the
City of Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and the City
Council finds that the Plat conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived to allow 0 feet of frontage for Lot 2-1
on a public street or an approved private street.
Section 2. That the Plat of Survey is hereby approved and the Mayor and City Clerk
are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa
upon said Plat of Survey.
