INTRODUCTION
This memo provides information regarding the platting and acceptance of additional right of way
adjacent to the west side of the proposed Rustic Point Estates Subdivision at the intersection of
Derby Grange and JFK Road.
BACKGROUND
Recently, the City of Dubuque approved a preliminary plat for the Rustic Point Estates
Subdivision at the intersection of Derby Grange Road and JFK Road. Last month, the City
annexed an area covering this subdivision. The owners of Rustic Point Estates, Derby Grange
LLC, are planning to begin Phase 1 of this subdivision this fall. During the final design process,
Derby Grange LLC and Jim and Janet Kress agreed that the westerly road of the subdivision
should be centered on the common ownership line between the two owners. This would place
half of the ROW for what is proposed to be Barnwood Lane on Derby Grange LLC property and
half on Jim and Janet Kress property.
DISCUSSION
Derby Grange LLC and Jim and Janet Kress have both agreed to dedicate 25 feet of each of
their properties to create a full 50 foot width right of way for the proposed Barnwood Lane. The
parties have also agreed to dedicate portions of their land to create a full 50 foot right of way for
Rustic Point lane. Please see map attached showing ROW contributions from each owner.
Snyder Land Surveying and Planning, Inc. has prepared an acquisition plat to provide the
additional right of way area for the full right of way streets. The areas being platted will be
dedicated to the public for street and utility purposes.
RECOMMENDATION
I recommend that the City Council approve the Acquisition Plat of Lot A of Lot 2, Lot B of Lot 2,
and Lot C of Lot 2, in Tscharner Place No. 4 in the City of Dubuque, Iowa, which provides
additional right of way for the public streets (Rustic Point Lane, Barnwood Lane, and Derby
Grange Road) in and adjacent to Rustic Point Estates Subdivision by the adoption of the
attached resolution.
ACTION TO BE TAKEN
I respectfully request approval of the Acquisition Plat of Lot A of Lot 2, Lot B of Lot 2, and Lot C
of Lot 2, in Tscharner Place No. 4, in the City of Dubuque, Iowa, and acceptance of the
dedication of said lots for Right of Way and utility purposes, through the adoption of the
enclosed resolution.

APPROVING THE ACQUISITION PLAT OF LOT A OF LOT 2, LOT B OF LOT
2, AND LOT C OF LOT 2, IN TSCHARNER PLACE NO. 4, IN THE CITY OF
DUBUQUE, DUBUQUE COUNTY, IOWA
Whereas, there has been presented to the City Council of the City of
Dubuque, Iowa, an Acquisition Plat dated June 26, 2017 prepared by Schneider
Land Surveying and Planning, Inc., describing Lot A of Lot 2, Lot B of Lot 2, and
Lot C of Lot 2, in Tscharner Place No. 4, in the City of Dubuque, Dubuque
County, Iowa; and
Whereas, said plat conforms to the laws and statutes pertaining thereto;
and
Whereas, upon said plat appears Lot A of Lot 2, Lot B of Lot 2, and Lot C
of Lot 2, together with certain easements for public street and utilities, which
James F. and Janet M. Kress, by said plat have dedicated to the public forever;
and
Whereas, the dedication of said lots as Right of Way is necessary to have
a full 50 foot right of way width for the new streets in Rustic Point Estates
Subdivision.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the plat dated June 26, 2017 prepared by Schneider Land
Surveying and Planning, Inc., relative to the real estate hereinabove described
be and the same is hereby approved, and the Mayor and City Clerk be and they
are hereby authorized and directed to execute said plat and on behalf of the City
of Dubuque, Iowa.
Section 2. That the dedication of Lot A of Lot 2, Lot B of Lot 2, and Lot C
of Lot 2, in Tscharner Place No. 4, in the City of Dubuque, for street Right of Way
purposes, together with the easements for public utilities as they appear on said
Acquisition Plat, be and the same are hereby accepted.
Section 3. That the City Clerk be and is hereby authorized and directed to
file said plat and certified copy of this resolution in the office of the Recorder, in
and for Dubuque County, Iowa.
Section 4. That James F. and Janet M. Kress shall provide, to the City of
Dubuque, within 90 days of plat approval, documentation showing that the
private easements (Document Numbers 2007-18315 and 2009-7714) within said
Lots A, B, and C of Lot 2, have been vacated.
