SUMMARY: City Manager recommending approval of an amendment to
the City of Dubuque Code of Ordinances so that City Code
will mirror the Iowa Code regarding official traffic control
signals which includes a flashing yellow arrow signal, a
steady upraised hand signal, a flashing upraised hand
signal, an upraised hand with countdown signal, and a

Assistant City Attorney Maureen Quann recommends City Council approval of an
amendment to the City of Dubuque Code of Ordinances so that City Code will mirror the
Iowa Code, which includes a flashing yellow arrow signal, a steady upraised hand
signal, a flashing upraised hand signal, an upraised hand with countdown signal, and a
walking person signal.

RE: Official Traffic Control Signals
Attached please find an amendment to the City of Dubuque Code of Ordinances
Section 9-7-321.257, Official Traffic-Control Signal. The result of the amendment is that
the City Code now mirrors the Iowa Code, which includes a flashing yellow arrow signal,
a steady upraised hand signal, a flashing upraised hand signal, an upraised hand with
countdown signal, and a walking person signal.
These amendments also provide an opportunity to further explain the traffic signals
used throughout the City and featured in City Code Section 9-7-321.257. The
Engineering Department determines what signals are best suited to locations using
state, federal and Department of Transportation regulations and the Manual on Uniform
Traffic Control Devices (MUTCD). The Police Department enforces the City Code
Sections that address these traffic signals, and the City Attorney's Office prosecutes
any contested citations issued by the Police Department. Consequently, all three
departments play a role in this proposed amendment. Each traffic control signal
featured in City Code Section 9-7-321.257 is defined below:
Steady Circular Red Light
The MUTCD states:
Vehicular traffic facing a steady circular red signal indication, unless
entering the intersection to make another movement permitted by another
signal indication, shall stop at a clearly marked stop line; but if there is no
stop line, traffic shall stop before entering the crosswalk on the hear side
of the intersection; or if there is no crosswalk, then before entering the
intersection; and shall remain stopped until a signal indication to proceed
is displayed, or as provided below.
Except when a traffic control device is in place prohibiting a turn on red or
a steady red arrow signal indication is displayed, particular vehicular traffic
facing a stead circular red signal indication is permitted to enter the
intersection to turn right, or to turn left from a one-way street into a one-
way street, after stopping. The right to proceed with the turn shall be
subject to the rules applicable after making a stop at the stop sign.
Unless otherwise directed by a pedestrian signal indication or other traffic
control device, pedestrians facing a stead circular read or stead red arrow
signal indication shall not enter the roadway.
Steady circular red signals exist at the intersection of Grandview Avenue and Highway
20.
Steady Circular Yellow Light
The MUTCD states:
Vehicular traffic facing a steady circular yellow signal indication is thereby
warned that the related green movement or the related flashing arrow
movement is being termination or that a steady red signal indication will be
displayed immediately thereafter when vehicular traffic shall not enter the
intersection. The rules set forth concerning vehicular operation under the
movement(s) being terminated shall continue to apply while the steady
circular yellow signal indication is displayed.
Pedestrians facing a steady circular yellow or yellow arrow signal
indication, unless otherwise directed by a pedestrian signal indication or
other traffic control device shall not start to cross the roadway.
Steady circular yellow signals exist at the intersection of Grandview Avenue and
Highway 20.
Steady Circular Green Light
The MUTCD states:
Vehicular traffic facing a circular green signal indication is permitted to
proceed straight through or turn right or left or make a U-turn movement
except as such movement is modified by lane-use signs, turn prohibition
signs, lane markings, roadway design, separate turn signal indications, or
other traffic control devices.

Such vehicular traffic, including vehicles turning right or left or making a U-
turn movement, shall yield the right-of-way to:
a) Pedestrians lawfully within an associated crosswalk, and
b) Other vehicles lawfully within the intersection.
In addition, vehicular traffic turning left or making a U-turn movement to
the left shall yield the right-of-way to other vehicles approaching from the
opposite direction so closely as to constitute an immediate hazard during
the time when such turning vehicle is moving across or within the
intersection.
Pedestrians facing a circular green signal indication, unless otherwise
directed by a pedestrian signal indication or other traffic control device, are
permitted to proceed across the roadway within any marked or unmarked
association crosswalk. The pedestrian shall yield the right-of-way to
vehicles lawfully within the intersection or so close as to create an
immediate hazard at the time that the green signal indication is first
displayed.
Steady green circular signals exist at the intersection of Grandview Avenue and
Highway 20.
Steady Green Arrow
The MUTCD states:
Vehicular traffic facing a green arrow signal indication, displayed alone or
in combination with another signal indication, is permitted to cautiously
enter the intersection only to make the movement indicated by such arrow,
or such other movement as is permitted by other signal indications
displayed at the same time.
Such vehicular traffic, including vehicles turning right or left or making a U-
turn movement, shall yield the right-of-way to:
a) Pedestrians lawfully within an associated crosswalk, and
b) Other vehicles lawfully within the intersection.
Pedestrians facing a green arrow signal indication, unless otherwise
directed by a pedestrian signal indication or other traffic control device,
shall not cross the roadway.

A steady green arrow signal exists in the left most lanes at the intersection of Highway
151 and the Locust Connector.
Flashing Circular Red
The MUTCD states:
Vehicular traffic, on an approach to an intersection, facing a flashing
circular red signal indication shall stop at a clearly marked stop line; but if
there is no stop line, before entering the crosswalk on the near side of the
intersection; or if there is no crosswalk, at the point nearest the
intersecting roadway where the driver has a view of approaching traffic on
the intersecting roadway before entering the intersection. The right to
proceed shall be subject to the rules applicable after making a stop at a
stop sign.
Pedestrian facing any flashing red signal indication at an intersection,
unless otherwise directed by a pedestrian signal indication or other traffic
control device, are permitted to proceed across the roadway within any
marked or unmarked associated crosswalk. Pedestrians shall yield the
right-of way to vehicles lawfully within the intersection at the time that the
flashing red signal indication is first displayed.
A flashing circular red signal exists at 12th and Iowa Streets between 6:00 A.M. and
12:00 P.M. on Saturday Mornings during summer farmer's market and any signalized
intersection that goes into flash mode.
Flashing Circular Yellow
The MUTCD states:
Vehicular traffic, on an approach to an intersection, facing a flashing
circular yellow signal indication is permitted to cautiously enter the
intersection to proceed straight through or turn right or left or make a U-
turn except as such movement is modified by lane-use signs, turn
prohibition signs, lane markings, roadway design, separate turn signal
indications, or other traffic control devices.
Such vehicular traffic, including vehicles turning right or left or making a U-
turn, shall yield the right-of-way to:
a) Pedestrians lawfully within an associated crosswalk, and
b) Other vehicles lawfully within the intersection.

In addition, vehicular traffic turning left or making a U-turn to the left shall

A flashing circular yellow signal exists at advanced warning signs prior to the first
signalized intersection when entering the City.
Flashing Yellow Arrow
The MUTCD states:
Vehicular traffic, on an approach to an intersection, facing a flashing
yellow arrow signal indication, displayed alone or in combination with
another signal indication, is permitted to cautiously enter the intersection
only to make the movement indicated by such arrow, or other such
movement as is permitted by other signal indications displayed at the
same time.
Such vehicular traffic, including vehicles turning right or left or making a U-
turn to the left shall yield the right-of-way to:
a) Pedestrians lawfully within an associated crosswalk, and
b) Other vehicles lawfully within the intersection.
In addition, vehicular traffic turning left or making a U-turn to the left shall
yield the right-of-way to other vehicles approaching from the opposite
direction so closely as to constitute an immediate hazard during the time
when such turning vehicle is moving across or within the intersection.
Pedestrians facing any flashing yellow signal indication at an intersection,
unless otherwise directed by a pedestrian signal indication or other traffic

flashing yellow signal indication is first displayed.
A flashing yellow arrow signal exists at White and 91" Streets.
Don't Walk or Steady Upraised Hand
The MUTCD states:

A steady upraised hand (symbolizing Don't Walk) signal indication means
that a pedestrian shall not enter the roadway in the direction of the signal.
A Don't Walk or steady upraised hand signal exists at Grandview Avenue and Highway
20.
Flashing Upraised Hand
The MUTCD states:
A flashing upraised hand (symbolizing Don't Walk) signal indication means
that a pedestrian shall not start to cross the roadway in the direction of the
signal indication, but that any pedestrian who has already stated to cross
on a steady walking person (symbolizing Walk) signal indication shall
proceed to the far side of the traveled way of the street or highway, unless
only to some other island or pedestrian refuse area.
A flashing upraised hand signal exists at Grandview Avenue and Highway 20.
Walking Person
The MUTCD states:
A flashing walking person (symbolizing Walk) signal indication means that
a pedestrian facing the signal indication is permitted to start to cross the
roadway in the direction of the signal indication, possibly in conflict with
turning vehicles. The pedestrian shall yield the right-of-way to vehicles
lawfully within the intersection at the time that the walking person
(symbolizing walk) signal indication is first shown.
A walking person signal exists at Grandview Avenue and Highway 20.

SIGNALS AND MARKINGS, SECTION 9-7-321.257 OFFICIAL TRAFFIC CONTROL
SIGNALS TO MIRROR THE STATE CODE
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. Section 9-7-321.257 of the City of Dubuque Code of Ordinances is
amended to read as follows:
9-7-321.257: OFFICIAL TRAFFIC -CONTROL SIGNAL:
A. For the purposes of this section "stop at the official traffic -control signal" means
stopping at the first opportunity at either the clearly marked stop line or before entering
the crosswalk or before entering the intersection.
B. Official traffic -control signals consisting of colored lights or colored lighted arrows
shall regulate vehicle and pedestrian traffic in the following manner:
1. A "steady circular red" or "steady red arrow" light means vehicular traffic
shall stop. Vehicular traffic shall remain standing until a signal to proceed is
shown or vehicular traffic, unless prohibited by a sign, may cautiously enter the
intersection to make a right turn from the right lane of traffic or a left turn from a
one-way street to a one-way street from the left lane of traffic on a one-way street
onto the leftmost lane of traffic on a one-way street. Turns made under this
paragraph shall be made in a manner that does not interfere with other vehicular
or pedestrian traffic lawfully using the intersection. Pedestrian traffic facing a
steady circular red light shall not enter the roadway unless the pedestrian can
safely cross the roadway without interfering with any vehicular traffic.
2. A "steady circular yellow" or "steady yellow arrow" light means vehicular
traffic is warned that the related green movement is being terminated and
vehicular traffic shall no longer proceed into the intersection and shall stop. If the
stop cannot be made in safety, a vehicle may be driven cautiously through the
intersection. Pedestrian traffic is warned that there is insufficient time to cross the
intersection and any pedestrian starting to cross the roadway shall yield the right-
of-way to all vehicles.
3. A "steady circular green" light means vehicular traffic may proceed
straight, turn right or turn left through the intersection unless otherwise
specifically prohibited. Vehicular traffic shall yield the right-of-way to other
vehicular and pedestrian traffic lawfully within the intersection.
4. A "steady green arrow" light shown alone or with another official traffic -
control signal means vehicular traffic may cautiously enter the intersection and
proceed in the direction indicated by the arrow. Vehicular traffic shall yield the
right-of-way to other vehicles and pedestrians lawfully within the intersection.
5. A "flashing circular red" light means vehicular traffic shall stop and after
stopping may proceed cautiously through the intersection yielding to all vehicles
not required to stop or yield which are within the intersection or approaching so
closely as to constitute a hazard, but then may proceed.
6. A "flashing yellow" light means vehicular traffic shall proceed through the
intersection or past such signal with caution.
7. A "flashing yellow arrow" light shown alone or with another official traffic -
control signal means vehicular traffic may cautiously enter the intersection and
proceed only in the direction indicated by the arrow. Vehicular traffic shall yield
the right-of-way to other vehicles and pedestrians lawfully within the intersection
and any vehicle on the opposing approach which is approaching so closely as to
constitute an immediate hazard during the time the driver is moving within the
intersection.
8. A "don't walk" or "steady upraised hand" Tight is a pedestrian signal which
means that pedestrian traffic facing the illuminated pedestrian signal shall not
start to cross the roadway in the direction of the pedestrian signal, and
pedestrian traffic in the crossing shall proceed to a safety zone.
9. A "flashing upraised hand" or "upraised hand with countdown" light is a
pedestrian signal which means that pedestrian traffic facing the illuminated
pedestrian signal shall not start to cross the roadway in the direction of the
pedestrian signal, and pedestrian traffic in the crossing shall proceed to a safety
zone. The "upraised hand with countdown" light is a pedestrian signal that also
provides the time remaining for the pedestrian to complete the crossing.
10. A "walk" or "walking person" light is a pedestrian signal which means that
pedestrian traffic facing the illuminated pedestrian signal may proceed to cross
the roadway in the direction of the pedestrian signal and shall be given the right-
of-way by drivers of all vehicles.
