The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant, Mark Gudenkauf, spoke in favor of the request, reviewing the proposed
subdivision will have building lots for 75 homes, a walking path within the development, and
street extensions to the east and west for future residential development. Mr. Gudenkauf
reviewed that sufficient easements will be platted to allow for future extensions of City water and
sanitary sewer service. The pre-annexation agreement with the City has been signed.
Staff reviewed the staff report, reviewing City versus County standards for new residential
subdivisions regarding subdivision streets and storm water management. Planning staff
reviewed the required 40 points of sustainability for new subdivisions, noting that points were
received for narrower street paving, solar oriented lots, a recreational trail, and County storm
water management requirements.
There were no public comments.
The Zoning Advisory Commission discussed the request and felt it was appropriate.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve
the request, subject to waiving street width for Luna Street, Mackenzie Ridge, Lauren Lane,
Alea Lane, Marissa Court, Conner Court and Carriage Court.
A simple majority vote is needed for the City Council to approve the request.

Physical Characteristics: The subject property is located on the south side of Oakland
Farms Road and generally slopes to the northeast. The subject property will be served

Ridge, Lauren Lane, Alea Lane, Marissa Court, Connor Court, and Carriage Court. The
subject preliminary plat is in all other respects compliant with the Unified Development
Code.
Conformance with Comprehensive Plan: This subdivision meets the Comprehensive
Plan Land Use Element Goal 1.2, 1.5, 1.8, 4.3 and 10.2.

Impact of Request on:
Utilities: The proposed Oakland Ridge Estates Subdivision will utilize individual
septic systems for each building lot, and will have shared wells within the
subdivision for water service.
Traffic Patterns: Access to the proposed subdivision will be off Oakland Farms
Road. Based on 2013 IDOT counts, there were 980 average daily trips on Oakland
Farms Road and 2, 330 average daily trips on Military Road.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided there is compliance with the Dubuque County Erosion and Sediment
Control Manual.
Adjacent Properties: Staff anticipates the most noticeable impact to adjacent
properties will be the change to the visual nature of this property with a change
from agricultural to residential housing and an increase in the number of vehicle
trips on the surrounding county roadway system. Staff estimates that when fully
built out with 75 single-family homes, approximately 750 additional vehicle trips per
day will be generated.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted Preliminary Plat of Oakland Ridge Estates is located on
the south side of Oakland Farms Road west of the intersections of Military Road and
Oakland Farms Road. The proposed subdivision will include 75 new single-family
building lots and the construction of six (6) new private streets. The subject subdivision
is jointly reviewed by both the City and County of Dubuque as it is within two miles of
the city of Dubuque's corporate limits. Section 16-11-7(E) of the Unified Development
Code establishes the criteria for review of County subdivisions.
The Preliminary Plat of Oakland Ridge Estates encompasses 99.6 acres. Access to
this proposed subdivision will be from two new private streets off Oakland Farms Road
to be called Luna Street and McKenzie Ridge. The applicant's engineer has provided
documentation that the proposed intersection of Luna Street with Oakland Farms Road
will comply with SUDAS standards for site visibility. Oakland Farms Road will need to
be reconstructed before Mackenzie Ridge can be connected.
The proposed private streets within Oakland Ridge Estates will be built with 22-foot of
paving with 66-foot of right-of-way easement for the main streets, and 50-foot of right-
of-way easement for the cul-de-sac streets. The County has recently amended their
subdivision code to allow the narrower right-of-way easements for short cul-de-sac
streets.

The submitted Preliminary Plat of Oakland Ridge Estates also provides two stub streets
to adjacent properties on the east and west sides of the subdivision. The developers
hope to be able to continue the subdivision in the future onto adjacent property.
The Planning Services Department has reviewed the proposed preliminary plat for
compliance with City Sustainability requirements. The submitted Preliminary Plat of
Oakland Ridge Estates proposes the following sustainability subdivision development
tools.
Proposed Sustainable Development Tools:
1) Solar lots (1/3 of total lots) = 10 points
2) Recreational trail = 15 points
3) 22-foot wide paving for streets = 5 points
4) County storm water management= 10 points
TOTAL: 40 points
Planning staff is willing to provide 10 points for compliance with the County Ordinance
on storm water management as it requires that the first 1.25 inches of rain be infiltrated
on the site. This requirement is more stringent that current City requirements.
The Unified Development Code Section 16-11-7(E), Fringe Area Development
Standards, requires that the developer of a County subdivision sign a pre-annexation
agreement with the City. This agreement stipulates that when the City proposes to
annex the property, the existing and/or future property owner(s) will agree to the
annexation. In return, the City portion of the property taxes will be discounted on a
sliding scale for 10 years. The developers have signed the pre-annexation agreement
and it has been sent to the City Council for their concurrence.
Section 16-11-7(E) also requires that the proposed subdivision also provides sufficient
easements to extend water and sewer into the subdivision without the need of acquiring
individual easements from each property owner in the future. The submitted
Preliminary Plat depicts the necessary easements. These easements will be reviewed
again as part of each Final Plat for subsequent phases of the subdivision.
Planning staff recommends the Zoning Advisory Commission approve the submitted
Preliminary Plat of Oakland Ridge Estates subject to waiving the street paving width
standard for Luna Street, Mackenzie Ridge, Lauren Lane, Alea Lane, Marissa Court,
Connor Court, and Carriage Lane.
