INTRODUCTION
The purpose of this memo is to seek authorization to submit a Clean Water State Revolving
Fund (SRF) Sponsorship Project application to the Iowa Department of Natural Resources
to secure funding for the Eagle Point Park Environmental Restoration Project. Enclosed are
the application, the project budget, project area maps, and a resolution.
BACKGROUND
In 2009, legislation was passed in Iowa that allows water utilities that issue debt through the
Clean Water SRF Program to sponsor and help finance other water quality improvement
projects within or outside its service limits. This funding mechanism, called Water Resource
Restoration Sponsored Projects, provides cities, counties, local watershed organizations,
watershed management authorities, county conservation boards, and soil and water
conservation districts a funding source to construct improvements throughout a watershed
that keep sediment, nutrients, chemicals and other pollutants out of streams and lakes.
Repayment of a standard Clean Water SRF loan includes the repayment of the original loan
amount, the principal, and the cost to finance the loan, interest and fees. On a Clean Water
SRF loan with a sponsored project, the financing costs are reduced by the amount of the
cost of the sponsored project improvements. Figure 1 shows a comparison between a
standard Clean Water SRF loan and a Clean Water SRF loan with a sponsorship project. As
shown, the total cost to the utility (the total of loan repayments) remains unchanged as the
cost of funding for the sponsorship project is offset by a reduction in loan financing costs.
Two water quality projects are completed for the price of one.
In 2016, the City of Dubuque's Kerper Boulevard Sanitary Sewer Reconstruction Project
qualified for a Clean Water SRF loan in the amount of $3,200,000. To take advantage of the
sponsorship project program, an application must be submitted by September 1, 2017
outlining the specifics of the Clean Water SRF Sponsorship Project, in this case the Eagle
Point Park Environmental Restoration Project.

DISCUSSION
Eagle Point Park Environmental Restoration Management Plan, approved by the City
Council in January 2017, outlines the unique nature and value of Eagle Point Park and the
importance of making the site more resilient. The report focuses on the restoration of native
plants to improve the health of the ecosystem and enhance ecological functions such as
water purification, groundwater recharge and pollinator support. Another major area of focus
is the reduction of stormwater runoff and using stormwater best practices to reduce soil
erosion improve water quality. This project would implement best practices outlined in the
Eagle Point Park Environmental Restoration Management Plan such as:
• Installation of Rain Gardens
• Stabilizing Headcuts
• Retrofitting Existing Basins
• Adding Native Plants and Prairie as Riparian Buffers
• Re-route Runoff to Existing Basin
• Creating an Infiltration Area
The City of Dubuque would pursue funding for this project through the Clean Water SRF
Sponsorship Project program which typically allows funding for approximately $100,000 for
every $1 ,000,000 on the original loan. Therefore, the Kerper Boulevard Sanitary Sewer

Reconstruction could sponsor the $320,000 needed to construct the improvements
associated with the Eagle Point Park Environmental Restoration Project. For the application
to be considered, it must include a resolution approving the submission of an application.
RECOMMENDATION
We recommend that the City submit an application to the Clean Water SRF Sponsorship
Project program in order to provide $320,000 in funding for the Eagle Point Park
Environmental Restoration Project.
BUDGETIMPACT
If the application is approved by the Iowa Department of Natural Resources, it would have
no impact on the City budget. The City of Dubuque would receive an interest rate reduction
on the Kerper Boulevard Sanitary Sewer Reconstruction loan that would offset the cost of
funding the Eagle Point Park Environmental Restoration Project.
ACTION TO BE TAKEN
We respectfully request the City Council adopt the resolution authorizing the City Manager
or his designee to submit a Clean Water SRF Sponsorship application to sponsor and fund
the Eagle Point Park Environmental Restoration Project.

AUTHORIZATION TO SUBMIT A CLEAN WATER SRF SPONSORSHIP PROGRAM
APPLICATION TO PROVIDE FUNDING FOR THE EAGLE POINT PARK
ENVIRONMENTAL RESTORATION PROJECT
Whereas, legislation was passed during the 2009 Iowa General Assembly session to
create the Clean Water State Revolving Fund Sponsorship Project program, which is
designed to provide communities with the ability to fund two water projects for the cost of
one; and
Whereas, the City of Dubuque submitted an Intended Use Plan to the Clean Water
State Revolving Fund in the amount of $3,200,000 for the Kerper Boulevard Sanitary
Sewer Reconstruction that was approved by the Department of Natural Resources and
the Iowa Finance Authority, which qualifies the City to apply for the Clean Water SRF
Sponsorship Project program; and
Whereas, the Eagle Point Park Environmental Restoration Project will include the
construction of $320,000 in improvements to help improve water quality and reduce runoff
in the watershed; and
Whereas, the City of Dubuque has prepared an application seeking $320,000 for the
Eagle Point Park Environmental Restoration Project through the Clean Water State
Revolving Fund Sponsorship Project program; and
Whereas, if approved, the City would receive an interest rate reduction of $320,000 so
that the citizens of Dubuque would not pay any more than they would for the approved
loan for the Kerper Boulevard Sanitary Sewer Reconstruction Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
That the City Manager or his designee is hereby authorized to submit a Clean Water
SRF Sponsorship application to sponsor and fund the Eagle Point Park Environmental
Restoration Project.

The City of Dubuque has prepared an Environmental Restoration Management Plan (ERMP)
for Eagle Point Park, a 164 -acre a historic community/regional Dark located atop limestone
bluffs on the MississiDDi River on the northeast side of the city of Dubuque. The 2017 ERMP
provides guidance when undertaking water quality improvements and introducing sustainable
best practices for manaaina stormwater and soil erosion runoff that enters the Bee Branch
Creek Watershed, which in turn flows into the MississiDDi River. The ERMP divides the park
into four Management Units to avoid cultural resources when installing green infrastructure
improvements. The SRF Sponsored Proiect involves design, engineering, permittina and
construction of recommended best practices for manaaina stormwater to improve water
quality. The SRF Project will use low impact development and green infrastructure BMPs
including rain gardens, infiltration basins, permeable surfaces, soil auality restoration,
conversion to native vegetation, and runoff diverters, stabilizing headcuts, and retrofitting
existing stormwater basins. In combination, these green infrastructure BMPs provide an
effective strategy for source reduction of runoff, increasing infiltration of runoff into the soil,
reducing volume and rate of runoff reaching downstream areas, and improving water auality.

The City of Dubuque (Applicant) hereby assures that it has authority under applicable State and
local law to comply with Section 213 of the Uniform Relocation Assistance and Real Property
Acquisition Policies Act of 1970, Public Law 91-646, 84 Stat. 1894 (42 U.S.C. 4601) as
amended by the Surface Transportation and Uniform Relocation Assistance Act of 1987, Title IV
of Public Law 100-17, 101 Stat. 246-256 (42 U.S.C. 4601 note) and 49 CFR 1.48(cc); and
certifies, assures and agrees that, notwithstanding any other provision set forth in the
application.
1. For projects resulting in the displacement of any person:
a. It will adequately inform the public of the relocation payments and services which will be
available as set forth in Subparts A, C, D and E of 49 CFR 24.
b. It will provide fair and reasonable relocation payments to displaced persons as
required by Subparts D and E of 49 CFR 24.
c. It will provide a relocation assistance program for displaced persons offering
services described in Subpart C of 49 CFR 24.
d. Comparable replacement dwellings will be available pursuant to Subpart F of
49 CFR 24, or provided if necessary, a reasonable period in advance of the time any person is
displaced.
e. In acquiring real property, it will provide at least 90 days written notice to each
lawful occupant of real property acquired, stating the date such occupant is required to move
from a dwelling or to move his business or farm operation.
2. For projects resulting in the acquisition of real property:
a. It will fully comply with the requirements of Subpart B of 49 CFR 24.
b. It will adequately inform the public of the acquisition policies, requirements and
payments which apply to the project.
c. It will make every effort to acquire real property expeditiously through negotiation.
d. Before the initiation of negotiations it will have the real property appraised and give the owner
or his representative an opportunity to accompany the appraiser during inspection of the
property, except as provided in 49 CFR 24.102(c)(2).
e. Before the initiation of negotiations it will establish an amount which it believes to be just
compensation for the real property, and make a prompt offer to acquire the property for that
amount; and at the same time it will provide the owner a written statement of the basis for such
amount in accordance with 49 CFR 24.102.
f. Before requiring any owner to surrender possession of real property it will pay the agreed
purchase price; or deposit with the court, for the benefit of the owner, an amount not less than
the approved appraisal of the fair market value of the property; or pay the amount of the award
of compensation in a condemnation proceeding for the property.
g. If interest in real property is to be acquired by exercise of the power of eminent domain, it will
institute formal condemnation proceedings and not intentionally make it necessary for an owner
to institute legal proceedings to prove the fact of the taking of this real property; and
h. It will offer to acquire the entire property, if acquisition of only part of a property would leave
its owner with an uneconomic remnant.
