City Engineer Gus Psihoyos is recommending acceptance of the public improvement
construction contract for the Heritage Trail Head Parking Lot Project, as completed by
Temperley Excavating, Inc., in the final contract amount of$51,758.46, which is a
10.9% decrease from the original contract amount of$58,062.50.
1 concur with the recommendation and respectfully request Mayor and City Council
approval.

RE: Heritage Trail Head Parking Lot Project
INTRODUCTION
The enclosed resolution provides for the acceptance of the public improvement
construction contract for the Heritage Trail Head Parking Lot Project.
BACKGROUND
DMATS has re-programmed $1 million set aside in Transportation Enhancement (TE)
funds for the Southwest Arterial recreational trail to other local projects, such as the
Lower Bee Branch: Overlook at 16th Street Detention Basin, Upper Bee Branch: MRT
Route Trailhead parking lot at 22nd and Prince Streets, and this project. The TE funds
are part of the DMATS allocations from prior federal transportation bills.
The project is a County/City partnership. Dubuque County has excess right-of-way on
the north side of S. John Deere Road near the intersection of US 52 and IA 32 (NW
Arterial) that provides a good location for a joint trail head.
The project site is located in close proximity to the Dubuque County Heritage Trail, the
City of Dubuque's Heritage Trail Riverfront System, and Iowa 32 Hike/Bike Trail. This
project involved construction of an 11-stall asphalt parking lot. This lot will provide for a
place to park when accessing the nearby trails.
DISCUSSION
Heritage Trail Head Parking Lot Project was completed by Temperley Excavating, Inc.
of East Dubuque, Illinois in the final contract amount of $51,758.46 which is a 10.9%
decrease from the original contract amount of$58,062.50.
BUDGETIMPACT
The project cost summary for the Heritage Trail Head Parking Lot Project is as follows:

The local funds from the Trail and Complete Streets CIP and from Dubuque County

ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution to accept the
improvements and to authorize the payment of the contract amount of $51,758.46 to
Temperley Excavating, Inc. for the Heritage Trail Head Parking Lot Project.

RESOLUTION NO. 302-17
ACCEPTING THE HERITAGE TRAIL HEAD PARKING LOT PROJECT AND
AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the Heritage Trail Head Parking Lot
Project (the Project) has been completed and the City Engineer has examined the work
and filed a certificate stating that the Project has been completed according to the terms
of the Public Improvement Contract and that the City Engineer recommends that the
Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project is
hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from the
Trails/Complete Streets appropriations for the contract amount of $51,758.46, less any
retained percentage provided for therein as provided in Iowa Code chapter 573, and to
pay such retainage only in accordance with the provisions of Iowa Code chapter 573.

The undersigned City Engineer of the City of Dubuque, Iowa, hereby certifies that
he has inspected the Heritage Trail Head Parking Lot Project, that the Project has been
performed in compliance with the terms of the Public Improvement Contract, and that
the total cost of the completed work is $62,110.15
