Planning Services Manager Laura Carstens is recommending approval of the final plat
of Oakland Ridge Estates, which is located in Dubuque County but within two miles of
the City of Dubuque corporate limits, subject to allowing 22 -foot paving width for
Mackenzie Ridge, Libby Lane, Morgan Creek Drive, Lea Lane and Maci Court, and
waiving Sections 11-20 Water Supply, 22-21 Sanitary Sewer, 11-23 Obligation to Install
Improvements, and 11-24 Improvement Guarantees.
The submitted Final Plat does provide sufficient easements to provide for the future
extension of City water and sanitary sewer to the individual building lots.

INTRODUCTION
This memorandum transmits the Final Plat of Oakland Ridge Estates, a resolution, and
related materials for City Council review and approval. The submitted Final Plat of
Oakland Ridge Estates is a new subdivision located on the south side of Oakland
Farms Road near its intersection with Old Military Road in Dubuque County. The City
and County of Dubuque are jointly reviewing this Final Plat, as it is within two miles of
the city's corporate limits. The City Council approved the preliminary plat for this
subdivision on August 21, 2017.
DISCUSSION
The submitted Final Plat of Oakland Ridge Estates creates 25 new single-family
building lots and constructs five new private streets to be named Mackenzie Ridge,
Libby Lane, Morgan Creek Drive, Lea Lane and Maci Court. The private streets will be
built with a County standard 22 -foot paving width. The 22 -foot paving width reduces the
amount of impermeable surface and provides adequate travel lane width to serve the 25
building lots proposed.
The proposed Mackenzie Ridge access to Oakland Farms Road complies with SUDAS
standards for sight visibility. The applicant's engineer has provided the necessary
documentation to the City Engineering Department which has confirmed that the new
access will meet SUDAS standards.
The subject subdivision complies with the Unified Development Codes 40 points of
sustainability through a mixture of development tools.
1. Solar lots (1/3 of total lots) = 10 points
2. Recreational trail = 15 points
3. 22 -foot wide paving width for streets = 5 points
4. County storm water management — 10 points

Planning staff is willing to provide the 10 points for compliance with the County
Ordinance on storm water management in that the Code requires that the first 1.25
inches of rain be infiltrated on the site. This requirement is more stringent than current
City requirements.
The submitted Final Plat does provide sufficient easements to provide for the future
extensions of City water and sanitary sewer to the individual building lots. This ensures
that the City will not need to acquire individual easements from future property owners
at such time as City utilities are extended to serve the subdivision.
The City Council has previously approved a pre -annexation agreement for the subject
property as a separate item at their August 7, 2017 meeting.
RECOMMENDATION
Staff recommends approval of the resolution for the Final Plat of Oakland Ridge Estates
subject to allowing 22 -foot paving width for Mackenzie Ridge, Libby Lane, Morgan
Creek Drive, Lea Lane, and Maci Court, and waiving Sections 11-20 Water Supply, 11-
21 Sanitary Sewer, 11-23 Obligation to Install Improvements, and 11-24 Improvement
Guarantees. The submitted Final Plat is in all other respects in compliance with the
Unified Development Code.

Conformance with Comprehensive Plan: This subdivision meets the Comprehensive
Plan Land Use Element Goal 1.2, 1.5, 1.8, 4.3 and 10.2.
Impact of Request on:
Utilities: The proposed Oakland Ridge Estates Subdivision will utilize individual
septic systems for each building lot, and will have shared wells within the
subdivision for water service.
Traffic Patterns: Access to the proposed subdivision will be off Oakland Farms
Road. Based on 2013 IDOT counts, there were 980 average daily trips on Oakland
Farms Road and 2, 330 average daily trips on Military Road.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided there is compliance with the Dubuque County Erosion and Sediment
Control Manual.
Adjacent Properties: Staff anticipates the most noticeable impact to adjacent
properties will be the change to the visual nature of this property with a change
from agricultural to residential housing and an increase in the number of vehicle
trips on the surrounding county roadway system. Staff estimates that when fully
built out with 75 single-family homes, approximately 750 additional vehicle trips per
day will be generated.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted Final Plat of Oakland Ridge Estates is located on the
south side of Oakland Farms Road west of the intersections of Military Road and
Oakland Farms Road. The proposed subdivision includes 25 new single-family building
lots and the construction of five (5) new private streets as part of Phase 1 of the
subdivision. The subject subdivision is jointly reviewed by both the City and County of
Dubuque as it is within two miles of the city of Dubuque's corporate limits. Section 16-
11-7(E) of the Unified Development Code establishes the criteria for review of County
subdivisions.
The Final Plat of Oakland Ridge Estates encompasses a total of 99.6 acres. The first
phase is comprised of 39.65 acres creating 25 building lots. Access to this proposed
subdivision will be from a new private street off Oakland Farms Road to be called
MacKenzie Ridge. The applicant's engineer has provided documentation that the
proposed intersection of Mackenzie Ridge with Oakland Farms Road will comply with
SUDAS standards for sight visibility. Oakland Farms Road will need to be
reconstructed before Libby Lane can be connected. The Final Plat provides an area
reserved for future reconstruction of Oakland Farms Road.

The proposed private streets within Oakland Ridge Estates will be built with 22 -foot of
paving with 66 -foot of right-of-way easement for the main streets, and 50 -foot of right-
of-way easement for the cul-de-sac streets. The County has recently amended their
subdivision code to allow the narrower right-of-way easements for short cul-de-sac
streets.
The submitted Final Plat of Oakland Ridge Estates also provides two stub streets to
adjacent properties on the east and west sides of the subdivision. The developers hope
to be able to continue the subdivision in the future onto adjacent property.
The Planning Services Department has reviewed the proposed Final Plat for
compliance with City Sustainability requirements. The submitted Final Plat of Oakland
Ridge Estates proposes the following sustainability subdivision development tools.
Proposed Sustainable Development Tools:
1) Solar lots (1/3 of total lots) = 10 points
2) Recreational trail = 15 points
3) 22 -foot wide paving for streets = 5 points
4) County storm water management = 10 points
TOTAL: 40 points
Planning staff are willing to provide 10 points for compliance with the County Ordinance
on storm water management as it requires that the first 1.25 inches of rain be infiltrated
on the site. This requirement is more stringent that current City requirements.
The Unified Development Code Section 16-11-7(E), Fringe Area Development
Standards, requires that the developer of a County subdivision sign a pre -annexation
agreement with the City. This agreement stipulates that when the City proposes to
annex the property, the existing and/or future property owner(s) will agree to the
annexation. In return, the City portion of the property taxes will be discounted on a
sliding scale for 10 years. The developers have signed the pre -annexation agreement
and it has been sent to the City Council for their concurrence.
Section 16-11-7(E) also requires that the proposed subdivision also provides sufficient
easements to extend water and sewer into the subdivision without the need of acquiring
individual easements from each property owner in the future. The submitted Final Plat
depicts the necessary easements. These easements have been reviewed as part of
the Final Plat by the Engineering and Water Departments.
RECOMMENDATION
Planning staff recommends approval of the Final Plat of Oakland Ridge Estates, subject
to allowing 22 -foot paving width for Mackenzie Ridge, Libby Lane, Lea Lane, Maci
Court, and Morgan Creek Drive, and waiving Sections 11-20 Water Supply, 11-21
Sanitary Sewer, 11-23 Obligation to Install Improvements, and 11-24 Improvement

APPROVING THE FINAL PLAT OF OAKLAND RIDGE ESTATES IN DUBUQUE
COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Oakland Ridge Estates,
and
Whereas, said Final Plat provides for a 22 -foot pavement width, where 26 -foot paving
width for a private street is required by Section 11-15 of Title 16 of the City of Dubuque
Code of Ordinances, Unified Development Code; and
Whereas, the preliminary plat has been examined by the Zoning Advisory Commission
and has its approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11-15 of Title 16 of the City of Dubuque Code of Ordinances,

c) To provide final design plans and sight distance calculations to the
City of Dubuque for the extension and connection of Mackenzie Ridge to
Oakland Farms Road. Street extension and intersection design as well as
sight distance calculations shall be reviewed and approved by the City of
Dubuque prior to the construction of the Mackenzie Road extension and
connection to Oakland Farms Road.
Section 5. That in the event Oakland Farms Real Estate Company fails to execute the
acceptance within 180 days after the date of this Resolution, the provisions hereof shall be
null and void and the approval of the plat shall not be effective.
