Van Milligen, City Manager SUBJECT: Formal Application for EPA Brownfield Grant In December of 2001, the City Council approved a proposal to the Environmental Protection Agency (EPA) for a grant through the Brownfields Assessment Demonstration Pilot program. The proposal discussed the City's Master Plan for the Port of Dubuque, and the City's need to complete Phase I and Phase 11 Environmental Assessments in the area. The proposal requested $200,000. EPA has recently selected the City proposal for funding. Economic Development Director Bill Baum is recommending City Council approval of the formal application to the EPA for a Brownfields Assessment Demonstration Pilot program. I concur with the recommendation and respectfully request Mayor and City Council approval. Van Milligen, City Manager From: Bill Baum, Economic Development Director Subject: Formal Application for EPA Brownfield Grant Introduction The purpose of this memorandum is to provide information and request action on proposed application to the Environmental Protection Agency (EPA) for a Brewnfields Assessment Demonstration Pilot program. Discussion In December of 2001, the City Council approved a proposal to EPA for a grant through the Brownfields Assessment Demonstration Pilot program. The proposal discussed the City's Master Plan for the Port of Dubuque, and the City's need to complete Phase I and Phase II Environmental Assessments in the area. The proposal requested $200,000 EPA has recently selected the City proposal for funding. In fact, the proposal was the only new one selected in all of Federal Region 7. The next step in the grant award process is the submission of a formal application to EPA for the funds. I have prepared a proposed application, based upon the proposal, and a resolution, both attached to this Memorandum. Action I recommend the City Council approve the formal application, and adopt the resolution authorizing the Mayor to sign the application. This area is also known as the "Ice Harbor", "4th Street Peninsula" and "South Ice Harbor" areas. The City's riverfront has a long history as a home for manufacturing and industrial use dating back to the 1800's. Shipbuilding, leather working, brewing, lumber yards, and shipping became the area's primary focus following the earlier settlement activities of trapping, fishing, and shell harvesting. Originally, the sites were marsh comprised of spits and humps of seasonally dry land. Over time, the flood plain was drained and filled to resemble the current land area. The pattern of indus~al use, while declining, continues to the present day on portions o£the Port of Dubuque. The site also contains existing tourist attractions, including the Riverfront Museum, Diamond Jo Casino, historic Shot Tower and associated surface parking. As a result ora major commitment of local funds and a series of grants from the state and federal governments, a new hotel and indoor waterpark, an education and conference center, the Mississippi River Discovery Center, (musemn, aquarium and wetlands), and the National Rivers Hall of Fame are under design and construction in the area. 1.2 Project Overview and Approach The Brownfield assessment pilot funds will be used to assess, identify, characterize, and plan response activities at any contaminated sites targeted for redevelopment in the Port of Dubuque. The City of Dubuque's overall approach for achieving its goals and objectives consists of capitalizing on the skills and effort of the partnering organizations committed to the redevelopment of the Port of Dubuque. The City Council has approved the Master Plan for the redevelopment of the Port of Dubuque. The City staffwitl finalize the identification of properties known or perceived to be contaminated, and obtain permission fi.om property owners to access their properties for assessment purposes. Staffwill also develop detailed plans for the acquisition or control of these properties, enroll the City in the State of Iowa's Land Recycling Program, and arrange for the Phase I and Phase II assessments. These assessments will be contracted to private environmental consulting firms. Depending upon the resuks of the assessments, the City staff or private consulting firms will develop a plan for remediation, including the financing of the remediation. 2 1.3 Project Objectives The City's objective is to redevelop the entire Port of Dubuque into a new "urban neighborhood", according to an approved Master Plan, with the committed national tourist attractions anchoring other commemial, office, and housing developments. EPA funding would be used to assess properties not yet under City ownemhip and control. The City anticipates p~chasing three properties within one year, and approximately ten other properties within five years. Challenges or problems the City will be addressing in the redevelopment of the Port of Dubuque include the fmancing of the redevelopment, educating existing and prospective property ownem about the brownfields identification and remediation process, and relocating businesses in the area. 1.4 Project Results and Anticipated Benefits The successful implementation of this Brownfields Pilot project will assist the City in redevelopment of the Port of Dubuque. Specifically, the Port of Dubuque Master Plan predicts an additional $137 million in development of approximately 14 acres of office space, 15 acres of office-Showroom space, 14 acres of residential development, 4 acres of commercial development, and 6 acres of parks and open spaces to compliment the existing 44 acres of existing and $188 million planned Casino and America's River projects. This redevelopment of the Port of Dubuque has created an exciting atmosphere in the City, and we invite EPA to be a partner in the success of this redevelopment project. The City anticipates the redevelopment will bring jobs, retail trade, additional tax base, and an increase in wealth and population to the City. Therefore, this Brownfields Pilot project can be a model for other communities in the redevelopment of properties. 1.5 Organization The City's Brownfields Assessment Demonstration Pilot program will be led by the City's Department of Economic Development. Bill Baum, the Economic Development Director of the City will be responsible for the implementation of this program, and is the Project Director. Mr. Baum has over 25 years experience administering federal grant programs, including EPA's wastewater and drinking water programs. Pam Myhre, Economic Development Planner for the City will play a key staffrole in assisting in the contracting of Phase I and Phase II Assessments. Ms. Myhre has extensive experience hi arranging for the completion of locally funded Assessments in the City's Downtown neighborhoods, the City's Industrial Parks, and the Port of Dubuque. Other City Departments will be involved in this project. The City has an established a Port of Dubuque "in-house" work group to implement the Master Plan for the area. The team consists of City Manager Michael Van Milligen, Assistant City Manager Cindy Steintaauser, City Planning Director Laura Carstens, Building Services Director Rich Russell, Transit Manager Mark Munson, City Engineer Mike Koch, Corporation Counsel Barry Lindakl, and Administrative Services Director Pauline Joyce. The City will seek assistance from the Iowa Department of Economic Development, the Iowa Department of Natural Resources, and the Corps of Engineers. All three of these agencies have agreed to assist the City in the implementation of the project. Finally, the City intends to contract with various private environmental engineem to complete the Phase I and Phase H Assessments. 3 2.0 Project Description and Schedule · Finalizing the master plan to guide development in the area. (Completed) · Finalizing the identification of properties within the area known to be or perceived to be contaminated. (Oct-Dec 2002) · Obtaining permission from property owners to access their properties for assessment purposes (October 2002 - Ongoing) · For certain non-City owned properties, develop plans for acquisition or control by the City or Dubuque Initiatives, the non-profit entity established to assist the City in controlling and owning property. (October 2002 - Ongoing) · Enrolling in the State of Iowa's Land Recycling Program. (Jan 2003) · Arranging for the Phase I Envh'onmentaI Site Assessment (ESA) process with qualified individuals or consultants. (March 2003 - April 2004) · Proceeding with Phase II Environmental site investigations on the properties where recognized environmental conditions exist. (March 2003 - Dec 2004) · Obtaining "no further action letters" from EPA and the Iowa Department of Natural Resources for properties determined to be "clean" following the Phase I or Phase II process. (March 2003- April 2004 and beyond) · Developing a plan for additional mmediation, and financhag further action at those properties after the Phase II ESA process. (July 2003 and beyond) · Continuous coordination and communication with the comm~mity, property owners, and prospective developers during the assessment process. (Ongoing) 3.0 Quality Assurance Requirements The City will assure that the selected consultant will conduct all Phase I Assessments according to the current ASTM standards. The consultant selected will also conduct Phase II Assessments according to the Quality Assurance Project Plan reviewed and approved by EPA. Gained community consensus and commitment by adopting the Master Plan for the Port of Dubuque. 2. Identified properties within the Port of Dubuque known to be contaminated or perceived to be contaminated. 3. Assessed the selected properties. 4. Finalized Cleanup plans. 5. Cleaned up the properties, thereby eliminating environmental hazards in the area. 6. Attracted developers to invest and redevelop the entire Port of Dubuque. Success will be measured by tracking the number of properties assessed, the number cleaned up, the number of acres mdeveloped, and the increase in economic activity: new jobs, add/tional retail sales, population increases, etc. over the life of the program. 5
