Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The memorandum and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, noting that the lot split places the existing
farm buildings on Lot 1 to provide the opportunity to sell them separately from the
agricultural fields.
Staff reviewed the submitted plat, noting that the Commission is being asked to waive
the lot frontage for Lot 2.
The Zoning Advisory Commission discussed the request, noting that waiving the lot
frontage for Lot 2 will not adversely impact adjacent property.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City
Council approve the request.
A simple majority vote is needed for the City Council to approve the request.

Subject: Final Plat of Lot ! and Lot 2 of Higley Place
INTRODUCTION
The Final Plat of Lot I and Lot 2 of Higley Place subdivides an existing parcel of land in
Dubuque County into two parcels. The subject property is within two miles of the City of
Dubuque corporate limits, and is jointly reviewed by both the City of Dubuque and the
County of Dubuque.
DISCUSSION
The submitted final plat subdivides property located on the north side of U.S. Highway
20 west of the Swiss Valley Road intersection. The final plat is considered a simple plat
as two new lots are being created; however, Lot 2 does not have frontage on a public or
private street. Both Lot 1 and Lot 2, as noted on the plat, are an integral part with the
ownership of the adjacent parcels that do have frontage on public or private streets.
However, this still does not comply with the City of Dubuque regulations in terms of
street frontage.
The applicant has indicated that the plat is being done to separate an existing farm
buildings from adjacent agricultural property to allow the sale of the farm buildings
separately.
Planning staff does not anticipate any adverse impacts created by the waiving of the lot
frontage requirement for the submitted final plat.
RECOMMENDATION
Planning staff recommends that the Zoning Advisory Commission approve the
submitted final plat of Lot 1 and Lot 2 of Higley Place subject to waiving the lot frontage
requirement for Lot 2.

RESOLUTION NO. 356-02
RESOLUTION APPROVING THE FINAL PLAT OF LOT 1 AND LOT 2 OF HIGLEY
PLACE IN DUBUQUE COUNTY, IOWA.
Whereas, there has been filed with the City Clerk a final plat of Lot 1 and Lot 2 of
Higley Place in Dubuque County, Iowa; and
Whereas, said plat provides Lot 2 with 0 feet of lot frontage, where 50 feet is required
by Section 42-19(b) of the Subdivision Regulations; and
Whereas, said final plat has been examined by the Zoning Advisory Commission and
had its approval endorsed thereon; and
Whereas, said final plat has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1: That Section 42-19(b) of the Subdivision Regulations is waived to allow
Lot 2 to have 0 feet of frontage, where 50 feet is required.
Section 2. That the final plat of Lot 1 and Lot 2 of Higley Place is hereby approved,
and the Mayor and City Cterk are hereby authorized and directed to endorse the approval of
the City of Dubuque, Iowa upon said final plat.
