Leisure Services Manager Marie Ware is recommending acceptance of the construction
contract for the Five Flags Theater Masonry Rehabilitation Project, as completed by
Hydro -Tech Inc., in the final contract amount of $311,952, which was $32,852 over the
bid amount due to additional square footage re -pointing, replacement of four additional
steel linters, painting existing doors and lentils and removal of an existing window and
infill with bricks.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for the
Five Flags Theater Masonry Rehabilitation which has been completed.
BACKGROUND
Five Flags Theater is on the National Register of Historic Places. It is an important
community treasure. The Five Flags Theater is owned by the City of Dubuque and
operated on a day-to-day basis by SMG Management. As a part of the management
agreement the City is responsible for capital improvements of Five Flags Theater.
Restoration of the envelope of historic structures is important to the long-term
sustainability of the structure itself both inside and outside. The fire escape is a working
fire escape for the theater.
Selser Schaefer Architects and WSAIModern Ruins were hired to provide architectural 1
engineering services. The first step was to evaluate both the Five Flags Theater and
Mathias Ham House prior to developing bid specifications. For Five Flags Theater the
report shows masonry rehabilitation was needed and the need to solve water issues at
the roof that create problems with the structure and masonry.
The consultants took a holistic view by not only looking at the current structures and the
masonry rehabilitation but also looking at the root causes of degradation of the
structures. The report was used in preparation of the attached bids and specifications.
The work for this project will include masonry rehabilitation repointing areas on all four
sides of the Theater, repairs to ornamental cornice, modification of roof in one area
drain properly, camel back copings repaired, fire escape and landing repairs, and
general coping repairs.
The City received formal competitive quotations for the Five Flags Theater Masonry
Rehabilitation Project on March 23, 2017. Hydro -Tech Inc. submitted the low bid in the
amount of $279,100. The project was awarded to Hydro -Tech Inc. based on a
competitive quotation process for public improvements in accordance with Iowa Code,
Section 26.14.
DISCUSSION
The Five Flags Theater Masonry Rehabilitation was completed by Hydro -Tech Inc. in
the final contract amount of $311,952. One change order was approved with a
deduction of $750 for less square footage re -pointing on the east elevation, additional
square footage re -pointing on the south elevation totaling $12,182, replacement of 4
additional steel lintels at a cost of $9340, painting existing doors and lintels at $3950,
removal of an existing window and infill with bricks at $3060 and resetting bricks directly
below coping stones at $4320. This change order totaled $32,852.

improvements and authorize payment for the contract amount of $311.952.00 to Hydro -
Tech Inc. for the Five Flags Theater Masonry Rehabilitation Project.

ACCEPTING THE FIVE FLAGS THEATER MASONRY REHABILITATION AND
AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Five Flags Theater Masonry Rehabilitation (the Project) has been
completed and the City Engineer has examined the work and filed a certificate stating
that the Project has been completed according to the terms of the Public Improvement
Contract and that the City Engineer recommends that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Five Flags Theater Masonry Rehabilitation Capital Improvement appropriation for
the contract amount of $311,952.00 Tess any retained percentage provided for therein
as provided in Iowa Code chapter 573, and to pay such retainage only in accordance
with the provisions of Iowa Code chapter 573.

In accordance with the Contract Documents, based on on-site observations and inspections and the
data compromising the Contractor's application, the Architect/Engineer certifies that to the best of
its knowledge, information and belief the Work has been completed in substantial compliance with
the plans and specifications, and the quality of the Work is in accordance with the Contract
Documents. 563 Design PLLC does not have knowledge of any outstanding work or payments.
The final project construction cost including Change Order 1 final is $311,952.00.
We have included copies of the Contract Payment No. 2 in the amount of $172,867.00 and Change
Order No. 1 Final for city approval. The change order documents the differences between the
original contract Scope of Work and final Scope of Work.
We recommend The City of Dubuque approve Contract Payment #2 and Change Order No.1 Final.
We also recommend The City of Dubuque approve and accept the Five Flags Theater Masonry
Rehabilitation and Fire Escape Project. Retainage in the amount of $15,598.00 will be held for 30
days after acceptance and paid at the time provided no claims from others are filed. We will process
Contract Payment No.3 Final for the retainage due to the contractor at the appropriate time.
