Van Milligen, City Manager SUBJECT: Sale of City Lot 4A of Mineral Lot 472 John G. Feltes of 2616 Stafford has requested to purchase Lot 4A of Mineral Lot 472, which is located between his property and Linwood Cemetery, and abuts Dubuque Community School District. Finance Director Ken TeKippe states neither Linwood Cemetery nor Dubuque Community School District have any interest in the property, and the City has no plans for the utilization of this property except for reserving the utility easements as noted. Ken TeKippe recommends disposition of the City's interest in this property, that the purchase price be established at $1, plus publication and filing fees, and that a public hearing be set for August 19, 2002. I concur with the recommendation and respectfully request Mayor and City Council approval. Michael C. Feltes, 2616 Stafford has requested the purchase of Lot 4A of Mineral Lot 472. The lot size is approximately 22' x 268' and located between his property and Linwood Cemetery and abuts Dubuque Community School District and Stafford Street. A copy of Mr. Feltes' letter requesting the purchase is attached. DISCUSSION The attached vicinity map shows the proposed area to be disposed of. The abutting properties are owned by Joseph G. Feltes, Linwood Cemetery, Dubuque Community School District (Jefferson Junior High practice field) and City owned Stafford Street. The existing parcel is not a city street or alley that needs to be vacated. Joseph G. Feltes indicated that he had maintained the property for over two years. I visited with Sandra Smith, General Manager of the Linwood Cemetery Association and Joseph Link, Business Manager for the Dubuque Community School District. Neither organization is interested in the property. RECOMMENDATION The City has no plans for the utilization of Lot 4A of Mineral Lot 472 to be disposed of except for reserving the utility easements as noted. I would recommend that a public hearing be set for the disposition of the City's interest in Lot 4A of Mineral Lot 472 on August 19, 2002. I would further recommend that the purchase price be established at $1, plus publication and filing fees. ACTION TO BE TAKEN The recommendation of the City Manager should be approved and a public hearing should be scheduled on the sale of the property by adoption of the enclosed resolution. Thank you for your assistance. KT/jg Enclosures RESOLUTION NO. 404-02 RESOLUTION OF INTENT TO DISPOSE OF CITY INTEREST IN LOT 4A OF MINERAL LOT 472, DUBUQUE, IOWA Whereas, Joseph G. Feltes has requested pumhase of Lot 4A of Mineral Lot 472: and Whereas, the City Council of the City of Dubuque, Iowa has determined that Lot 4A of Mineral Lot 472 is no longer required for public use, and that the sale of Lot 4A of Mineral Lot 472 in the City of Dubuque, Dubuque County, Iowa should be approved. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the City of Dubuque intends to dispose of its interest in Lot 4A of Mineral Lot 472 in the City of Dubuque, Iowa. Section 2. That the conveyance of Lot 4A of Mineral Lot 472 in the City of Dubuque, Iowa subject to easements of record to Joseph G. Feltes be contingent upon the payment of $1, plus publication and filing fees. Section 3. The City Clerk is hereby authorized and directed to cause this Resolution and a notice to be published as prescribed by Iowa Code Section 364.7 of a public hearing on the City's intent to dispose of the foregoing-described real property, to be held o the 19th day of Auqust , 2002, at 6:30 o'clock p.m. at the public library auditorium, 1 1th & Locust, Dubuque, iowa.
