SUBJECT: Sale of Vacant Lots 3 and 4 in Block 9 Birch Acres
A number of individuals recently contacted the City relative to the potential acquisition of
City-owned lots not currently being utilized for City purposes. Sealed bids were
accepted for City-owned property described as Lots 3 and 4 in Block 9 Birch Acres.
Finance Director Ken TeKippe states that the City has no plans for the utilization of said
property, recommends that the property be sold to the high bidder, Jeff Arensdorf, for a
purchase price of $27,000, plus publication and filing fees, and that a public hearing be
set for August 19, 2002.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
A number of individuals recently contacted the City relative to the potential acquisition of
City owned lots not currently being utilized for City purposes.
BACKGROUND
A copy of the public notice and bid form, as well as a recap of bids received, is attached.
The Birch Acres property received bids from Jeff Arensdorf, Tom Gansen, Eric Frommelt,
and Paul Wheelock. The attached vicinity map shows the proposed area Lot 3 Block 9
Birch Acres and Lot 4 Block 9 Birch Acres to be disposed of.
RECOMMENDATION
The City has no plans for the utilization of Lots 3 and 4 in Block 9 Birch Acres to be
disposed of, except for reserving the utility easements as noted.
I would recommend that a public hearing be set for the disposition of the City's interest in
Lot 3 Block 9 Birch Acres and Lot 4 Block 9 Birch Acres on August 19, 2002. I would
further recommend that the purchase price be established at $27,000, plus publication and
filing fees and that the property be sold to the high bidder, Jeff Arensdorf.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public hearing should
be scheduled on the sale of the property by adoption of the enclosed resolution. Thank you
for your assistance.

RESOLUTION NO. 406-02
RESOLUTION OF INTENT TO DISPOSE OF CITY INTEREST IN LOT 3 BLOCK
9 BIRCH ACRES AND LOT 4 BLOCK 9 BIRCH ACRES, DUBUQUE, IOWA
Whereas, Jeff Arensdorf has offered to purchase Lot 3 Block 9 Birch Acres and
Lot 4 Block 9 Birch Acres owned by the City of Dubuque: and
Whereas, the City Council of the City of Dubuque, Iowa has determined that Lot 3
Block 9 Birch Acres and Lot 4 Block 9 Birch Acres are no longer required for public use,
and that the sale of Lot 3 Block 9 Birch Acres and Lot 4 Block 9 Birch Acres in the City
of Dubuque, Dubuque County, Iowa should be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the City of Dubuque intends to dispose of its interest in Lot 3
Block 9 Birch Acres and Lot 4 Block 9 Birch Acres in the City of Dubuque, Iowa.
Section 2. That the conveyance of Lot 3 Block 9 Birch Acres and Lot 4 Block 9
Birch Acres in the City of Dubuque, Iowa subject to easements of record to Jeff
Arensdorf be contingent upon the payment of $27,000, plus publication and filing fees.
Section 3. The City Clerk is hereby authorized and directed to cause this
Resolution and a notice to be published as prescribed by Iowa Code Section 364.7 of a
public hearing on the City's intent to dispose of the foregoing-described real property, to
be held on the 19th day of Auqust , 2002, at 6:30 o'clock p.m. at the public library ·
auditorium, 11th & Locust, Dubuque, Iowa.
