Claim Response, Patrick, ChrisBARRY A. LINDAHL~~ CORPORATION COUNSEL, CITY OF DUBUQUE MEMO TO: DATE: RE: Claimant Cottingham & Butler Mayor Terrance M. Duggan and Members of the City Council July 26, 2002 Claim Against the City By Cottingham & Butler, by Chris Patrick Date of Claim Date of Loss Nature of Claim 06/03/02 February 2002 Vehicle Damage This is a claim ~n which the claimant states that after cracks were sealed in the Iowa Street Parking Ramp roof, sealant dripped onto his vehicle, damaging the paint According to the report of Tim Horsfield, Parking System Supervisor, Mr. Patrick had notified the Parking Division of a water leak in the decking of the Iowa Street Ramp. It was confirmed by the Parking Division that there was a leak and materials were used to repair the crack. However, as a result of a continued leak, Mr. Horsfield does feel that materials used most likely did drip onto the vehicle owned by Cottingham & Butler. It is therefore the recommendation of Mr. Horsfleld to approve this claim in the amount of $89.95. The Legal Department concurs with this recommendation. BAL/tls cc'. Earlier this spring, Chris Patrick from C0ttingham & Butler notified the Parking Division of a water leak in the decking of the Iowa Street Parking Ramp. It was determined that there was a leak and materials ware used to Ax the problem. As a result of the materials used and also a continued leakage, most likely ongoing material did drip onto Mr. Patrick's vehicle. It is my opinion that the damage claim file by Cottingham & Butler is consistent with this type of parking ramp leakage and repairs. It is therefore my recommendation to pay the claim as filed.
