Nature of Claim
Vehicle Damage
This is a claim in which claimant states that the passenger rear tire of her vehicle was
punctured by a piece of wood that had a large nail sticking out of it. According to Ms.
Vaske, workers from the White Street Reconstruction Project had left the wood in the
roadway.
According to report of Mike Koch, Public Works Director, this claim relates to the White
Street Reconstruction Project that was performed by W. C. Stewart Construction
Company. The contract between W. C. Stewart Construction Company and the City
included bonds and insurance, as well as language stating that the contractor shall hold
the City harmless against all claims arising out of the construction project.
It is therefore the recommendation of Mr. Koch to forward this claim to W. C. Stewart
Construction Company. The Legal Department concurs with this recommendation.

Claim Against the City of Dubuque by Donna Vaske
This claim relates to the White Street Reconstruction Project that is being done
by WC Stewart Construction Co. The contract called for the standard form of
contracts and bonds with the City, which require the contractor to hold the City
harmless from any claims of damage resulting from the work.
Therefore, it is the recommendation of the City Engineering Division that this
claim for damages be forwarded to WC Stewart Construction Co. for further
consideration/processing.
