Kennedy Reconstruction - City/County Funding Agreement A portion of the John F. Kennedy Reconstruction project between the Dubuque Soccer Complex and the City limits is located one-half in the City of Dubuque and one-half outside the Dubuque City Limits (The City limits in this area runs down the centerline of John F. Kennedy Road.) During the design phase of the project, the City approached Dubuque County with a proposal to widen John F. Kennedy Road, including that portion in Dubuque County, as part of the current project. It was informally agreed that Dubuque County would pay for all the construction items located outside the Dubuque City limits, from the Soccer Complex to Barony Road. Public Works Director Mike Koch recommends approval of the agreement between the City of Dubuque and Dubuque County for cost-sharing of that portion of the project located outside the Dubuque City limits, in the estimated amount of $157,583.05 I concur with the recommendation and respectfully request Mayor and City Council approval. Kennedy Reconstruction- City/County Funding Agreement INTRODUCTION On April 15, 2002, the City Council held a public hearing on the plans and specifications for the reconstruction of John F. Kennedy Road from Spring Valley Road to the City limits. DISCUSSION A portion of the project, between the Dubuque Soccer Complex and the City's limits, is located one-half in the City of Dubuque and one-half outside the Dubuque City limits. (The City limits in this area runs down the centedine of John F. Kennedy Road.) During the design phase of the project, the City approached Dubuque County with a proposal to widen John F. Kennedy Road, including that portion in Dubuque County as part of the current project. It was informally agreed that Dubuque County would pay for all the construction items located outside the Dubuque City limits, from the Soccer Complex to Barony Road. Attached is a formal agreement between the City of Dubuque and Dubuque County for cost-sharing of that portion of the project located outside the Dubuque City limits, in the estimated amount of $157,583.05. The agreement provides that the City do all the design and construction work, and that Dubuque County would reimburse the City based on the final cost of the project after the project has been completed. RECOMMENDATION I recommend that the City Council approve the agreement between the City of Dubuque and Dubuque County for the County's cost-sharing on the project, in the estimated amount of $157,583.05. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution approving the agreement between the City of Dubuque and Dubuque County relating to the construction of John F. Kennedy Road from the Dubuque Soccer Complex to Barony Road. KENNEDY ROAD FROM THE NORTHWEST ARTERIAL TO BARONY ROAD Whereas, the City of Dubuque has scheduled improvements for the reconstruction of John F. Kennedy Road from the Northwest Arterial to the northerly City limits; and Whereas, Dubuque County and the City of Dubuque have agreed to cost- share in the portion of said project which lies partially in the Dubuque City limits and partially outside of the Dubuque City limits; and Whereas, the City of Dubuque proposes to design, construct, inspect, and initially pay for the entire cost of said project; and Whereas, Dubuque County agrees to fund that portion of the project located outside the Dubuque City limits based upon the jointly-accepted participating construction items as detailed in the attached agreement; and Whereas, the City Council of the City of Dubuque agrees with the terms and conditions of said agreement. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: That the Mayor be authorized and directed to execute two copies of the agreement for the reconstruction of John F. AGREEMENT BETWEEN THE CITY OF DUBUQUE, IOWA AND DUBUQUE COUNTY, IOWA FOR THE CONSTRUCTION OF JOHN F. KENNEDY ROAD FROM THE NORTHWEST ARTERIAL TO BARONY ROAD WHEREAS, the City of Dubuque, Iowa (CITY) and Dubuque County, Iowa (COUNTY) desire to enter into an agreement for cooperation in the construction of John F. Kennedy Road from the Northwest Artedal to Barony Road (The Project): NOW, THEREFORE, it is agreed by and between the parties as follows: 1. CITY will design the Project as described below: Reconstruction of a portion of John F. Kennedy Road from the Northwest Arterial to approximately 1,382 meters to Barony Road. The pavement will include curb and gutter and will be 12.5 meters from back-of-curb to back-of-curb. The design will allow for one (1) full lane of traffic each direction and also allow for left-turn bays at the Northwest Arterial and other major entrances such as the soccer complex. 2. CITY will develop the Project plans, as described above, and shall initially bear all costs incident thereto. 3. That the CITY will pay for all project costs within the Dubuque City limits and that the COUNTY will pay for all project costs outside the Dubuque City limits. 4. The following estimated items of construction and estimated cost of $157,583.05 shall be the basis for COUNTY's cost-sharing in the project. Payment shall be made by COUNTY to CITY upon completion of the Project and the calculation of the final cost to be allocated to COUNTY, based upon the final cost of those items of construction as listed above. Subject to the approval of and without expense to COUNTY, CITY agrees to perform (or cause to be performed) all relocations, alterations, adjustments or removals of utility facilities, including but not limited to power, telephone and telegraph lines, cable television lines, natural gas pipelines, watermains and hydrants, curb boxes, sanitary sewers, and related poles, installations and appurtenances, whether privately or publicly owned, and all other facilities or obstructions which are located within the limits of an established street or alley and which will interfere with construction of the Project. In connection with the Project, all real estate and rights to real estate necessary for right-of-way in the construction, relocation, or reconstruction of public roads which are or which will be under the jurisdiction of COUNTY will be acquired by CITY for and in the name of COUNTY. If any section, provision or part of the Agreement shall be found to be invalid, the validity of the Agreement as a whole or any section, provision, or part thereof not found to be invalid shall not be affected. This Agreement shall be executed in two counterparts, each of which so executed shall be deemed to be an original and both shall constitute but one and the same instrument. Schneider, CMC City Clerk RESOLUTION NO. 02-172 ORIGINAL WHEREAS, the City of Dubuque and Dubuque County have scheduled improvements to a portion of Kennedy Road from the Northwest Arterial to Barony Drive, and WHEREAS, the City of Dubuque proposes to design, let, construct and inspect said project, and WHEREAS, it is necessary for Dubuque County and the City of Dubuque to enter into an agreement regarding said project, THEREFORE BE IT RESOLVED that the Board of Supervisors of Dubuque County, Iowa hereby approve and direct the Chair to sign the Agreement between the City of Dubuque and Dubuque County for the Kennedy Road project Adopted this 15th day of July, 2002.
