Van Milligen, City Manager Busted Lift Special Event Permit Mr. John Finn of the Busted Lift wishes to have a special outdoor event blocking the 1st Street Extension east of the Busted Lift on the evening of Saturday, July 27. I apologize for bringing this to the attention of the City Council so near to the event, however, there is some disagreement on the timeliness of Mr. Finn's application. On April 16, 2002, Mr. Finn submitted the required State of Iowa Alcohol Beverages Division Outdoor Service Area Application to serve alcohol as part of this event. At that time he was given the City of Dubuque Special Event Permit Application. Mr. Finn says that he returned that application in May to the City Clerk's Office. Sue Winter advises that the application was not received by the City Clerk's Office. This misunderstanding was identified when Mr. Finn brought in the $300 alcohol permit fee the morning of Monday, July 22, 2002, only to discover that the City and the State had not issued any permits for this event to occur. In the interim, Mr. Finn had submitted a request to the City to be able to create a permanent outdoor area that would not be so large as to block the street. As part of that process, neighbors submitted the attached letters of concern. John Finn has provided a written response to those letters. Last September the Busted Lift held an event called Irish Fest at Murphy Park and Leisure Services Department Manager Gil Spence provided the attached memo to the Park and Recreation Commission with concerns about how that event was conducted. Mr. Finn provided the attached written response to Mr. Spence's concerns, and the Park and Recreation Commission agreed to allow the event to occur again this year with certain conditions. The Park and Recreation Commission minutes from that meeting are also attached. At 4:00 p.m. on July 22, 2002, I asked Mr. Finn to provide a completed City of Dubuque Special Event Permit Application, which he provided at 4:50 p.m., and the consent of his neighbors pdor to the special Council meeting of July 23. Agreement from two of the neighbors, Bob Byrne and Frank Salwolke, is attached. If the Mayor and City Council agree to approve the submittal of the State of Iowa Alcohol Beverages Division Outdoor Service Area application to the state., I will issue a special event permit upon his meeting the insurance and other conditions of the permit. They have asked me to con. tact you on their behalf and formally voice their objection to a request made by John Finn, owner of The Busted Lift, for a permit and authority to construct and maintain an outdoor patio at 180 Main Street Certainly, you can understand my clients' concerns regarding the nuisances associated with an outdoor bar, including increased and elevatednoise, litter, and destruction of property. Further, some of the business hours of The Busted Lift overlap the business hours of my client, Canvas Products Company. We anticipate that the operation of an outdoor bar will also result in disturbances to my client's business during operating hours. It is my understanding that some of the properties in the area are residential, and the sounds created by an outdoor bar will certainly be a problem to anyone trying to live or raise a family in the general vicinity. Related Agenda Item April 12, 2002 Mayor Terry Duggan City of Dubuque City Hail Dubuque, IA 52001 Re: Busted Lift 180 Main Street Dubuque, IA Dear Mayor Duggan: It is our understanding that the City of Dubuque is being approached by the owners/operators of The Busted Lift to sell to them the area in the roar of their building that is plotted as a public sidewalk. As owners of property at 190 Main Street, we feel the need to inform you, our City Manager and the City Council of our objections: 1 ) The street (1st St. Extension) is more heavily traveled than some might expect, by abandoning this sidewalk you will be placing all pedestrian traffic in the street. As this area continues to develop you will be seeing an increase in pedestrian traffic in this area. Safety of pedestrians should be a main concern of our City. 2) Parking in this area has already been a Problem for the neighbors. Customers of the Busted Lift continually use neighboring driveways for parking. They already are short {they have none) of the required off street parking and now want to increase their capacity! 3) The Historical Commission and the City were given grandiose plans of the renovations that were to take place on this property at least 4 years ago. Work has never been completed and what was done was not what was proposex:l. 4) The Busted Lift advertises and "guarantees" that they will be open every night until 2:00 AM. This brings with it more problems: a. Noise late at night when. residents are trying to sleep. b. Trash (beer bottles, etc.) strewn over the area. c. Public urination on the sidewalks. d. Vomit on the sidewalks. 5) The Busted Lift already ignores the laws and codes of the City by utilizing public streets for special parties. When an organization such as Dubuque Main Street sponsors an event (The Main Event), we are required to get special permission from the City to close off any street area. It is also a requirement that fencing be erected to contain those drinking to a confined area and security guards are required to make sure no one leaves the area with alcohol. Businesses inside the event area who operate bars have to get special liquor, licenses and special dram shop insurance to sell alcohol on the sidewalk in front of their business for a one day eventl The Busted Lift, however, ignores all these requirements and puts a tent in the middle of 1st Street Extension without any permits or City approval! Are our laws only for those who willing obey them? The City of Dubuque and the property owners in Historic Main DistrlcI have spent years and a tremendous amount of public and private funds to make this area a thriving part of the community of which we can be proud. May 1 remind you that the "plan" for this area is to combine business with upper level residential. Trusting in the City that this indeed was the plan, we and many others in the area have expended our monies in rehabbing neighboring buildings to first class business properties with high end living above. I know that many people in the City visit the Busted Lift afte work and in the early evening hdurs and view it as a quiet little pub with a unique atmosphere. Late in the evening it tums into a different atmosphere. PeopIe who have already had enough to drink, leave the bars that close early and come to the Busted Lift - they know it'll be open until 2:00 AM. These people are loud. crude and vulgar at closing time. It is a sad situation when residents are awaken with loud obnoxious noises during the early morning hours and then faced with cleaning up vomit and trash before they can.open their business the next day! How would you tike to be awakened in the middle of the night with someone on the roof of your apartment yelling to his buddies in the street? ..This has happened. People have gotten to the roof of the Busted Lift and walked across 3 building roofs to 198 Main Street. If they fall where is the liability? Will the City allow the neighbors to put razor wire fencing on the roofs to keep out trespassers? If you allow the Busied Lift (or any other bar in the area) to serve alcoholic beverages on what is and should be public property you will be destroying what you and so many people in the City have spent years trying to accomplish. The Busted Lift has continually ignored regulations set by the City--parking requirements, use of public areas, over capacity of building and. building rehab requirements. Don't ever believe you will contain their business to this sidewalk area - you will be seeing people drinking, etc- in the middle of the street. What next? Give them the street? The operators of the Busted Lift have continually sold the City a "bill of goods' to get what they want. Originally, it was to be an Irish eating establishment with a quiet tiltle pub - operating during hours of most restaurants. They were to lease off street parking. They were to rehab the exterior of the building. They were to compliment an up and coming business/residential neighborhood. None of these items have been accomplished. I'm sorry, these people will promise you whatever you want to hear and then do as they please with no repercussions from the authorities. I plead with you, do not abandon or sell this sidewalk area. You will bo destroying the value of the neighboring properties and cause more problems than you can ever imagine. Duggan, Van Mil]igen, and Koch: We are the owners of the Main Gallery, located two doors up Main Street from The Busted Lift. We also llve in the back of the building. John Finn, owner of the Busted Lift, came in recently to request that we approve a plan to build and maintain an outdoor patio behind his establlshment. Mr. Finn has, in the past, asked us to give permission for various events. Sometimes we felt no fallout from his activities and didn't mind giving permis- sion for one or two nights. However, the most recent St. Patrick's Day celebra- tion was very loud and went on way beyond the time promised. We will think carefully before giving our permission for future parties. We definitely want to register our obiections to Mr. Finn having a permanent right to expand outside the Busted Lift. He claims there will be no music, but the mess and noise from the drinkers and so on will destroy our ability to use our outside deck, or (if music is as loud as St. Patrick's Day) even relax at home. Judging by certain evidence we see on our sidewalks and the noise at 2 a.m., we also believe the establishment may serve drinks to people who have possibly bad more than enough. Further, the proposed outdoor patio would interfere with the private and commercial flow of traffic in the alleyway, and possibly be a hazard to pedestrians loitering in the area. Although we realize we don't live in a residential neighborhood, we believe the key to the revitalization of lower Main lies in building residential space and trying to attract more peo- ple to live downtown. We desire a diverse neighborhood of retal] shops, restaurants, and residences. Neighborhood bars might also fit in if they respect their surroundings. We have many friends who have expressed a desire to live in the downtown area, should space become available. However, they won't do so if the area is too noisy. First I would like to summarize the intent of this patio area. There will be no live music, or piped in music or speakers of any kind associated with this patio. The patio will conform to the surrounding area, and will consist of tables, chairs, planters with flowers, and a movable wooden fence enclosing the area where alcohol will be consumed. This area is designed to be used for patrons who would like to enjoy a beverage outside, overlooking the Ice Harbor and the emerging Riverwalk Project. We will closely monitor drinking and noise levels as professionals in this service industry. We have built a reputation on quality, have maintained it for two years of operation, and will do so in the future. Some points mentioned in the letters you received from Jennifer Clemens-Conlon and Duane Greenfield contain some statements that are either not true or exaggerated and I would like to address them point by point. 1. It was stated that there has been a history of noncompliance of city ordinances by The Busted Lift. I am not aware of any issue of noncompliance. In fact, The Busted Lift has gone above and beyond what has been required by the city for street closings and we have kept open areas so neighbors and Canvas Products could continue to use their parking spots and conduct business. 2. There was an accusation that on St. Patrick's day The Busted Lift did not hold the necessary perm/ts for an outdoor tent. This is not true. In every case, all required permission was received from the appropriate city department, and we have never received a complaint from any city department except for when our tent vendor was late picking up their tent. This was remedied immediately. We always held all required liquor, food, indemnity and dramshop licenses 3. There is also an accusation stating The Busted Lift has been inconsiderate of its HAY 1 3 2002 business neighbors. In reality, I keep open frequent lines of communication with all neighbors, and except for these letters, was unaware of any problems. The only exception was on St. Patrick's Day when Bob Byrne approached me and requested that the music be turned down. According to my understanding of City ordinance, outdoor music is allowed until 10pm on Sundays, but in order ro keep peace we turned down the volume to accommodate our neighbor. Also, this was St. Patrick's Day, which you may agree might be a poor example ora typical day at The Busted Lift. 4. There is a concern expressed in the letters about the noise from an outdoor bar. The only additional noise will be conversation. The Busted Lift is not an establishment that is rowdy and out of control. This can be verified by qhecking police records. We have never had an underage drinking violation, or an issue with loud noises. We pride ourselves on the fact that our customers are respectful and well behaved. Of course there may be exceptions in any establishment, however, for our two years of operation this has not been an issue. I personally have called the Dubuque police when I felt the situation warranted it. These situations were when a customer would show up at The Busted Lift intoxicated and I was concerned they were driving and posed a hazard. These may be documented in police logs. 5. The point was made that sidewalk space would be lost by our patio and people would be forced to walk in the street. This is not true. We have incorporated a 48" egress for the city sidewalk to remain open. This was discussed with several city departments at last years request meeting. 6. Parking was raised as a concern. There have been a handful of times in two years that a customer has parked in a private driveway. The Busted Lift has called for a tow truck to remove these vehicles and has posted signs in The Busted Lift informing customers of the parking requirements of neighbors. I have had several personal discussions with the owner of Canvas products, with witnesses attending these meetings, and he has never expressed any concern over this issue. I have told him to please call a tow track if his driveway is blocked and he has said it is not a problem. 7. A remark was made that 4 years have passed since The Busted Lift proposed grandiose plans of renovation and these plans are still not complete The fact is we have only been open for two years, and the remodeling is in full process. In fact, within the last month I have contacted the city regarding moving ahead with exterior work on the building. Our renovation is proceeding as planned. 8. Regarding trash and beer bottles strewn over the area, as was stated in one of the letters you received, we have been very, very meticulous about cleaning up not only any garbage caused by our customers, but general garbage in the area. We want this area to look attractive and clean, and this area is much, much cleaner and tidy now than it was when we first moved into this neighborhood, thanks in large part to our efforts. 9. There was a very serious allegation that The Busted Lift ignores the laws and city codes by utilizing public streets for special parties. This is absolutely not true. We have always complied and actually sought out requirements that we would need to abide by. The accusation is that The Busted Lift boldly, and without regard for city requirements, simply sets up a tent on 1st street extension and sells alcohol without a license. This is ridiculous, and is actually an insult to every city department that approves these functions. We are diligent in our compliance with local and state liquor laws. 10. There is a further allegation that The Busted Lift is a sort of Jekyll and Hyde pub, that appears as a quiet pub by day but at night turns into some sort of monster. We have had only one over capacity complaint, and we remedied that with better communication with our employees and closer monitoring of occupancy. Our clientele consists of professionals and responsible adults. 11. There was a concem expressed that people would be drinking in the streets if we open an outdoor patio. We have complied and will continue to comply with all laws and regulations regarding alcohol consumption. I am well aware of the fines and consequences for infractions, and our liquor license is very valuable to us. Drinks will only be allowed in the patio area, the same as the Yard Arm, the Dog House, the Lounge, Tugboat Willy's or any other outdoor area. 12. Another point brought up in one of the letters was that people who have had too much to drink at other establishments then come to The Busted Lift because they know we are open until 2am. We do not serve anyone who has had too much to drink or appears intoxicated when they enter The Busted Lift. These people are asked to leave, and we also have called a taxi and given rides home to several people. We do not over serve people who are in the pub. In addition most bars in Dubuque are open until 2am, so there is no incentive for them to come to The Busted Lift thinking we are open later than other bars. 13. This same letter states that the patrons of The Busted Lift are loud, unruly and vulgar at closing time. I am not aware of any incident at closing time that would lead anyone to claim this. Our patrons have been respectful of the neighborhood. 14. There was an incident when we first opened where some college students gained access to the rooftops of the building between 1st and 2nd street. We later were able to determin.e that these people were staying at the Julien hotel, had never been in The Busted Lift, and gained access by climbing up one of the adjacent buildings fire escapes. The author of one of these letters is Duane Greenfield, who has not resided in this neighborhood for several months. It appears strange ro me how he can form negative judgments about The Busted Lift while living in Arkansas. On May 10, I spoke with Frank, the owner of Canvas Products, and he once again told me garbage and noise had not been a problem for him, but that Duane Greenfield thought it was a problem. In our opinion, and in the opinion of countless others, The Busted Lift has been very positive for this neighborhood, and for Dubuque in general. As evidenced by letters from other neighbors who approve of this patio plan, we feel we have been good neighbors, and will continue ro do all we can to peacefully co-exist. I have had neighbors tell me that even during outdoor events they can not hear the music since it is around.the back of the buildings and faces the Ice Harbor. In addition The Busted Lift has donated thousands of dollars to the community, not only through taxes but by giving money to local organizations, including the American Cancer Society, Wee Care Child Development Center, Fred Skemp after his heart attack, St. Patrick's St. Mary's early childhood center, Hillcrest Family Services, and this year the Dubuque Boys and Girls Club. Furthemore, individuals who make the choice to live in a downtown setting that is growing and expanding and includes commercial and retail space, should understand that the operation of those businesses is part of the ambiance of deciding to live in this area. I understand the need for respect of property and noise levels, and we will continue to do all we can to be an excellent neighbor and member of this community. We feel that this outdoor patio will enh'ance this neighborhood, provide another valuable asset to the Ice Harbor area, and not annoy our respected neighbors. Spence, Leisure Services Manager October 30 2001 SUBJECT: Irish Fest This memorandum is intended t'o provide you with information on the Irish Fest held October 13, 2001, in Murphy Park, for use in evaluating the event. After the commission gave approval, John Hail and I met on August 24th-with John Finn and Jeff Cremer. A copy of the notes from that event are attached, along with the letter I sent to John Finn saying if I missed anything to let me know. Also attached is a copy of a letter I sent.tb John Finn dated September 5th where I enclosed an aerial view of the park and the parking locations identified by John Hail. That letter also suggested the two Johns meet at the park to review the parking situation and finalize a plan. John Hail had several conversations and meetings with John Finn and Jeff Cremer to finalize plans for the event. The following is a list of items that transpired different than what was .agreed to. · No final site plan was given to John Hail. · A person was to supervise parking in the park but no one did. Vehicleg were to parallel park on the. roadway but many vehicles parked at 90 angles with wheels off the road. Also, vendors pulled up to the tents and remained there. This situation. was made more serious with the rain the day of the event. · The tug-of-war was to be held behind the backstop but was held on the third base line of the infield. The organizers said they would repair the turf. We did not understand there was to be a keg of beer in there. The building on Sunday morning smelled .. iike beer. Our weekend staff had to clean the building because it was reserved at 11:00 a.m. for a youth birthday party. · They were to use the electrical hookups installed by Hillcrest for their light display. On Friday, our maintenance worker in the park stopped someone from wiring a 220 outlet in the maintenance shop and drilling a hole in the wall to get the wiring outside· · They were told they could not place Signs in the islands on Grandview Avenue but signs appeared there and in other right-of-way locations. The following is a summary of John Hall's involvement on Saturday and Sunday: · On event day, Saturday, October 13th John Hail went to Murphy Park at 3:00 p.m. to check on things. It had rained that morning and no one was working on parking. John Finn said he had a golf cart and would send someone out to keep an eye on it. Cars, trucks and trailers were parked on the ball field. · John returned to the park at 7:30 p.m. to find vehicles parked almost completely around - .the park, easily double the number of vehicles identified by John Hail. John talked with John Finn and Jeff Cremer before he left at 8:30 p.m. to make sure they understood that the music-and beer stopped at 10:00 p.m. They both said "no problem." At 10:15 p.m. John received a call from park ranger Deb Naderman that the music was still playing and beer was still being served. Deb told John Finn if the activities did not stop she would call in the police. The music stopped at 10:20 p.m. John Hail returned to the park at 10:35 p.m. to make sure the cleanup was started. Fencing in the beer area will be a pr~b(em since it will need to be so large and have several exits; would like to use the exterior fence of the pa?k, like last year. Park can be used, but this may need to change in the future. For parking, would like to see one seasonal ranger and the auxiliary police hired. This will provide more coverage at less cost. Finn recommends people be stationed around the park for continuous coverage. John Hail will contact the auxiliary to see if they are available. Hours Cf the full time maintenance worker were questioned and also if that person was for clean up. Spence explained that this person would not be responsible for park cleanup and that the com.,mittee would still need to do that. Also, the number of hours this person works .will depend on what is going on in the park. 4. Does the committee need to provide trash cans and a dumpster? YES Can they put a sign on the fence along the highway (like Hillcres_~t does) in September?. No, signs will only be allowed the day of the event. I want to thank you for all your support on Irish Fest. I sincerely appreciat~ it. I mn writing this to respond to John HaWs memorandum regarding Irish fest. We will attend the commission meeting on November 13. We acknowledge that there are areas that need improvement and fine tuning for next years festival. I will list those below, as well as respond to specific comments made by John Hail. point by point from John Hall's memo -We need to make sure the park department has a site plan as soon as the city has one. We were under the impression our meeting of August 24 was sufficient. - Parking was supervised, however we need to do a better job monitoring this for next year. No damage occurred, but some cars were parked on the grass, especially by the vendors area. Our plan is to station parking supervisors ever] 20 yards around the roadway next year. - The tug of war site was never determined to be behind the backstop. We were told by two landscape contractors to wait until spring to repair this area, and we will do that at our expense. Damage is minimal and can be easily repaired. -According to'our stage manager, the band ended at 10:07. We realize this went over the 10:00 limit and it will not happen again. The sound system malfunctioned earlier in the day and we got backed up, then Gaelic Storm performed an encore for the approximately 1,600 people at the show. We were wrong to let the music run over and it will not happen again. Beer sales ended at exactly 9:50 pm. -We were under the impression that the headquarters pavilion needed to be for the next day rental, but that it was not crucial that the tent be gone by 11 am. There was a.bsOlumly no trash left on the grounds. The tent ,~as not removed until Monday. We told Bel-Aire to have it down on Sunday, and we could not reach them. Seleo came for the rest rooms later than we told them to. The Dumpster was removed later than we told them also. Our plan next year is to be sure to identify to these subcontractors exactly what is expected of them. -There was a keg of beer in the event headquarters building which we had discussed. earlier, the building was not a mess. The floor needed to be mopped and that was it. There ~vas no garbage, and ~mly no mess. -In order to run the popcorn machine we needed to run a 220 outlet, which we had discussed earlier with Park employees and Hillcrest volunteers. Nothing was damaged to accomplish this. -Unfommately there was poor communication regarding signage. In our meeting with Gil and John Hail we were told no public right of way signs, however, Guy Hemenway felt that since this was a city festival, signage was ancillary to thc festival and was allowed. I understand the city is reviewing this policy, and should have an understandable new policy by next year's fest. We were not trying to go around anyone or disturb anyone, we were attempting to follow existing policies. Due to inconsistent interpretation a problem arose. We plan to improve our communication with all city departments next year. -Regarding John Hall's impressions of Saturday and Sunday John states no one was working on parking. In fact, 6 people were assigned to parking. We can and will do a better job next year. It is difficult to enforce a policy when someone leaves a parking spot, and someone else pulls in quickly and leaves their car. Next year we will have people stationed around the roadway to minimize problems. Even still, there were no problems with parlcing, no damage occurred, and we:were never more than two-thirds full. Many more cars could have been accommoc~te~ ~ -According to our stage manager, who was handling the bands and timing all day, the park ranger approached us at 9:55 and said the band needed to stop due to the 10:00 ordinance. I explained to her that a lot of the neighbors were attending the festival, and that the band was only going to play one more song and then we were finished. She told us that it was 10:10 and we had to stop right then. there were !,600 people cheering for an encore. I told her we understood, and that the band would end after their next song. They wanted to play more but we did not allow them to. -When our volunteers left the park Saturday night, there was no garbage on the grounds or bathrooms, and all pavilions were spotless, except for needing to be mopped. There was straw on the ground, which we were planning to come back and rake away. -John Hail states that he called in a weekend crew to clean up. There was no more cleaning to be done, other than raking straw and mopping the bathrooms and pavilion. - John Hail states that commitment were made and not followed through. I don't know what he .is referring to. fie also states that there were problems that arose. I would like to know what those were. There was not one security incident, not one injury, nothing was broken, and except for the tug of war tuff ar~a, there was no lasting injury to the greenspace. He says new event organizers be named. This is an irrational insult. We organized and ran a fa-st class event with an incredible minimum of problems. Quite seriously, other than John Hail, all we have heard are extremely positive comments and thank you's. John says a substantial deposit be required. For what? There was no damage, and except for the $110.00 bill we paid for his clean up crew, (which is still a mystery to me what they cleaned up), there was no other costs incurred to the park from thc lest. John states we need more security. Once again, for what? There was not one security or safety issue. He wants us to move the event to Eagle Point Park. We can discuss this, however, Murphy park is in the Little Dublin area of town, and is, in our opinion an Ideal setun~. Changing locations will not address the issues John has raised. John thinks we should not allow beer. How was beer a problem7 We would like to use Murphy park for all future Irish Fests, and we also want to team from this year. How long lasting the damage or how difficult to repair is not the point. The point is, vehicles were not to be on the grass and no one prevented it from happening. 3. This may well be, but John Hail was in the park three times and no one was working parking. 9. Commissioner Duggan would like off duty police officers working - at least one when the beer starts being served, and from 6:00 p.m. until closing. REQUEST FROM GARY LATHAM TO MAKE SNACK 8AR A NON SMOKING FACILITY: Gary Latham was present requesting that the commission make the golf course snack bar a totally non-smoking facility. There are more non-smokers and they should be given first consideration. Mr. Latham did not feel it would work to make one section smoking and the other non-smoking because there is no ventilation and he hoped the commission would take that into consideration when making a decision. He said many people leave after their golf league because the smoke is so bad you can't breathe.
