Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer DATE: January 9, 2009 SUBJECT: Acceptance of Public Improvements in Crescent Heights Subdivision INTRODUCTION The enclosed material provides for City Council acceptance of the public improvements which the developer, McDermott Real Estate, LLC, has recently completed in Crescent Heights Subdivision. BACKGROUND As a condition of subdivision plat approval through Resolution No. 566-00, the developer of Crescent Heights Subdivision was required to install certain improvements including street paving with curb, sanitary sewer main, watermain, storm sewers and catch basins, boulevard street lighting, and a stormwater detention facility and to dedicate these improvements to the City upon completion. DISCUSSION The Subdivision Ordinance requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. On December 11, 2008, McDermott Real Estate requested City's acceptance of the improvements in Crescent Heights Subdivision. Upon inspection by the City, it has been determined that all public improvements required by Resolution No. 566-00 have been completed in accordance with plans approved by the City Council and in conformance with City specifications. RECOMMENDATION I would, therefore, recommend that the City Council accept the improvements. Maintenance of said public improvements shall be the responsibility of McDermott Excavating, and the owner, McDermott Real Estate, LLC, for a period of two (2) years from the date of acceptance by the City Council. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution accepting the improvements. Prepared by Ronald J. Turner, PLS RESOLUTION 18-09 ACCEPTING IMPROVEMENTS IN CRESCENT HEIGHTS SUBDIVISION Whereas, pursuant to Resolution 566-00, certain public improvements including street paving with curb, sanitary sewer main, watermain, storm sewers and catch basins, boulevard street lighting, and a stormwater detention facility were installed by the developer of the Crescent Heights Subdivision. Whereas, the improvements have been completed and the City Manager has examined the work and has filed a certificate stating that the same has been completed in accordance with the plans approved by the City Council and in conformance with City specifications, and has recommended that the improvements be accepted by the City Council. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the recommendation of the City Manager be approved and that said public improvements in the Crescent Heights Subdivision be and the same is hereby accepted. Section 2. That maintenance of said public improvements shall be the responsibility of the contractor and owner for a period of two (2) years from this date.
