Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer DATE: January 9, 2009 SUBJECT: Acceptance of stormwater Detention Facilities in Cedar Ridge Farm Place No. 4 INTRODUCTION The enclosed material provides for City Council acceptance of the stormwater detention facilities which the developer, Nemmers Cedar Ridge Farm Limited Partnership, has recently completed in Cedar Ridge Farm Place No. 4. BACKGROUND As a condition of subdivision plat approval through Resolution No. 350-01, the developer of Cedar Ridge Farm Place No. 4 was required to install certain improvements including street paving, storm sewer, sanitary sewer, watermain, street lighting, and stormwater detention facilities and to dedicate these improvements to the City upon completion. Since over 80 percent of the lots are developed, the developer has formally requested the City's acceptance of the stormwater detention facilities which have been installed. The remaining public improvements were previously accepted by Resolution No. 321-03 on September 15, 2003. DISCUSSION The Subdivision Ordinance requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. On December 18, 2008, Cedar Ridge Family Partnership requested City's acceptance of the stormwater detention facilities in Cedar Ridge Farm Place No. 4. Upon inspection by the City, it has been determined that the stormwater detention facilities required by Resolution No. 350-01 have been completed in accordance with plans approved by the City Council and in conformance with City specifications. Inspections, administrative and maintenance expenses incurred by the City of Dubuque for the stormwater detention facilities (Lot B and Lot C) shall be assessed against Lot 1 through 7 and subdivisions thereof, in proportion to the acreage of each lot as a percentage of the acreage in the subdivision. Such costs will be dependent upon the condition of the facility. The City Manager shall certify such costs to the City Clerk, who in turn shall promptly certify such costs to the Dubuque County Treasurer, and such costs shall then be collected with and in the same manner as general property taxes in accordance with provisions of law. RECOMMENDATION would, therefore, recommend that the City Council accept the stormwater detention improvements. Maintenance of said stormwater detention facilities shall be the responsibility of the City of Dubuque with said maintenance costs being assessed to the property owners within the subdivision. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution accepting the stormwater detention improvements. Prepared by Ronald J. Whereas, the stormwater detention improvements have been completed and the City Manager has examined the work and has filed a certificate stating that the same has been completed in accordance with the plans approved by the City Council and in conformance with City specifications, and has recommended that the stormwater detention improvements be accepted by the City Council. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. ,That the recommendation of the City Manager be approved and that said stormwater detention improvements in the Cedar Ridge Farm Place No. 4 Subdivision be and the same is hereby accepted. Section 2. That maintenance of said public improvements shall be the responsibility of the City of Dubuque with costs for said maintenance, inspection, and administration being assessed to the property owners of Cedar Ridge Farm Place No. 4.
