Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant's representative spoke in favor of the request, noting the submitted plat
of survey is a first step in developing a larger residential subdivision.
Staff reviewed the location of the property, joint review by City and County, and the
need to waive lot area for Lot 2 of 2 and lot frontage for both lots.
There were no public comments.
The Zoning Advisory Commission discussed the request, and had no objection.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, subject to waiving lot frontage for Lot 1 of 2 and Lot 2 of 2 and lot
area for Lot 2 of 2.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted plat of survey subdivides an existing parcel into two lots. The lot split is
to facilitate the conveyance of land (Lot 2 of 2) to the adjacent property owner to the
south, Mr. David Chapin. The property is within two miles of the City of Dubuque
corporate limits and thus is jointly reviewed by both City and County of Dubuque.
DISCUSSION
The submitted plat of survey is being reviewed by the Zoning Advisory Commission as
the two lots created do not have frontage on a public or private street. In addition, Lot 2
of 2 does not have the minimum 5,000 square foot of lot area, but rather 3,750 square
foot. Lot 2 of 2 is being sold to the adjacent property owner, Mr. David Chapin, while
the existing property owner, Edward Neises, is the seller. Both Mr. Neises and Mr.
Chapin have additional property that do have frontage on Old Davenport Road. In order
to consolidate the two lots into the existing parcels owned by the seller and buyer would
require a significant amount of survey work with a significant increase in cost. Planning
staff has no objection to the proposed plat of survey as the lot splits will not adversely
impact adjacent properties, and are not intended for the development of additional
single-family homes.
RECOMMENDATION
Planning staff recommends that the Zoning Advisory Commission approve the plat of
survey subject to waiving lot frontage requires for Lot 1 of 2 and Lot 2 of 2 and waiving
the lot area requirement for Lot 2 of 2.

RESOLUTION APPROVING THE FINAL PLAT OF SURVEY LOT 1 OF LOT 2
AND LOT 2 OF LOT 2 OF THE SOUTHEAST QUARTER OF THE SOUTHEAST
QUARTER OF SECTION 24, TOWNSHIP 88 NORTH, RANGE 2 EAST OF THE
FIFTH P.M. IN TABLE MOUND TOWNSHIP IN DUBUQUE COUNTY, IOWA.
Whereas, there has been filed with the City Clerk the Plat of Survey Lot 1 of Lot
2 and Lot 2 of Lot 2 of the SE 1/4 of the SE1/4 of Section 24, T88N, R2E of the 5th P.M.
in Table Mound Township in Dubuque County; and
Whereas, said plat provides 0 feet of frontage for Lot 1 of 2 and Lot 2 of 2 where
50 feet is required, and Lot 2 of 2 has 3,750 square feet of lot area, where 5,000 square
feet of lot area is required by Section 42-19(b) of the Subdivision Regulations; and
Whereas, said plat has been examined by the Zoning Advisory Commission and
had its approval endorsed thereon; and
Whereas, said plat has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the City Council hereby waives Article IV, Design and
Improvement Standards of the Subdivision Regulations, except for Section 42-19,
Blocks and Lots.
Section 2. That Section 42-19(b) of the Subdivision Regulations is waived to
allow Lot 1 of 2 and Lot 2 of 2 to have 0 feet of frontage, where 50 feet is required, and
Lot 2 of 2 to have 3,750 square feet of lot area where 5,000 square feet of lot area is
required.
Section 3. That the Plat of Survey Lot 1 of Lot 2 and Lot 2 of Lot 2 of the SE'/4
of the SE 1/4 of Section 24, T88N, R2E of the 5th P.M. in Table Mound Township,
Dubuque County, is hereby approved and the Mayor and City Clerk are hereby
authorized and directed to endorse the approval of the City of Dubuque, Iowa, upon
said final plat.
