Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the area to be platted and
location of the proposed park land.
Staff reviewed the location and layout of the proposed subdivision, and reviewed the
location of the proposed park land and noted the location of a future access road that
will serve Barrington Lakes Subdivision as part of an interchange to be built as part of
the Southwest Arterial project.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the proposed park
is somewhat removed from the building lots but that they recommend approval of the
final plat as submitted.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

RESOLUTION NO. 31 - 09
A RESOLUTION AUTHORIZING APPROVING FINAL PLAT OF ENGLISH RIDGE
SUBDIVISION IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a final plat of English Ridge
Subdivision in the City of Dubuque, Iowa; and
Whereas, upon said final plat appears streets to be known as Chesterfield Drive
(Lots B & C), Stone Valley Drive (Lot D), Kingsley Lane (Lot E), Kingsley Court (Lot F),
Wellington Lane (Lot G), Wellington Lane (Lot H) and Shrewsbury Lane (Lot 1), together
with certain public utility, storm sewer, sanitary sewer and water main easements, storm
water detention facility (Lot A) and park land (Lot K) which the owner by said final plat
has dedicated to the public forever; and
Whereas, the preliminary plat has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said final plat has been reviewed by the City Planner and had her
approval endorsed thereon; subject to the owner's agreeing to the conditions noted in
Section 3 below; and
Whereas, said final plat has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating to it, .except that streets and
public utilities have not yet been completely constructed or installed.
NOW THEREFORE, BE lT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. Thaf the dedication of Chesterfield Drive (Lots B & C), Stone Valley
Drive (Lot D), Kingsley Lane (Lot E), Kingsley Court (Lot F), Wellington Lane (Lot G),
Wellington Lane (Lot H) and Shrewsbury Lane (Lot I) together with the park land (Lot K)

and the easements for public utilities, sanitary sewer, storm sewer and water mains, as
they appear on said final plat, be and the same are hereby accepted; and
Section 2. That the Final Plat of English Ridge Subdivision is hereby approved
by the Mayor and City Clerk are hereby authorized and directed to endorse the
approval of the City of Dubuque, Iowa, upon said final plat, provided the owners of said
property herein named, execute their written acceptance hereto attached agreeing:
(a) To reduce Stone Valley Drive (Lot D), Kingsley Lane (Lot E),
Kingsley Court (Lot F), Wellington Lane (Lot G), Wellington Lane
(Lot H) and Shrewsbury Lane (Lot I) to grade and to construct
concrete curb and gutter and to hard surface with asphaltic
concrete, or with concrete paving with integral curb, all in
accordance with the City of Dubuque standard specifications, all in
a manner acceptable to the City Engineer, in conformance with
construction improvement plans approved by the City Engineer,
and inspected by the City Engineer.
(b) To install sanitary sewer mains and sewer service laterals into each
individual lot, water mains and water service laterals into each
individual lot, storm sewers and catch basins, boulevard street
lighting and erosion control devices all in accordance with the City
of Dubuque standard specifications, all in a manner acceptable to
the City Engineer, and in accordance with construction
improvement plans approved by the City Engineer, and inspected
by the City Engineer.
(c) To construct a storm water detention facility (Lot A) in a manner
acceptable to the City Engineer, in accordance with the City of
Dubuque standard specifications approved by the City Engineer,
and inspected by the City Engineer. .
(d) To construct sidewalk along Stone Valley Drive frontage of Lot A
and Lot K in accordance with City of Dubuque Standards and
specifications.
(e) To construct said improvements, prior to the two (2) years from the
date of acceptance of this resolution, at the sole expense of the
owners, or future owner.
(f) To maintain the public improvements, for a period of two (2) years
from the date of the acceptance of those improvements by the City
Council of the City of Dubuque, Iowa, at the sole final expense of
the owners, or future owner;

And, further provided that said English Ridge, L.L.C., as owners of said property,
shall secure the performance of the foregoing conditions provided in this Section by
providing guarantees in such form and with such sureties as may be acceptable to the
City Manager of the City of Dubuque, Iowa.
Section 3. Sidewalk installation shall be the responsibility of the owner
abutting the public rights-of-way, including lots with multiple frontages, as required by
City Code 41-100 and 42-24.
Section 4. The owner must continue to own and maintain Lot A and
stormwater detention facility until (1) the facility has been fully completed, (2) 80% of
the platted lots have been fully developed, and (3) adequate erosion control measures,
as approved by the City have been installed on the remaining 20% of the lots.
Acceptance of Lot A and the facility must be by the City Council as required by the
Subdivision Ordinance. Upon the City's acceptance of the detention facility, the
inspection, administrative and maintenance expenses incurred by the City of Dubuque
for the storm water detention facility (Lot A) shall be assessed against the lot owners of
all additions in English Ridge Subdivision as indicated in the. preliminary plat, in
proportion to the acreage of each lot, and the City Manager shall certify such costs to
the City Clerk, who in turn shall promptly certify such costs to the Dubuque County
Treasurer, and such costs shall then be collected with and in the same manner as
general property taxes in accordance with provisions of law.
Section 5. That the final acceptance of the public improvements shall occur
upon certification of the City Engineer to the City Council that the public improvements
have been completed in accordance with the approved improvement plans and City
standards and specifications and accepted by City Council Resolution.
Section 6. That in the event English Ridge, L.L.C., fails to execute the
acceptance and furnish the guarantees provided in Sections 2 and 3 hereof within 180
days after the date of this Resolution, the provisions hereof shall be null and void and
the acceptance of the dedication and approval the plat shall not be effective.

Physical Characteristics: The property currently is farmland southeast of the Highway
20/Cousins Road intersection and west of English Mill Road. Topography ranges from
moderately steep slopes near Highway 20 to gently rolling along English Mill Road. A
branch of the South Fork of the Catfish Creek drains the property.

Previous Conditions of Zoning or Plats: The preliminary plat of English Ridge Subdivision
was approved with the following conditions:
1. That residential lots not have direct access to Stone Valley Drive;
2. That a bike lane be added along Stone Valley Drive and parking be allowed only on
one side;
3. That Lots 39, 40 and 41 be dedicated as park area with one access to Stone Valley
Drive allowed from Lot 39; and
4. That the final plat be submitted to the Zoning Advisory Commission for review.
The Zoning Advisory Commission recommended approval of a previous final plat at the
December 5, 2007 meeting that was larger in terms of number of lots. The Commission at
that time approved the submitted final plat removing conditions #1 thru #3 listed above. The
Zoning Advisory commission received a new Final Plat at their July 2, 2008 meeting. The
Zoning Advisory Commission tabled that Final Plat of English Ridge Subdivision to their
August 6, 2008 meeting as the Developer was changing the location of the proposed
Subdivision Staff Report -Final Plat of English Ridge Subdivision

parkland to be dedicated to the City of Dubuque. The new park location was not reflected on
the submitted Final Plat. The applicant revised the Final Plat to show the new park location
and the Zoning Advisory Commission recommended approval.
Dedication of Open Space or Public Amenities: The applicant is proposing to dedicate a
parcel of land to the City as a public park.
Proposed Streets and Grades: Stone Valley Drive--1.6 - 7.1%; Kingsley Court--3 - 10%;
Kingsley Lane - 8 - 5%; Wellington Lane--3 - 9%; Shrewsberry Lane--1 - 3%.
Recommended Motion: Motion to approve the submitted Final Plat of English Ridge
Subdivision as the submitted Final Plat is in substantial compliance with City of Dubuque
Subdivisions Requirements.
Conformance with Comprehensive Plan: This subdivision meets the Comprehensive
Plan Land Use element Goals: 1.2, 1.5, 4.1, 4.4 and 7.2.
Impact of Request on:
Utilities: Existing utilities can be extended to serve the proposed subdivision.
Traffic Patterns: English Mill Road is a County maintained roadway that carries
approximately 510 average daily trips.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment provided
adequate erosion control is provided during all phases of development of the property
and adequate storm water control is provided.
Adjacent Properties: Staff anticipates the most notable impact to adjacent property will
be additional vehicle trips on English Mill Road and a higher level of ambient light.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted Final Plat of English Ridge Subdivision subdivides
approximately 97 acres into 45 single-family lots and the remaining acreage for future
development of residential and commercial lots. The property is located west of English MIII
Road and east of U.S. Highway 20 and the existing Stone Valley Drive. The subdivision
provides for an extension of Stone Valley Drive from its current terminus to English Mill Road
with 5 new public streets proposed to serve the residential and commercial lots. A portion of

the project is located within the U.S. 20 corridor preservation zone and the entire property is
located within the Iowa 32 (Southwest Arterial) Corridor (copies of both attached).
The Zoning Advisory Commission approved a previous final plat at the December 5, 2007
meeting (minutes attached) that was larger in terms of number of lots. The Commission at
that time approved the submitted final plat removing conditions #1 thru #3. A copy of the
minutes from the December 5, 2007 meeting are attached.
The proposed new public streets witin English Ridge Subdivision will be built to the City's
public street standards. The extension of Stone Valley Drive will be built to the City's
collector street standard of 37 feet of paving and a 60-foot right-of--way. The remaining
streets in the subjdivision will be built to the City's local residential street standard fo 31 feet
of paving and 50 feet of right-of-way.
Sanitary sewer service will be provided through an extension of the sanitary sewer line which
currently serves Stonebrook Center Subdivision. The existing 12 inch water main will be
extended from its current terminus on Stone Valley Drive. The first phase of the subdivision
will be comprised of 45 single-family zoning lots. The lot and street layout is partially dictated
by two existing underground gas mains that run through the subdivision. The developer has
also provided a stub street (Wellington Lane) to the property immediately north of the
proposed English Ridge Subdivision to provide for future access. Engineering has
recommended storm and sanitary sewer be stubbed to the adjacent property for future
development of land owned by John and Carolyn Haupert just east of English Ridge
Subdivision.
A portion of the proposed subdivision lies within the U.S. Highway 20 Corridor Preservation
zone. This portion is on the west end of the subdivision and Chesterfield Drive will provide a
future connection to U.S. Highway 20. This roadway would be constructed as part of the
Southwest Arterial and its interchange with U.S. Highway 20. The proposed Chesterfield
Drive also would serve as a new access to Barrington Lake Subdivision as the existing at
grade intersections of both Stone Valley Drive and Barrington Drive will be eliminated as part
of the construction of the Southwest Arterial and its interchange with U.S. Highway 20.
The proposed English Ridge Subdivision also lies entirely within the Highway 32 (Southwest
Arterial) Corridor. The City Council does have the authority to approve new subdivisions
within the corridor provided that it is determined that the subdivision will not negatively
impact the acquisition of right-of--way along the preferred alignment of Iowa Highway 32. A
copy of the Preliminary Plat of English Ridge Subdivision was provided to the Southwest
Arterial Corridor Technical Committee as well as the Iowa Department of Transportation.
Because the location of the proposed subdivision relative to the Southwest Arterial preferred
alignment and the interchange with U.S. Highway 20, it does not appear that the proposed
layout will significantly impact the acquisition of property necessary to complete the
Southwest Arterial or the interchange with U.S. Highway 20.
The preliminary plat was approved by the City Council, thus complying with the Highway 32
(Southwest Arterial) corridor requirements. The IDOT responded that the area included in
the subdivision plat did not impact the Highway 20 Corridor Preservation Zone.

The submitted final plat provides property for a public park. The Zoning Advisory
Commission approved the preliminary plat subject to Lots 39, 40 and 41 being designated as
park land. The combined area of the three lots totals approximately 67,000 square feet.
The Zoning Advisory Commission can approve the final plat with the proposed park land in
lieu of the area required as part of the preliminary plat.

CALL TO ORDER: The meeting was called to order at 6:30 p.m. by Chairperson Eugene
Bird Jr,
AFFIDAVIT OF COMPLIANCE: Staff presented an Affidavit of Compliance verifying that
the meeting was being held in compliance with the Iowa Open Meetings Law.
MINUTES: Chairperson Bird requested that the response from Bob Hartig to his question
include that the green space in the Medical Associates Clinic PUD was also to screen the
view of the Medical Associates building from the residential properties. The minutes of the
November 7, 2007 meeting were unanimously approved as modified.
ACTION ITEMI FINAL PLAT OF ENGLISH RIDGE SUBDIVISION: Application of English
Ridge LLC for approval of the Final Piat of English Ridge Subdivision located along English
Mill Road.
Larry McDermott, 11407 Highway 20 West, said #hat he started working on his project in
March of 2007. He said that he met with City departments and solicited their input. He
said the requirements for a park and bike path and limitations on drive access did not
surface until the last Zoning Advisory Commission meeting. He said that staff had asked
for parks and bike trails. He said that, due to traffic safety, the park location proposed at
the last Zoning Advisory Commission meeting was shifted to an interior lot. He said the
bike trail is not needed in this subdivision because there is no connection for it.
Mr. McDermott said that the City has not provided clear standards for green development.
He said that covenants for his subdivision require that all houses are energy star rated. He
said there are many other collector streets in the community that have direc# driveway
access and that the section of his subdivision with direct access onto the collector street
will only be a quarter mile in length. He asked the Zoning Advisory Commission to approve
the plat as submitted.

Staff Member Kritz discussed the conditions on the preliminary plat. He noted that
limitations on access, a requirement for a bike lane and final review by the Zoning Advisory
Commission had been proposed. He said that the final plat shifts the park to the interior of
the development from. the original location at the entrance near English Mill Road. He
discussed the park size and access, He reviewed the bike lane alignment and various
parking scenarios for the bike path which he said would eliminate parking and require a
five-foot wide bike lane on both sides of the street. He discussed possible connections
from the bike trail to the proposed alignment for the Southwest Arterial. He said that there
are no current City standards preventing driveway access to a collector_street.
Chairperson Bird asked if the subdivision be phased relative to the park. Mr. McDermott
said that he will initially create 40 lots and that the park will be part of the first phase of the
subdivision. He said that if parking is prohibited on both sides of the street it would be
necessary to create a parking lot for the proposed park area.
Commissioner Hardie stated that the recommendation for bike/hike trails and limitations on
access to the connector street came from the Zoning Advisory Commission, not from City
staff. He said he agrees that the City should have a strategy for green development and
provision of bike trails. He said that he is encouraged that the park will be provided in the
first phase of the development. He said his only concern is that the park may not be ideally
located being next to the C-3 zoned property: He said that it appears that the proposed
bike trail may not have a connection to the bike trail system until well into the future. He
said he is okay with the proposed driveway accesses onto the collector street.
Commission Stiles concurred with Commissioner Hardie. He stated that the Zoning.
Advisory Commission tested the proposed conditions with Mr. McDermott's representative
at the last meeting and he concurred with them.
Chairperson Bird said that he approves of the final plat as submitted.
Staff Member Kritz said that park and trail standards will be proposed through the Unified
Development Code process.
Motion by Hardie, seconded by Smith, to approve the Final Plat of English Ridge LLC as
submitted. The motion was approved by the following vote: Aye -Smith, Hardie, Christ,
Miller, Schiltz, Stiles and Bird; Nay -None.
ACTIN ITEMIFINAL PLAT SERENITY RIDGE: Application of John Herrig for approval of
the Final Plat of Serenity Ridge Subdivision located along Derby Grange Road.
The Commission decided to table the Fina( Plat of Serenity Ridge Subdivision at the
applicant's request.
Motion by Hardie, seconded by Stiles, to table the request. Motion approved by the
following vote: Aye -- Smith, Hardie, Christ, Miller, Schiltz and Stiles; Nay -None.
