Van Milligen, City Manager Sale of City Lot 4A of Mineral Lot 472 John G. Feltes of 2616 Stafford has requested to purchase Lot 4A of Mineral Lot 472, which is located between his property and Linwood Cemetery, and abuts Dubuque Community School District. Finance Director Ken TeKippe states neither Linwood Cemetery nor Dubuque Community School District have any interest in the property, and the City has no plans for the utilization of this property except for reserving the utility easements as noted. Ken TeKippe recommends disposition of the City's interest in this property, and that the purchase price be established at $1, plus publication and filing fees. Van Milligen, City Manager Ken TeKippe, Finance Director Sale of City Lot 4A of Mineral Lot 472 DATE: July 24, 2002 INTRODUCTION Joseph G. Feltes, 2616 Stafford has requested the purchase of Lot 4A of Mineral Lot 472. The lot size is approximately 22' x 268' and located between his property and Linwood Cemetery and abuts Dubuque Community School District and Stafford Street. A copy of Mr. Feltes' letter requesting the purchase is attached. DISCUSSION The attached vicinity map shows the proposed area to be disposed of. The abutting properties are owned by Joseph G. Feltes, Linwood Cemetery, Dubuque Community School District (Jefferson Junior High practice field) and City owned Stafford Street. The existing parcel is not a city street or alley that needs to be vacated. Joseph G. Feltes indicated that he had maintained the property for over two years. I visited with Sandra Smith, General Manager of the Linwood Cemetery Association and Joseph Link, Business Manager for the Dubuque Community School District. Neither organization is interested in the property. RECOMMENDATION The City has no plans for the utilization of Lot 4A of Mineral Lot 472 to be disposed of except for reserving the utility easements as noted. I would recommend that a public hearing be set for the disposition of the City's interest in Lot 4A of Mineral Lot 472 on August 19, 2002. I would further recommend that the purchase price be established at $1, plus publication and filing fees. ACTION TO BE TAKEN The recommendation of the City Manager should be approved and a public hearing should be scheduled on the sale of the property by adoption of the enclosed resolution. KT/jg Enclosures RESOLUTION NO. 420-02 RESOLUTION DISPOSING OF CITY INTEREST IN LOT 4A OF MINERAL LOT 472, DUBUQUE, IOWA Whereas, pursuant to resolution and published notice of time and place of hearing, published in the Telegraph Herald, a newspaper of general circulation published in the City of Dubuque, iowa on the 9t.h day of August ,2002, the City Council of the City of Dubuque, iowa met on the 19th' day of Auqust , 2002, at 6:30 p.m. in the Public Library Auditorium, 360 West 11th Street, Dubuque, Dubuque County, iowa to consider the proposal for the sale of real estate described as: Lot 4A of Mineral Lot 472, City of Dubuque, Dubuque County, Iowa Whereas, the City Council of the City of Dubuque, iowa overruled any and all objections, oral or written to the proposal to sell such real estate. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY ~j:OF DUBUQUE, IOWA: Section 1. That the Mayor be authorized and directed to execute a Quit Claim Deed, and the City Clerk be and is hereby authorized and directed to deliver said deed of conveyance to Joseph Feltes upon receipt of the purchase price in full, and payment of publication and filing fees. I have spoken with Ron Turner at the City Engineem office to have the area checked for sewer and utilities. Ron stated that there are no sewer or utililies in that area and that the vacating of this piece of land was favorable. The property is located on Stafford Aveoue. See attaehad diagram. It runs adjacent to property that I own, It is Lot 4A of Minerai Lot 472. It is 22 feet by 267.811 feet and is located between Linwood Cemetery and my property. The reason for my wanting to acquire this piece of property is because I would like to enhance the land with shrub life and maintain already existing trees and grass. I have done my best to maintain this land so that my property appearance is acceptable and welcoming. I have done this for the past 2.5 years. If this is possible, T will work closely with the City Engineer's Office to obtain writtea consent of the contiguous property ownem. Thank you for your consideration in this matter.
