Sale of Vacant Lot 130 of Lenox Addition
A number of individuals recently contacted the City relative to the potential acquisition of
City-owned lots not currently being utilized for City purposes. Sealed bids were
accepted for City-owned property described as Lot 130 of Lenox Addition. Finance
Director Ken TeKippe states that the City has no plans for the utilization of said
property, and recommends that the property be sold to the high bidders, Eric and Bonita
Timmerman, for a purchase price of $500, plus publication and filing fees.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
A number of individuals recently contacted the City relative to the potential acquisition of
City owned lots not currently being utilized for City purposes.
BACKGROUND
A copy of the public notice and bid form, as well as a recap of bids received, is
attached. The Lenox property received bids from Eric and Bonita Timmerman and Noel
Ploessl. The attached vicinity map shows the location of Lot 130 of Lenox Addition to
be disposed of.
RECOMMENDATION
The City has no plans for the utilization of Lot 130 of Lenox Addition, except for
reserving the utility easements as noted.
I would recommend that a public hearing be set for the disposition of the City's interest
in Lot 130 of Lenox Addition on August 19, 2002. I would further recommend that the
purchase price be established at $500, plus publication and filing fees, and that the
property be sold to the high bidders, Eric and Bonita Timmerman.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public hearing
should be scheduled on the sale of the property by adoption of the enclosed resolution.

RESOLUTION DISPOSING OF CITY INTEREST IN LOT 130 OF LENOX
ADDITION, DUBUQUE, IOWA
Whereas, pursuant to resolution and published notice of time and place of hearing,
published in the Telegraph Herald, a newspaper of general circulation published in the
City of Dubuque, Iowa on the 9th . day of August, ,2002, the City Council of the
City of Dubuque, Iowa met on the 19th day of Au.qust , 2002, at 6:30 p.m. in the
Public Library Auditorium, 360 We~t' 11t~ Street, Dubuque, Dubuque County, Iowa to
consider the proposal for the sale of real estate described as:
Lot 130 of Lenox Addition City of Dubuque, Dubuque County, Iowa
Whereas, the City Council of the City of Dubuque, Iowa overruled any and all
objections, oral or written to the proposal to sell such real estate.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the sale of Lot 130 of Lenox Addition in the City of Dubuque, Iowa
to Eric and Bonita Timmerman and the same is hereby approved for the sum of $500,
plus cost of publication and filing fees. Conveyance shall be by Quit Claim Deed
subject to reservation of utility easements.
Section 2. That the Mayor be authorized and directed to execute a Quit Claim
Deed, and the City Clerk be and is hereby authorized and directed to deliver said deed
of conveyance to Edc and Bonita Timmerman upon receipt of the purchase price in full
and payment of publication and filing fees.
Section 3. That the City Clerk be and is hereby authorized and directed to record
a certified copy of this resolution in the office of the City Assessor, Dubuque County
Recorder and Dubuque County Auditor.
Passed, approved and adopted this 19th day of August, 2002.

PUBLIC NOTICE
The City of Dubuque invites sealed proposals for the pumhase of the vacant City-owned
lots described below. Sealed proposals will be accepted until 1:00 p.m., Friday, May 17,
2002. Proposal forms may be obtained by calling (563) 589-4133. Appraisals of the
properties ara available for review in the Finance Office at City Hall. Persons submitting
proposals will raceive a tabulation of all proposals raceived. The successful purchaser
will be responsible for publication and filing fees and any other fees necessary for the
transaction.
All proposals must be filed with the City Clerk at City Hall by 1:00 p.m. on the 17th day of
May, 2002. The City reserves the right to reject all bids.
All sales will be by quit claim deed. The purchase of any property is subject to final
