Sale of Vacant Lots 3 and 4 in Block 9 Birch Acres
A number of individuals recently contacted the City relative to the potential acquisition of
City-owned lots not currently being utilized for City purposes. Sealed bids were
accepted for City-owned property described as Lots 3 and 4 in Block 9 Birch Acres.
Finance Director Ken TeKippe states that the City has no plans for the utilization of said
property, and recommends that the property be sold to the high bidder, Jeff Arensdorf,
for a purchase price of $27,000, plus publication and filing fees.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Sealed bids were received for the sale of vacant Lots 3 and 4 in Block 9 Birch Acres.
The City has no plans for the utilization of these lots, except for reserving the utility
easements as noted. Therefore, it is recommended that Lots 3 and 4 in Block 9 Birch
Acres be sold to the high bidder, Jeff Arensdorf, for a purchase price of $27,000, plus
publication and filing fees.

RESOLUTION DISPOSING OF CITY INTEREST IN LOT 3 BLOCK 9 BIRCH
ACRES AND LOT 4 BLOCK 9 BIRCH ACRES, DUBUQUE, IOWA
Whereas, pursuant to resolution .and published notice of time and place of headng,
published in the Telegraph Herald, a newspaper of general circulation published in the
City of Dubuque, Iowa on the 9th day of August ,2002, the City Council of
the City of Dubuque, Iowa met on the 19th day of Auqust , 2002, at 6:30 p.m. in the
Public Library Auditorium, 360 West 11th Street, Dubuque, Dubuque County, Iowa to
consider the proposal for the sale of real estate described as:
Lot 3 Block 9 Birch Acres and Lot 4 Block 9 Birch Acres City of Dubuque, Dubuque
County, Iowa
Whereas, the City Council of the City of Dubuque, iowa overruled any and all
objections, oral or written to the proposal to sell such real estate.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the sale of City of Dubuque real property described as Lot 3 Block
9 Birch Acres and Lot 4 Block 9 Birch Acres in the City of Dubuque, Iowa to Jeff
Arensdorf and the same is hereby approved for the sum of $27,000, plus cost of
publication and filing fees. Conveyance shall be by Quit Claim Deed subject to
reservation of utility easements.
Section 2. That the Mayor be authorized and directed to execute a Quit Claim
Deed, and the City Clerk be and is hereby authorized and directed to deliver said deed
of conveyance to Jeff Arensdorf upon receipt of the purchase price in full, and payment
of publication and filing fees.
Section 3. That the City Clerk be and is hereby authorized and directed to record
a certified copy of this resolution in the office of the City Assessor, Dubuque County
Recorder and Dubuque County Auditor.

INTRODUCTION
A number of individuals recently contacted the City relative to the potential acquisition of
City owned lots not currently being utilized for City purposes.
BACKGROUND
A copy of the public notice and bid form, as well as a recap of bids received, is attached.
The Birch Acres property received bids from Jeff Arensdorf, Tom Gansen, Eric Frommelt,
and Paul Wheelock. The attached vicinity map shows the proposed area Lot 3 Block 9
Birch Acres and Lot 4 Block 9 Birch Acres to be disposed of.
RECOMMENDATION
The City has no plans for the utilization of Lots 3 and 4 in Block 9 Birch Acres to be
disposed of, except for reserving the utility easements as noted.
I would recommend that a public hearing be set for the disposition of the City's interest in
Lot 3 Block 9 Birch Acres and Lot 4 Block 9 Birch Acres on August 19, 2002. I would
further recommend that the purchase price be established at $27,000, plus publication and
filing fees and that the property be sold to the high bidder, Jeff Arensdorf.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public hearing should
be scheduled on the sale of the property by adoption of the enclosed resolution. Thank you
for your assistance.

Whereas, Jeff Arensdorf has offered to purchase Lot 3 Block 9 Birch Acres and
Lot 4 Block 9 Birch Acres owned by the City of Dubuque: and
Whereas, the City Council of the City of Dubuque, Iowa has determined that Lot 3
Block 9 Birch Acres and Lot 4 Block 9 Birch Acres are no longer required for public use,
and that the sale of Lot 3 Block 9 Birch Acres and Lot 4 Block 9 Birch Acres in the City
of Dubuque, Dubuque County, Iowa should be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the City of Dubuque intends to dispose of its interest in Lot 3
Block 9 Birch Acres and Lot 4 Block 9 Birch Acres in the City of Dubuque, Iowa.
Section 2. That the conveyance of Lot 3 Block 9 Birch Acres and Lot 4 Block 9
Birch Acres in the City of Dubuque, Iowa subject to easements of record to Jeff
Arensdorf be contingent upon the payment of $27,000, plus publication and filing fees.
Section 3. The City Clerk is hereby authorized and directed to cause this
Resolution and a notice to be published as prescribed by Iowa Code Section 364.7 of a
public hearing on the City's intent to dispose of the foregoing-described real property, to
be held on the 19th day of Au.qust , 2002, at 6:30 o'clock p.m. at the public library
auditorium, 11th & Locust, Dubuque, iowa.

PUBLIC NOTICE
The City of Dubuque invites sealed proposals for the purchase of the vacant City-owned
lots described below. Sealed proposals will be accepted until 1:00 p.m., Friday, May 17,
2002. Proposal forms may be obtained by calling (563) 589-4133. Appraisals of the
properties are available for review in the Finance Office at City Hall. Persons submitting
proposals will receive a tabulation of all proposals received. The successful purchaser
will be responsible for publication and filing fees and any other fees necessary for the
transaction.
All proposals must be filed with the City Clerk at City Hall by 1:00 p.m. on the 17t~ day of
May, 2002. The City reserves the right to reject all bids.
