The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, indicating that the submitted plat consolidates the existing property into two lots. Staff reviewed the plat of survey, indicating that the applicant's house is on Lot 1 and that Lot A is a steep wooded hillside. The Zoning Advisory Commission discussed the request, noting that Lot A is not conducive to residential development. Recommendation By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. The submitted plat of survey consolidates the 12 lots of West Ridge Subdivision, Second Addition into two lots - Lot 1 and LotA. The applicant vacated the platted right-of-way of Kane Street in 2001 as the topography of the property made it impractical to develop this subdivision. DISCUSSION The submitted plat of Survey of Lot 1 and Lot A of West Ridge Third Addition consolidates the. 12 building lots and Kane Street right-of-way into two lots. Mr. Miller is constructing a new house on Lot 1 that has direct access to the cul-de-sac portion of Kane Street, There is a 20' by 50' access easement shown on the plat of survey that will ensure access to Lot 13 West Ridge Second Addition where there is an existing single-family home located. Lot A has no street frontage. The applicant is requesting that the Zoning Advisory Commission waive the lot frontage requirement for Lot A. The topography of this lot makes it very unlikely that it will be developed for a single-family home. The Zoning Advisory Commission can require that Lot A be designated as "unbuildable" if there is a concem that it would be used as a building lot in the future. RECOMMENDATION Planning staff recommends that the submitted plat of survey of Lot 1 and Lot A of West Ridge Third Addition be approved subject to the Zoning Advisory Commission waiving the lot frontage requirement for Lot A and designating the tot as non-buildable. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow Lot A with 0 feet of lot frontage, where 50 feet is required. Section 2. That the Plat of Survey of Lot I and Lot A of West Ridge Third Addition, a Division of Lot 1-12, Inclusive, and Lot 13-A of West Ridge Second Addition is hereby appreved, and the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa upon said final plat.
