Public Works Director Mike Koch recommends award of the contract to the only bidder, River City Paving, in the amount of $1,241,143.29, which is 7.54% over the engineer's estimate. Koch, Public Works Director SUBJECT: Jackson Street and West Locust Street Resurfacing INTRODUCTION The enclosed resolution provides for the award of the Jackson Street and West Locust Street Resurfacing Project. DISCUSSION The Jackson Street and West Locust Street Resurfacing Project will consist of the milling of the exiting surface along the gutter and a 2" overlay for Jackson Street from 22nd to 30th Street and West Locust Street from 17th to Clarke Drive. The project will also include the replacement of catch basins and deteriorated portions of curb and gutter. Fiber optic conduits will be installed along the West Locust Street portion. The Iowa Department of Transportation (IDOT) received one sealed bid on the project on August 20, 2002. River City Paving, a division of Mathy Construction Co. of Kieler, Wisconsin, submitted the Iow bid in the amount of $1,241,143.29. This amount is 7.54% over the engineer's estimate. RECOMMENDATION I recommend that the contract be awarded to River City Paving in the amount of $1,241,143.29. BUDGET IMPACT The summary of the project costs is as follows: Estimate Bid Construction Contract $1,154,095.25 $1,241,143.29 Contingency 115,409.53 115,409.53 Engineering 63,475.24 63,475.24 Total Project Cost $1,332,980.02 $1,420,028.06 The project will be funded by 80% Federal STP funds (with a maximum of $720,000), with the City paying the remaining 20%. Whereas, said sealed proposals were opened and read on the 20th day of August, 2002, by the Iowa Department of Transportation (IDOT), and it has been determined that the bid of River City Paving, A Division of Mathy Construction Co., of Kieler, Wisconsin, in the amount of $1,241,143.29 was the lowest bid for the furnishings of all labor and materials and performing the work as provided for in the plans and specifications. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: That the contract for the above improvement be awarded to River City Paving, A Division of Mathy Construction Co. of Kieler, Wisconsin, and the Manager be and is hereby directed to execute a contract on behalf of the City of Dubuque for the complete performance of the work. Because of a possible construction overlap with the White Street Reconstruction Project, the specifications for the Jackson Street Paving Project will not allow the contractor to start until July 1, 2003, which is after the completion date for the White Street Project. Marriott in Des Moines, Iowa no later than 9:00 o'clock am on 20th of August, 2002 for the construction of Jackson Street and West Locust Street Resurfacing. Copies of the plans and specifications may be obtained in the Office of Contracts at Iowa Department of Transportation in Ames, Iowa until noon on the previous day of the letting. Payment to the contractor will be made from funds as may be legally used for such purposes. Failure to execute a contract and file an acceptable performance bond and Certificate of Insurance within 30 days of the date of the approval fro awarding the contract, as herein provided, will be just and sufficient cause for the denial of the award and the forfeiture of the proposal guarantee. All proposals must be filed on the forms furnished by Iowa Department of Transportation, Contracts office, sealed and plainly marked. Proposals containing any reservations not provided for in the forms furnished will be rejected, and the Iowa Department of Transportation reserves the right to waive technicalities and to reject any or all bids. A Proposal guaranty shall be not less than the amount as set forth in the proposal form shall be filed with each proposal. The Proposal guaranty shall be in the form as specified by lowa Department of Transportation The successful bidder will be required to furnish a performance bond in an amount equal to one hundred percent (100%) of the contract price. Said bond is to be issued by a responsible surety company approved and acceptable to the City Council and Iowa Department of Transportation, and shall guarantee the faithful performance of the contract and terms and conditions therein contained, and shall guarantee the prompt payment of all materials and labor and protect and save harmless the City of Dubuque, Iowa, and Iowa Department of Transportation from claims and damages of any kind caused by the operations of the Contractor. Said Bond shall also guarantee the matedal and the maintenance of the improvement(s) constructed for a minimum period of two (2) years from and after its completion and acceptance by the City Council. No bid submitted by any Contractor which contains a condition or qualification shall be recognized or accepted by the City Council and Iowa Department of Transportation and any letter or communication accompanying the bid which contains a condition or qualification upon the bid which has the effect of qualifying or modifying any provision of the specifications in any manner will be construed as a non-qualifying bid and will be rejected by the City Council as not responsive.
