City Engineer Gus Psihoyos is recommending the vacation of Gillespie Street, Fink
Street and the adjacent alley, which are now located within the West 32"d Street
Detention Basin.

SUBJECT: Vacating Gillespie Street, Fink Street, and Adjacent Alley
INTRODUCTION
This is in response to a request from City Engineering for the vacating of Gillespie
Street, Fink Street, and the adjacent alley which are located within the West 32"d Street
Detention Basin.
DISCUSSION
The attached plat of Lot 1 of Gillespie's Second Addition shows the proposed areas of
Gillespie Street, Fink Street, and the adjacent alley to be vacated. The abutting
properties are owned by the City of Dubuque.
The areas to be vacated will be consolidated into said Lot 1. No public utilities exist
within the area to be vacated.
The vacated property is a part of the West 32"d Street Detention Basin.
RECOMMENDATION
The City has no plans for the utilization of Gillespie Street, Fink Street, and the adjacent
alley to be vacated, except as use for the detention basin.
would recommend that Gillespie Street, Fink Street, and the adjacent alley as shown
on the attached plat be vacated, and that a public hearing be set for the disposition of
the public interest in the subject area on February 16, 2009.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public hearing
should be scheduled on the vacating of the property through adoption of the enclosed
resolutions.

RESOLUTION NO. 40-09
RESOLUTION OF INTENT OF VACATE PUBLIC INTEREST IN GILLESPIE
STREET, FINK STREET, AND ADJACENT ALLEY IN THE CITY OF
DUBUQUE, DUBUQUE COUNTY, IOWA
Whereas, the Engineering Department has requested the vacating of
Gillespie Street, Fink Street, and adjacent alley; and
Whereas, MSA Professional Services has prepared and submitted to the
City Council a plat showing the vacated portion of Gillespie Street, Fink Street,
and adjacent alley, which hereinafter shall be known and described as part of Lot
1 of Gillespie's Second Addition in the City of Dubuque, Dubuque County, Iowa,
should be approved.
NOW, THEREFORE, BE IT RESOL~/ED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
Section 1. That the City of Dubuque intends to vacate public interest in
Gillespie Street, Fink Street, and adjacent alley in the City of Dubuque, Iowa.
Section 2. That the City Clerk be and is hereby authorized and directed
to cause a notice of intent to vacate of said real estate to be published in the
manner as prescribed by law.
